No, they will just say that the CCA cannot be found, but that does not mean that one does not exist. I believe the courts in a few cases, have confirmed that companies can send information to CRA's in these circumstances.

Hi folks, a wee update here.

 

I recently got an email from Equifax, as I'd asked them to investigate this, too. They mentioned AK wanted to talk to me regarding this default, and I assumed they had changed their minds.

 

I made a phone call a couple of days ago, and explained the situation to the adviser I spoke to, and he confirmed that the default was going to be removed. He put me on hold to check with their compliance department, and then came back through, and said yes it can be done online.

 

This morning I have got a letter saying that AK are refusing to do it, which I'm obviously not impressed about. Seeing as they agreed to do it, then changed their minds, does this mean I can force them to do it through a complaint to the relevant ombudsman (FOS, I think?)?

Submit a complaint with AK and threaten to go to the FOS. I believe the FOS will look into this, as the default would obviously have an effect on financial transactions.

 

I suppose it is also a Data Protection issue, so you could also involve the ICO.

In what way would it be a data protection issue?

 

I'm currently composing a nice email to AK, and would like to include as many angles of attack as possible.

 

AK have an obligation under DP for the accuracy of the data and the CRA's have responsibility to ensure that the data they hold is accurate.

 

Have a read through the principles pages on the ICO site to inform you. http://www.ico.gov.uk/for_organisations/data_protection/the_guide.aspx

Email sent off, and received a confirmation back today saying it had been passed to the relevant department.

 

I kept it civil, and mentioned at the end I was considering going to the FOS, and reporting them to the ICO, but that to save time and money for both of us, I would appreciate it if they could sort it quickly.

 

Hopefuly this won't take long to resolve.

YYYYYYYYYYYYYYYYEEEEEEEEEEEEEEEEESSSSSSSSSSSSSSSSSSSSS!!!!!!!!!!!!!!!! RESULT!

 

Stephanie from Aktiv Kapital called to say that they'd listened to the call, and they are going to remove the default! she said that the guy I spoke to messed up, and shouldn't have said what he did, but they're going to take it off, and it'll show in 2 or 3 days!

 

WOO!
