We did redirect the mail for 1 year, never had any details from the Halifax since the judge order the case be set aside. How long do the Halifax have to claim the funds, also would they have to issue new claim against myself & wife.

 

As the case won on default due to the Halifax not issuing defence and even after the claim was issued by judge they had extra time to apply the claim to be set aside which they did not, we arranged via high court enforcement to get the funds of which the Halifax paid in full, then we had to wait 14fsys before the funds were released. Even at that point the Halifax did not reply nor write. Once the case was heard in the high court in London they asked for our case to be set aside stating details relating to the main high court case, at the point out judge issued the case to be set aside, which was 7 months after they paid.

 

we are hoping the Halifax do nothing but just think a letter will arrive. As this is a debt in the eyes of Halifax would it ever be state barred

I think they would have 6 years from the date of the last judgement to get the money back.

 

You would better to ask the question in the legal issues bit on CAG, as there are people who would know the court rules in this. Did the set aside actually then trigger you have to pay Halifax the money back or have Halifax got to take further action ?
