I took out a loan many years ago with Welcome Finance. It was a joint loan with my ex partner. When we split up we both went our seperate ways and I kept on moving around, I finally settled down and in 2007 Welcome finally caught up with me. I have a written agreement that I was to pay £30 a month until January 2010 in which case £800 will have been paid and that they shall call the debt settled. In March 2009 Natwest closed my bank account down and therefore all D/D's were canx by Natwest until I found a new Bank. When I got my new Bank account I immidiately paid 2 months which would have brought me upto date with the new Terms and conditions. Well as from Nov 2009 Welcome are phoneing me at every given opportunity to say that I owe them an additional £900, when I explained to them that I have a new arrangement with them and have a hard copy of this the supervisor/manager today told me that the arrangement is not worth the paper it is written on. I understand that several branches have been closed and all accounts transfered over to the Collections department in which are causing my life hell. I gave them my new address and it appears that they havent updated my address details too, so at least i suppose they wont be knocking on my door.

Any advise out there, I have a copy of the new agreement and can someone let me know if they can legally do this?

how long was it from your last payment before dropping off the radar,

and welcome contacting you

was it a secured loan

 

I have been paying routine;y every month from 28th November 2007 apart from the business with the bank canx D/Debits I missed that payment but then the next month I paid double.

Welcome started phoneing me approx 2 years after i started paying.

It was an unsecured loan. My last payment is supposed to be this month (end of)

i need to know when was gthe last payment made to welcome before you droped off the radar, then how long till they made contact in 2007

 

It was 3 years until they made contact with me in 2007

Im not sure what you mean 'before you dropped off the radar' I took the loan out in 2001 made regular payments until 2003ish

now the good news

 

thats a legally binding document

 

as long as 800 quid has been paid

 

welcome can go and swivel

Welcome Collections have been calling, I have never been so blunt with a company. They have basically said this morning that because I missed a payment in March 2009 (due to bank closing down account) that the agreement is void ( although I did pay double the next month) and that they are going to collect the rest of the £900 by chasing me for it.

I am all upto date on paymets now and only have 1 final £30 payment

I just done a calculation on excel for this. if you pay 20 pounds this month 28th Janruary then you are paid up and you have paid 800 on the understanding you have met each payment. Pay the 20 this month and let us know and we will do you a letter to tell them mark as settled.

what you have to realise is welcome/cattles are only open to collect as much money before royal bank of scotland finally pulls the plug

 

they are watching there backs, thats all

 

i take it you got no notification from welcome in march that the agreement was terminated

i did not think so

 

welcome as usual are talking pure bs
