Hi,

I have decided to default on my PayDayUK loan as I cannot afford more than the monthly interest, thus not reducing the overall amount. I plan to pay them the same amount once Collections have been in touch once the 28th has past.

 

Does anyone know if they will record something on my credit reports? There is nothing showing on either Equifax or Experian in the way of having anything owed to them.

 

Has anyone else defaulted with (specifically) PDUK? Did they put something on your reports, or are they clear?

They did put something on my credit report but not a default yet.

They did put something on my credit report but not a default yet.

 

Something as in what? late payment marks?

As mentioned, today was the day my payment is due and waiting for me this morning is the following standard email (where is says PAYMENT AMOUNT is exactly how it is in the email.:

Below is my pleasant-now-lets-be-fair-and-approachable reply:

 

Dear Sir/Madam,

 

I respond to your email as below. I have recently lost my job and am

currently in reciept of Job Seekers Allowance at £65 per week. With regret,

that means I am currently unable to meet my obligation to you. Naturally, I

am keen to repay the amount owed as quickly as possible, and I hope that I

will not be out of work for too long.

 

In the interim period, I would like to offer a repayment schedule of £30 per

calendar month, payable on the 1st of each month or the first working day

after that. As May 1st is a Saturday, I offer the first payment, if you are

agreeable on 4th May 2010. I would like to make this payment as a direct

payment into your account. This is for my own security in managing my budget

effectively.

 

I anticipate that my offer may not be high enough for you, so I will

pre-empt that by stating now that whilst I am in reciept of benefits, £30

per calendar month is non-negotiable.

 

Therefore I would be very grateful if you can reply to this email with

details of which account and reference number I should use to pay the money

to you.

 

Please understand that this offer is conditional; I respectfully request

that you freeze all interest and charges on the account so that I am able

to make good progress in paying the outstanding balance. I would like to

point out to you that I have been a customer of yours for a year now and

have until now, had a perfect record with you.

 

When I return to full time employment I will be able to re-evaluate my

budget and expedite the repayment of any balance left at that time.

 

Please note that I am no longer contactable on either phone number you have

on record, this is due to my current financial difficulties. The landline

has been cut off, and the mobile contract sold on, so please do not phone

who I sold the phone to, she will not be able to assist you. Therefore email

is the quickest and most unambiguous way of resolving this matter.

I've been reliably informed that I had 3 phonecalls and answerphone messages from PDUK on Wednesday and 1 text message (which detailed exactly how much I owe). No phonecalls since then though.

 

No answer to my email either. Looks like they won't get their first £30 on the 4th then :rolleyes:

I recieved another email from PDUK today (poor sods have to work a Bankk Holiday lol) asking them to contact them.

 

I replied to that as follows....

I refer you to my previous email dated 28th April 2010. I am disappointed

that after 5 days I have yet to recieve a reply. £30 is waiting to be paid

to you as soon as I recieve your reply containing your banking details and

reference number.

 

I must also point out that in that email, I advised you that the mobile

number on your records is no longer held by me, and as you have now had that

email for 5 days, I will now point out that any further phone calls to that

number, including text messages must cease immediately. Any text messages or

answerphone messages left on number 077XX XXXXXX after the timestamp of this

email will be treated as a breach of the Data Protection Act, and if

discovered, I will pursue the matter to it's fullest extent.

3 Digit Security Number

Start Date (if applicable)

Once we have these details we can set the payment arrangement in place starting from the 4th May 2010.

Please confirm the dates that we will be able to take the regular payments.

Once we have this information then we will set this up on the system for you and an email will be sent confirming this.

 

Please note that until a payment is made on the account, you are still liable for the payment in full so it is advisable that you respond to this email as soon as possible.

 

Did you know that as we work with a credit reference agency, we share your account information on a monthly basis, so when you repay your loan on time, this could also help to improve your credit rating. arranged for my money to be paid into another account. So any attempts on my

account will prove fruitless.

Every email to them is another bullet in the gun should this get to court.

 

Question for everyone:

 

If they refuse this offer or continue to ignore me and push this matter to a DCA, can/should I refuse to deal with them (especially if they ask for more than £212.50) and allow them to take me to court? Or should I play ball with the DCA if the amount is the same? Can I dispute anything extra added if handled by a DCA, given my attempts to resolve this directly with PDUK?

Brilliant dizzle - love the do not ignore this matter will no go away.:p

 

Personally I would now leave them to it. If they pass to dca treat them in the same way. They would look like right muppets if they went to court. Once they know court threats do not phase you they will have to negotiate or not get paid.

Yes, I thought that would raise a smile or two :)

 

I think I spooked them once I told them the card they have for me had been blocked, as the dialogue was flowing quite freely up until that point. I really wouldn't be surprised if the next thing I hear from them is a DCA letter through the post. :roll:

 

Don't think they like customers who won't roll over at their request. :D

I've started getting Mail Delivery Error reports from them (I've seen other threads on here reporting similar problems). I have sent them an email from my Hotmail account to see if I get a response this time around.

No problem at all and thanks for the compliment.

 

I'm documenting everything here so that it serves as help for anyone else in a similar situation.

 

I've not heard back from them as yet, but will keep updating as and when.

Another 24 hours later and nothing else from them. So, my absolute final email to them, completing the working week.

 

I have no idea if what is highlighted in bold would hold up in any court or not (probably not), but we'll see if it pulls a response from them lol.

If, after close of business today, Friday, 7th May 2010, you decide that you do think I should repay you the outstanding balance of £212.50, you will have to take action through the County Court and explain to the Judge why my offer has not been taken up by yourselves. I will attend the hearing.

 

I will not enter into correspondence with any Debt Collection Agent regarding this matter, as this should already have been long since dealt with by yourselves.

We have tried on numerous occasions to confirm the payment arrangement with you by email as per your request, but it appears that these are not being received. Great news and well done you. Im having the same problem and wandered how you contacted them as my emails are now getting returned. Who and how can I contact them, I agreed to pay them £20 per month, made the mistake of giving them my card details to do this, they have now wiped out my bank with 4 card payments totally over £140 the day my job seekers was paid in leaving me with no money to feed my children. I need them to get in touch so PLEASE PLEASE HELP !!!!
