Can anyone give me the current appropriate address for MBNA HQ so that I can send them a Subject Access Request. To summarise, my account with them goes back to 1998, around 2000 we got into financial difficulties and from then on I paid nominal amounts to Link every month. I know that an awful lot of money in charges was added to the account. I have been told here I can claim back charges, & PPI. I need the information first so after sending Link an 'account in dispute letter' as recommended above a few months ago, I sent Link a SAR letter. They responded with computerised lists of actions only since they had taken over the account.

I am assuming therefore that I now need to SAR MBNA direct. Has anyone got the address please and any further advice? (Will they give me the details I require with a SAR as it goes back to 1998-2000?)

Telephone the Information Commissioners Office (ICO) on Tuesday morning and ask them for MBNA's Compliance Department's correct address details.

Thankyou very much for that. I will do that. Can our claim for charges go back that far, ie 1998?

 

Prudence

 

When you serve your SAR upon MBNA, request a comprehensive list of all charges applied to the account to include - the breach relied upon, the date thereof, the amount applied for each breach relied upon. Any amount applied as a result of a breach by you must reflect the actual damages suffered by the Bank, the amount(s) applied must not be excessive/disproportionate. 6 years is the max that you can claim back any excessive amounts that have been applied to the account.

 

They will not play ball with you, so you must persist with your request to be refunded. PPI refunds are to be paid directly to you also.

Thanks very much The Mould. I'm a bit peeved that Link could not provide full details of the sum they are demanding from me when I sent them an SAR! Aren't they obliged to get that information from MBNA for me now that I've paid them and got nothing that helps me in return?

Well, oh by the way, I forgot to say that today is a normal working (business) day so, the ICO may well be open, perhaps you could telephone them today and obtain the info on MBNA's correct address for DPA issues/complaints.

 

When the account/debt was sold, MBNA probably only provided details of the amount owing and a copy of the agreement, most of the info held on the account has most likely been placed into archive storage by MBNA, so Link might only have limited account information, you are right though, the history of the records for the account should be provided to the new owner of the contract along with the original contract, MBNA should keep a copy of the original and supply the new owner (assignee) with the original document as title has now passed to them.

 

In your SAR to MBNA, request copies of all info held in archives also.

Hi, I tried several times to get the address from the ICO but was kept hanging on for absolutely ages so in the end, I just sent off the SAR to an address I found somewhere on here, which was:

Hi All

It's now more than 40 days since I sent the SAR request to MBNA and haven't heard a thing from them, not even an acknowledgment, tho still being pursued by Link. Any advice on what to do next please as without the information, I am unable to pursue the PPI/charges claims. Many thanks, Pru

Hi Prudence.....you now need to send a letter headed LETTER BEOFRE ACTION, give them a further 7 or 14 days to comply with your request, enclose a copy of the original SAR letter and send it off by recorded delivery - an example here - POST #17 - http://www.consumeractiongroup.co.uk/forum/showthread.php?178660

hello pru, just read your thread and ive got the excact same appliction form as yourself. im waiting on advice about my sar wether to sent it stating my previous married name or the name on the application form that link have sent me. hope things are working outfor you. kind regards joleen.

Hi All, sorry to hear you are having problems with these rogues to Joleen. Well I got a reply to my SAR a few days ago and came on here to ask what I should do next? PPI was included by the way. It is ticked on the form but I do not remember requesting it and also it may sound stupid but it doesn't look like my sort of tick!! Joleen if I were you I think I would quote both names in the SAR to be sure but I hope someone will confirm that for you on here who is better informed than me. If someone could advise on my next steps I would be grateful. I am still being pursued by Link and as my last payment to them was only last year I am concerned to sort this out somehow.

The Mould or 42Man if you are around I would appreciate any advice. I have received the SAR from MBNA. I have been reading around the site but I am getting more confused. Looking at the SAR, it seems I was charged around £450 in total in payment protection payments before the account was sold on to Link (on a previous Statement it states it was assigned in 2002 but at the end of the statement of charges I've just received it says "Adjustment to Balance" and the whole amount as a -figure. Then underneath a 2004 date stating "Charge Off Adjustment" with the same negative figure). Could you please advise on what I should do next? Many thanks.

As regards the SAR Prudence, then they may still send any other information before the 40 calendar days is up. Once that 40 days has passed then you would need to write a LETTER BEFORE ACTION, enclosing a copy of the original SAR you sent giving them a further 14 days to comply. What they have to do is confirm that they hold nothing else on you with regards to any other accounts...there is an example of a LBA here - http://www.consumeractiongroup.co.uk/forum/showthread.php?178660

Thanks very much 42man. The 40 days are up and I have not received anything further though I am being hotly pursued by DCAs who are getting more and more threatening. Link especially. I have checked through the SAR and I have been sent the following:

Explanation & key of terms used/abbreviations

Autoscore SM Card Application details

Copy of application form (incidentally, the payment protection altho ticked does not look like my 'sort of tick' and also there is a date stamped right at the side of it as '18 Aug' altho I signed the form 22 June & has their date stamp as 'Verified 3 July'!!)

Copy of Terms & Conditions

Screenshots of 'Account updates/information

Credit Card agreement with my address on it but no signatures

Customer Info System - Communications Logs (sold to Link 2004)

Additional Communications Log (lots of abbreviations not mentioned in the 'key')

Statement of life of the card till sold on to Link

 

Do I still need to send a Letter Before Action, if not what should be my next steps please?

In which case it would seem like there may have been some skullduggery involved with your PPI Prudence......I think you should write a brief letter outlining the blatantly missold PPI (with the dates you mention on the application) and make them (Link) aware of the court case above (highlighted in the link I gave). Obviously you would have to weigh up some kind of settlement with them (if you choose this option) BUT get it all in writing, recorded delivery. It is either this option or you wait until Link bring it to court.....

 

Something along the lines of this...

 

Dear Sirs / Madam

 

Further to your recent communication, I have received a number of documents relating to a Subject Access Request made by me to MBNA. There are several issues which I intend to query, the main one being that despite not knowing that I had any kind of PPI insurance, it is also apparent that the 'ticked' box was not ticked by me. You should also make note of recent court cases with regard to MBNA and missold PPI

 

In light of some serious irregularities with dates regarding this account and in lieu of both excessive charges and PPI issues I am prepared to make a settlement off of XXXX

 

I will also request that any adverse credit information is removed from my files.

 

I will await your response within 14 days

Hi All

Hope someone can help with this. I am still battling with finances/debts resulting from a failed business back in 2000. We had a loan and a cc from m b n a and I have recently received SAR data from them - all relating to the cc and no mention of the loan account whatsoever. I have had great advice re this part (dodgy PPI) and am writing to the relevant dca. I was paying Ca bot for years re the loan nominal £5 p.m. payments but changed accounts last summer and stopped. I am being hotly pursued by them now and could anyone advise how I should handle it. I notice the balance is almost three times its original value by the way. Any advice would be gratefully refceived. Pru
