  1. well sorry to disappoint but I have had to accept the offer!!! my car failed its MOT and as I need it for work I had to accept this offer to get it fixed. I was hoping our loan would be through this week but it is taking longer than expected (typical lol) at least I have enough to start my credit card actions out of the change. Thanks for all the support to everyone who replied, not the ideal solution but its better than nothing
  2. all my fee's were added to the loan/mortgage i am sure. on the subject of buying a house tho, we bought our 1st last year and its been a money pit, I honestly dont see the big fuss about owning your own home. I had more money spare when renting, granted I would be paying out forever but at least i could enjoy my wages as opposed to spending out every spare penny on carpets, heating, decor, kitchens, bathroom etc etc etc boiler packed up 2 weeks ago... 250 quid for parts and labour, flat roof on porch is now leaking.. aint got quote yet due to being skint anyway hope it all finally gets sorted and you can then enjoy it.
  3. dont get me wrong 500 quid would have gone down a treat just now but hopefully I will have 10k in the bank (the missus' account elsewhere tho lol) in a couple of weeks and can issue the MCOL then, so gonna send rejection letter with 14 days, seeing as I am going to have to wait that long anyway I may aswell chance my arm in the meantime
  4. here is a copy of the letter I have drafted (from the rejection template and tweaked slightly) let me know if ok please. The reason I am allowing an extra 14 days is to see if they actually want to avoid interest etc at this stage and can see my 100% intention to pursue the monies via the courts My Address 06/11/2006 Alison Follett Head Office Customer Relations London E14 5HP Re: Account number ######## Response to settlement offer. Dear Alison Thank you for your letter dated 2nd November 2006 I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, this is now totaling £#### due to 2 more charges being levied on my account since the original statements were requested. I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary. My letter before action sent previously indicated that you had until 03/11/06 to respond before Court action commences. This deadline has now passed, I will hold off court action for another 14 days for you to repay the full outstanding amount of £#### or I will commence a County Court claim with immediate effect after 20/11/2006. As you are well aware court proceedings involve time, potential costs and also interest on the charges. I trust this clarifies my position. Yours faithfully
  5. well I am just about to sort a secured loan out to do work on the house, I have eight weeks to accept so will see if this goes ahead then press for the full amount, if not then i will accept. So as it stands I am gonna press for the full amount edited due to my terrible grammar and thanks for the comments, they all help
  6. not very helpful but very relevant and honest part of me really wants to go all the way, I know the £1k will ease a lot more financial strain but in 2 months time I am sure I will have some bugger demanding payment for it whereas £485 now will let me square up a few bits and finish a couple of job around the house arrrrgggggggggggggghhhhhhhhhhh!!!! lol, plus I havent got the funds to issue the MCOL or goto the SCC atm gonna think it over this weekend, if anyone else would like to persuade/dissuade me then please feel free
  7. Dilemma!!! just had offer through from Barclays for £500 my claim is for £979 so it amounts to approx 50%, LBA deadline expired today (coincidence?). Now I am totally skint at the moment so cant afford to issue MCOL etc (boiler packed up and flat roof being done on porch = skinto mucho) so what I am saying is should I accept this offer, take the money and have a easier next couple of months or try and scrape together the funds for the MCOL (which could be a few weeks yet) and proceed for the full amount which could take a few months plus the arseache of submitting all the required legal 'stuff'!!! I am at a quandry lol
  8. glad to hear the last bit, lba 14 days up tomorrow and had 3 more charges since SAR.. takes it upto £1170 excluding interest lubbly jubbly
  9. good point lol or send the lba and also do another letter regarding partial payment etc and send in same envlope that way each one is seperate and they have no excuses
  10. yep get it sent just cos they have made an offer doesnt mean you have to accept!! timescales are what you set in agreement with legal guidelines, just because you dont send exactly 14 days afterwards is upto you, it does not jeopardise your claim or your rights... Go For It
  11. 5 days left before MCOL am a bit skint so tbh I could do with this asap lol although I think I may have a wee while to wait yet!!!
  12. the longer they hold onto the money being claimed the more money it makes them, thats why they pay out at the last opportunity imo they know they have tyo pay it but stretch it out for the sake of it... grrrrrrrrrr
  13. Letter receieved from Barclays today.. Enter Mr Brophy (although it was PP signed lol) Standard response - they aim to respond to timescales in my letter but cannot guarantee, they aim to find a solution within 4 weeks and they will send a full report or update in 8 weeks..... yeah right LBA being posted today
  14. I would cough up the £5 - the charges are worth more than that and then you have 100% costs incurred to claim, also makes you look much more organised and prepared (which you obviously are anyway) its upto you but for the sake of £5 I wouldnt let them get away with any of them as a matter of principle
  15. 'Bring it on' I say My boilers just packed up today so would go nicely towards the cost of the replacement (or a nice new laptop lol) or failing that just keep it in the bank to cover any other charges they take in future
