      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I filed my MCOL yesterday - the Woolwich seem to be going to the very last second and then paying out - has anyone been unsuccessful with the Woolwich or actually ended up in Court? - if mine gets referred to my local Court I will also be at Dartford County Court so anyone want to be my Court buddy? If I get sent a AQ how much is the fee and do the Woolwich then have to pay for this on top - I have stipulated that Im claiming court fees too.

 

Also my a/c with them has been closed for over a year - how will I receive a payment if I do receive one - do closed accounts take longer?

Not one of the banks have defended in court !

 

You will likely be paid by cheque...... make it clear thats how you want to be paid.

I filed my claim with MCOL deemed served as from Monday.

 

Today have received a letter from Laurence White of Barclays basically saying they don't agree with my letter etc. and are not going to refund the charges. Part of the letter also says:

 

"Our records also indicate that last year we may already have disposed of a debt outstanding in your name, amounting to over £1000."

 

Basically, I entered into an IVA arrangement 18 months ago with Woolwich as one of my creditors. My claim against them now is for £2030 so even if they offset my debt they would still owe me £1030 and that's without taking into account what they actually get out of my IVA when it is settled (approx £420).

 

I've been unable to find anyone on here that's in the same position as me but was wondering if anyone knew what I should do next. Obviously I am proceeding with MCOL as I have already paid for it but should I give this guy a call on Monday to see if we can come to some sort of agreement or should I just proceed as normal?

How long are the generally taking to submit defences and/or settle? If I get sent a court AQ can I send the cheque from someone elses cheque book - I can't find mine anywhere? I'm a bit nervous that because this case is slightly different what with me having outstanding debt etc that it might actually get to court.

You will be fine.

They have to submit a defence within the 28 days.

AQ usually follows a couple of days later.......you then have 14 days to return it.

I would imagine a cheque thats not in your name is fine as long as you write the case number and your name etc on the back (in the top portion )

Got home today to find an Acknowledgement of Service with the box of I intend to defend all of this claim ticked. Signed by James MacDonald (Pupil barrister). The email address for correspondence etc. is keith.jeremiah - he seems to be coming up a lot in the Barclays/Woolwich threads.

 

Just waiting now. Am really nervous about this - don't think being 7 months pregnant helps matters. :(

I'm so nervous about this. Should I try emailing Me Jeremiah and acknowledge his Acknwolegement of Service and see if he wants to settle out of Court for £1500 - my total claim is for £2020. Could it really hurt to try and be reasonable rather than continue the Court process. I've just been reading on fool.co.uk about a person that has heard of another person actually ending up in court with Egg. If this reaches Court stage the likelihood is Im going to be a new Mum and having to cope with a new baby AND a court case is more daunting than anything I can think of.

You are not claiming against Egg...........Barclays have not defended 1 case......and yours aint gonna be their first one I can be 99.99.9 certain on that 1.

Thanks think Im just feeling a tad disheartened as my claim with Halifax only took 7 weeks from start to finish and Ive been reading threads on here for Woolwich/Barclays where they get a court date for months later. I'm going on maternity leave in 6 weeks and it would be nice not to have to think of anything but myself and baby :)

You can apply for judgment by default on moneyclaim. IF judgment is granted then you can apply for a warrant and you can call in bailiffs if you still haven't had your money returned. Though I'm afraid to say it is most likely they will submit a defence and will probably leave it to the last minute. Keep us posted and don't worry!

When/if the Woolwich submit a defence will I be able to view it on MCOL and will the status of my claim on there change or do I just have to wait to receive the defence through the post?

 

Im still waiting to hear anything - they got til 19th Sept to submit a defence.

ive been reading this thread, good luck with this, and try not to worry its not good for the baby so relax and just go with the flow :) everyone heres on your side. You will probably find Woolwich file their defence on the last day leaving it to the last minute means they are hoping you fold before they do plus just think of the extra interest they are earning off your money by holding it that bit longer.

 

Reading alot of threads no one has ever gone to court yet with woolwich so im sure you're be fine, im waiting for woolwich to get back to me and its annoying but just think of the extra baby stuff you can buy when they settle!

Thats a point I have not seen raised on the forum. I know most banks scrapped them some while ago due to pulic outcry (if only they could do the same with their other unlawful charges). I do not know the answer, however when you use a cash machine they are providing you with a service therefore I dount this fee can be reclaimed.
