The bit they are refering to is criminal law not civil; you can NOT sue anybody under the age of 18; nor can anything they sign be legally binding. They may chance their arm by sueing the parents; but they would have to prove negligence or knowlrdge of the intended offence.

If you keep receiving these letters it would be bordering on harrasement and could be reported or action taken if you wished.

Sorry but they can sue in the civil courts if as they say the child is 14 or over. However they won't be able to enforce any judgment until they reach 18 years which IMHO makes it a pointless exercise & waste of money

 

I agree they can't sue for breach of contract because as you say only an 18 year old can enter into a contract

I was under the impression that RLP was set up by the retailers in question, along with a few others, plus a few names that I won't mention.

 

I don't think Actons solicitors are part of RLP but probably act on their behalf if matters get to Court. They must be just using this as a registered office address and using their other address to work from. Too many mistakes being made for these letters to be coming from solicitors.

 

Has anyone contacted Staffordshire Police to find out whether the letter RLP have on their website is a true one?

Sugar plum if you know something about RLP please share.

 

Whilst there is no name plate recording RLP's presence after having checked Google at street level it appears that RLP & Acton Solicitors DO share the same building. I assume this because the address for RLP has Acton Solicitors on the door

 

Also please don't assume that because a letter comes from a solicitor it won't be full of nonsense & poorly composed............they often do & it's probably true that until we came along they, as well as developing some dubious practices, have acted unchecked for some time & therefore have got away with telling victims a load of codswallop

JonCris, I'm assuming things my internet research, I have no hard facts to point out (yet)!

 

All these civil recovery meetings retailers have, always list RLP although there are other solicitors that are dealing with the same matters.

 

The wonky letter on RLP site from Staffordshire Police is not signed or dated and the person in question retired 2 years ago.

 

It's impossible to become a client.

 

Although there could be dodgy solicitors around this is on a much bigger scale.

JC all the info. I have and speaking legal paople I know tell me 18 is the minimum age you can be sued as an individual in the civil court!

At 14 you are deemed responsible for your own actions and be treated as an adult in criminal matters.

That actually would be feasible (although I don't know if it's true) as I have read other similarly incredulous threads involving Tesco's and Iceland. RLP appear to have security retail domination it would seem.

 

As a Mother myself, I am appalled that children can be traumatised in this manner over such trivial acts....I'm certainly going to think more carefully about where I go shopping in future.

Still awaiting a reply from Boots, checked with the Post Office and letter sent to them was signed for on 1st April, no acknowledgement or anything to say it had been passed on to Head office. They really don't want to send me a copy of the RLP notice my daughter signed. Will send another letter on Monday, might include copies of RLP letters received and ask for an urgent response.

Regarding my daughter's testing mousse incidence in Boots.

 

As I had no response from Boots on Thursday I sent a further letter also enclosing my 3 RLP letters.

 

Today I have had a reply, apologising for their lack of response but explaining that they've had a changeover in Store Manager.

 

The new Store Manager yesterday investigated the matter and has taken guidance from their Regional Profit Protection Manager. I can now be assured that the civil recovery claim has been cancelled.

 

The Regional Profit Protection Manager is now conducting a thorough investigation and has confirmed that the appropriate communication and training has already been arranged. The member of the security team who issued the civil recovery notice no longer works for them.

 

This Profit Protection Manager would very much like to speak to me and I have been given his mobile number.

 

Letter ends with a further apology for any distress caused.

Yes looks like they are seeing some sense after all....and acknowledging their responsibilities.

Its a good start-and could be good ammunition to use in highlighting the same to those others who hae yet to come round to the same conclusions.
