      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Too much info on the AQ is not a good idea......just a gist of the claim.

I've filled in the AQ thing ready for Monday. On the dates that you can't do in next 4 months part I have put:

 

"I am 7 months pregnant after November it will be impractical".

 

Is this ok or should I leave it blank? - obviously I wouldnt want to miss the hearing cos I was in labour but I also would hate for the court to dismiss it because I was being unreasonable?

I would put some reference to your situation.

 

I respectfully inform the Court that as I am now 7 months pregnant there will naturally be some restrictions as to my ability to remain available after November.

have a read of squishy thread in barclays our local court totally ignored the fact that she was pregnant...i sent my aq after hers and got a court hearing much earlier so dont know what they are playing at. just thought i would alert you.

Remember tho policy varies from court to court and no two are the same.

These kind of decisions are made by Court managers and admin staff .

Right. Now Im really nervous. AQ filled in, filed and paid in person at Dartford CC this morning. ARRRRGGGGHHHHHH. I'm actually more worried about this than giving birth!

Please please please don't worry, you don't need the stress. You are suing them not the other way round, they have acted unlawfully not the other way round. You will win this.

 

And giving birth is a breeze, don't worry about that either!

Blimey no drugs - you are brave (or mad?!) either way well done!

 

How long do you reckon it will be before I receive a court date and do the Woolwich tend to contact you before the Court date? - I sent them a letter on Friday copied to Mr Keith Jeremiah at Barclays with my mobile number and email address in case they "wanted to discuss beforehand".

 

When I get the court date through what sort of things am I going to have to send them in my "bundle"? - I've been as good as I possibly can (with pregnancy brain) at keeping all my correspondence.

 

I go on maternity leave in 2 weeks and it would have been so nice to be able to start that with nothing else hanging over me.

well i got a court date 2 months after i gave in aq...your judge maynot require a bundle all difft...so hang fire you may get earlier one than me...

no the woolwich have not made any contact with me but beleive me they soon will when they see my bundle.!!!! :D :D :D

all the info on court bundles is in the library by bookworm and also have a look at jonni2bad thread against the halifax...great stuff on there re bundle. just be calm and wait until you get hearing...dont stress the poor little baby out or you for that matter

Rascal, will be interested to see your date - as lobster said, I put my AQ in before her but my hearing date is due 6 weeks after hers - hers is on my due date, so I guess the court felt a good gap after the birth was better than getting me in too close beforehand.

 

Closey, I hope to do it like you, at home and without drugs!! Fingers crossed!!!!

Have the gas and air, that really helped me while my wife was giving birth . . . .

Rascal this is not unusual looking at the timescale.

The court will only proceed when they have the defence allocation questionaire returned too.

If thats been done,then its likely that the case is awaiting Judges directions for the case.

Why dont you call the court ?

The number should be on the paper that was returned advising you of the transferre.

You should have the claim No ready.

Court staff are very helpful and should be able to bring your case up on the system and tell you exactly where they are up to.

This should then put your mind at rest !!
