Hello

 

Last week my bank HSBC charged me for drawing money out of the cash machine 30 mins before the cash was avaliable. I phoned them up requesting this charge to be removed but they denied my request. So I searched the internet and found this site. I am now going to claim back my charges for the last 6 years. In my haste to get this started I went into the bank and applied for my last 6 years worth of statments. They got me to fill in a Data Protection Act form that includes manual intervention. I signed the form at the bank. I have now relised that I can get all the details I need from internet banking. I want through my statments online and found they have charged me £2453.00 over the last 6 year. I am currenty filling in the Schedule of Calim. I first did the easy version that did not include intrest. I then decided to try and do the one that includes intrest on charges. All was going fine and then It started to give me the full amount of interest back. This is a sample line. 18/04/2005 1.19 -97.09 0.00 1.19

 

Is this normal to me this does not seem correct.

 

A few more questions on other things.

 

1. I have also a loan with Sainburys if I try and claim charges back for late payments can they request the full loan to be repaid. If I missed another payment would they be able to request full playment.

 

2. I have a loan with HSBC where I took out payment protection. Can I cancel the payment protection. Is there a template I searched but could not find one.

 

3. I belive I can request the signed document for all my loans and If the bank can not provide within 30 days I can have the loan cancled and any payments I have paid back.

 

4 Is there anything I can do with a CCJ that my mother is playing back. She has been paying the CCJ back at £5 a month for the last 6 years. The CCJ has just been bought by another company and still has about 10 years left. The company keep phoneing asking for the payments to be increased we are not going to increase payment as we see this as an interest free loan.

it will give you the full interest if your overdraft does not exceed the total for unlawfull charges (if they had not charged you unlawfully you would not have been overdrawn)

 

1 no they shouldn't

2 yes you can. dont need a letter just tell them if you are sure that is what you want.

 

3 & 4 sorry i cant help you with those (fortunately i have never had that problem).

Question 3.

 

Make a request under the consumer credit act 1974 for signed original copies of your agreement.

They have 12 working days to provide this.

There are temp letters in the baliffs and dca threads (cag ) ......where you will probably find the answer to question 4 above also.!

QUESTION 3!!

 

Be careful! This letter is really meant for stalling or putting off Debt Collection Agencies.

 

I think you will find that this only applies when the original lender has sold or assigned the loan to a debt collection agency.

The original lender will have a signature on an agreement from you, however when the Debt collection agency come after you saying "you owe us £x" this is where the letter comes i handy.

This letter asks them to prove that the credit agreement is with them and not the original lender, because you did not take out a credit agreement with the DCA they will be unable to prove it, this also sometimes uncovers sloppy handovers of accounts between lenders and DCA's. If they are unable to come back within the 30 days then you should report them to the appropriate agencies.

The loan won't simply be cancelled, it will remain, but the lender may give up chasing you for it, and they are also entitled to enter a default on your credit record if this happens. It's not a way of simply giving up on a loan.

QUESTION 4!!

 

Tell them to sod off! The payments were agreed with the court at the time of the CCJ, they have no right to demand you increase payments. Stick to your guns on this one!!

Just sent off my Request for repayment of £2589.06. I have sent the request via email hope this does not slow down the procuedure. I have read other people have sent their requests via email and been sucsessful.

Just to update you all.

 

I will be filing my MCOL tomorrow as I have not heard a word from HSBC. I know I am a bit late but needed to wait until pay day. I have also been trying to get my PPI on my loan cancled. They have told me this is impossible. I have sent them the letter below today. When I first tried to cancel the PPI over the phone they said I would need to go into my local branch. I went into my local branch on Monday and they said I could not cancel the PPI and the only way to cancel is take out a new loan without the PPI. I would need to do that over the phone. Today I phoned them back again just to check how much I could save taking out a new loan without PPI. They told me I would not qualify for the new loan as I have had quite a few returned items. I think canceling my PPI is going to be a lot more difficult than reclaiming the charges.

COMPLAINT

 

Dear Sir or Madam

I took out the above loan for £25,000 on 24/03/04. When I took it out, I signed up for Payment Protection Insurance. I phoned up on 26/09/2006 to ask to cancel it and was told that this is impossible. I am writing to complain.

 

When I took out the loan, I was told that I would not have been given the loan if I did not take PPI. I have since been told that this is not true, and that you are not allowed to make PPI a condition of taking out the loan unless you include the costs of PPI in your quoted loan interest rate, which you did not do.

I therefore consider that I have been mis-sold this expensive insurance, which I do not need and which I said that I did not want.

I have been advised that I should be able to cancel the PPI contract at any time and receive a partial refund of the premium that I have paid. I would like to do this and in view of the way I was mis-sold the insurance, I would like to ask for a full refund of the whole premium.

I would appreciate a reply to this email within fourteen days. If you reject this complaint, I would be grateful if you could explain whether you provide an internal appeals process. If you do not, please supply me with a final response letter, so that I can take up the matter with the Financial Ombudsman Service.

My claim is now at the issued status and they have 14 days to reply. How long does it usually take for the to reply to the initial claim on mcol. I have also received the following email regarding my claim for my PPI back.

I have just received am Email from HSBC requesting me to arrange an appointment to discuss canceling the PPI on my loan. The details are as follows.

 

Dear Mark

 

In order for us to discuss your concerns further I would be grateful if

you would contact my colleague *** (Branch manager) in

order to arrange a mutually convenient appointment.

 

 

I was happy doing everything via email as I can get advise before I proceed with anything but a appointment seems scary. Any advise you can give before I proceed.

Quick Update

 

Had a meeting with the bank manager about cancelling my PPI on my loan. To cut long story short they say they are unable to cancel the PPI on the loan and I cant take out a new loan without PPI as my credit score is too low. In the meeting I asked if they had the credit agreement she just kept telling me they would have given me a copy. So yesterday sent then the standard template requesting my signed credit agreement giving them 12 days to reply. Also requested a copy of the telephone conversation I had when I took out the loan.

 

Quick update on the charges received a letter from DG Solicitors today asking for a schedule of my charges that I am claiming. Please can anyone tell me if I can inclued new charged that have recenly been added or will I need to start the process again for them. Also how long does it take once they have received my list of charged.

Recevied a full offer for my bank charges from DG solicitors yesterday that I am going to accept. Anyone know if I can fax the acceptance over or do I need to send it by snail mail.
