As yet i have not done anymore on the Y.B issue, all that was paid back regarding my claim for charges was the small sum of money that was paid through the hardship route. Regarding them selling on the account when the claim was into them for the charges was it legal for them to do so, and if not, where do i stand with the new owners of the account. Also what has to be considered is the fact that i put it up on the site to see how enforcable it was, the opinion of cag members was it was flawed in a lot of places and would not be enforcable in court. So you can now see i have a few different avenues to go down, choosing the right one is the problem.

You should pursue a full refund of all penalty charges placed on the a/c.

 

Approach YB direct for this using the normal reclaiming process and the Credit Card reclaim template in the Bank Templates forum.

I would say pursue Marlin for a refund of all penalty charges as they appear to now own the CC a/c.

 

If you reclaim penalty charges plus interest at the bank's contractual rate, this should maximise your claim.

 

Have you quantified the amount of penalty charges on the a/c and put them on a spreadsheet. See the Interest Tutorial at Link No6 in my signature. There's a link to a spreadsheet there which will help you claim int't at the contractual rate.

My question is this, how can Marlin own it when my account was in dispute when sold. If the sale was against the law, surely it should be passed back to the seller, or am I wrong on this train of thought.

Depending on the circumstances, you may well be correct.

 

However, if you start by chasing Marlin for a refund of your charges and contractual interest, you may find they drop the a/c like a hot potato and give it back to YB.
