Hi

 

Can I be defaulted twice for the same debt? The debt was originally from First National, I was defaulted by them in 2006. The debt was solely made up of late payment fees (which I have reclaimed this year) however the debt was sold in 2006 to Aktiv Kapital and they have placed a default on the account aswell :mad: I never realised there was 2 defaults until I checked today.

 

Can they do this?

sadly yes they can because they will claim you broke an agreement with them.

 

you say you reclaimed all the fees? did this not then clear the debt?

So First National Bank and Aktiv Kapital who purchased the debt can both place a default on my credit account?

 

I cleared the debt ages ago, the Aktiv Kapital one shows as Satisfied. It was only this year that I realised that I could reclaim the late payment fees and did so off First National/GE Money.

ok so the reclaim has nothing to do with the previous clearing of the balance?

 

so its looking klike you did not clear the whole debt & this new default has just appeared?

 

wasn't a F&F offer was it to clear it before was it?

Ok I think this has got a bit confused.

 

I had a HP agreement with First National over the course of the agreement I made a few late payments and subsequently at the end of the 48 month agreement there was a balance outstanding, which was entirely made up of the late payment fees.

 

Eventually the debt (late payment fees) was passed to Aktiv Kapital whom I paid in full. They placed a default on my credit report and then marked it as satisified. This was back in 2006

 

There is nothing owing.

 

Earlier this year I reclaimed the late payment fees from First National/GE as I learnt that they fees were unlawful.

 

I was in the process of writing to Aktiv to kindly ask them to remove the default which is marked as satisified as this is the only bad mark that I have on my credit file. However when I checked my credit file this morning I found that on the Equifax one both First National and Aktiv have marked the account as defaulted. The defaults were given a few months apart both in 2006.

Seems you cant be defaulted twice for the same debt. Spoke to Experian and they in turn spoke to First national and they have now removed the information. :D

 

What do you reckon the chances are of getting Aktiv to remove the satisfied default? It was such a small amount and its my only default now.
