ok today have had a letter from solicitors with a notice of discontinuance what does this mean please
Post number# 39 18/12/2009

 

Had a letter from court this morning acknowledging that they have received a discontinuence letter
Post number# 64 08/02/2010

 

Would I be able to find it on a credit file the dates that is then get in touch with the court I will when have a spare couple hours go through every piece of paper work but if I have no luck would that be an option

 

No the Court documentation is not held on your CRAs files...... I have quoted your threads above re the NoD

Oh dear I don't think I still have all tat I thought I had put the letter safe but can't seem to find it but I can get an idea of the date from the posts on here

Given the unscrupulous tactics of dca's it's always a good idea to keep docs safe, even if you think it's all done & dusted.

If you heeded the advice in Post 67: (Keep your Notice of Discontinuance and the letter from the court very safe - forever!), check if you've filed it with other important docs, such as Wills or insurance docs.

I am going to write a letter today with the dates and explain it was discontinued and I have a letter from the court and hopefully I will find it but doubtful should I fill in a court paper yet or wait and see what the reply is from them first

If the claim was issued vis a MCOL you can complete it on line.

Then IMO wait until the last minute, log all contact and correspondence, then send a copy of the letter along with a bill of costs for your reimbursement, failure to pay will result in you issuing a claim via the small claims track.

 

I've had it up to hear with corporations abusing their position! :mad2:

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

No I was going to do it all last week but been unwell I need to take the next step now as I think time must be running out

Advise the Sol that this matter has already been litigated claim number xxxxxxx county courtlink3.gif xxxxxxx and was Discontinued on xx xxxx xxxx.Attach a copy of the NoD and refer them to CPR 38.Unless they have permission to represent the claim you invite them withdraw their claim at their earliest convenience

 

Until you get written conformation of the above you must proceed to acknowledge the claim and proceed normally..

 

 

 

If you do NOT acknowledge this claim, they WILL win by default.

Hi yes I know I need to acknowledge the claim but am unsure what I need to put on the claim form as a defence I take it sol is solicitor I'm filling it in now do I just writ in part 3 defence that ain't was already discontinued sorry if I'm being thick about this but I'm taking it I sent solicitors all the info u mention above but unsure about the claim form

You dont defend today you only acknowledge and send the letter to the claimant I have advised......you may not need to defend subject to their response.

When acknowledging all you have to do is put defend in full. this will give you another 14 days.

 

You then need to write to the address on the claim form with a copy of the discontinuance. Should they not discontinue before the 14 days are up, Andy should be able to pop you up a quick defence.

Ok I have ticked I dispute the full amount claimed as shown on the form I have put nothing in the defence so will get in post now

 

Oh guys you must be pulling your hair out I just saw that all I need is the part acknowledge of service part of the form

Hi

Could someone help,please I have been sent a multiple of statements from Cabot about a credit card the debt was for an M&S card but the case was discontinued in the court years ago could anyone advise why these may have been sent

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
