UPDATE UPDATE

 

Hi All

 

I have today recieved some comms from Banner Jones, it is the Claimant's reply to my Defence. titled ..REPLY TO DEFENCE.

 

The paperwork has many bullit points along with exibits?

 

Ok, so I have a direction hearing early April, should I reply to their response? should I be making interim payments towards this too?

Hi All

 

W e have recently finished paying for a vehicle financed through Santander. However, and unfortunately in my case there was a twist, 2 yr ago we got a letter from close credit management advising us of the NOA? ( cant locate ) and so we agreed payments etc. we have cleared all monies owing and there is no outstanding etc.

 

I want to claim back charges? cca? dsar? as we have never questioned any of this scenario. do you think this is worth pursuing?

Subject Access Request under the Date Protection Act 1998 to the Data Controller at Santander will provide you wih all the data that is held on your account.

There is a £10,00 statutory fee for this Santander have 40 days to comply.

 

There is a template in the CAG Library for you to use.

 

Send the SAR by recorded delivery and check th date it's received, the 40 days starts then.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

Hi All.

 

Ok a few year ago I had a loan for vehicle with OC= Santander, fell into difficulty etc, defaults etc, but then Close Credit Ltd, ( now known as Bluestone Credit ) took over the loan. The loan is now closed and paid in full.

 

However I want to dsar this account, Bluestone say they have the info? but shouldnt I request from the OC?

Were they just collecting on behalf of Santander or did they buy the debt?

 

Normally the SAR would go to the original creditor.

 

Is this for a charges reclaim and/or PPI or something else?

Hi ims. Close Credit advised me today that they purchased from Santander. and said to sar them? I explained the request normally goes to OC. I want this to have a look at account for poss charges and ppi etc.

I would send to Santander - how long have Close Credit/Blue Tooth been dealing with the account ? There would be no point in making a SAR request of them unless they have had the account for at least 2 years or more.

If it were me I would SAR the original creditor.

 

It is likely that all Bluestone got was a spreadsheet with names, addresses and amounts on it. They also would not have applied the charges or the PPI, the original creditor would and they will be your target for any reclaims.

Bluestone said that they only got paperwork with what you mention above.
