I hope that you get allaocated to small claims.

 

I don't think the ERC saga is over yet as I said before I think it depends on the wording of the contract.I was in court with a fairly recent one if I had gone with the other one first (£1,800) I think I'd have stood a much better chance of winning it.The contract was more basic when it came to the wording and I think the no breach point would have been much stronger.

Thanks MF, we took out our mortgage in 2003 so it is fairly recent. I don't want to hijack your thread with questions about my claim, you have enough on your plate. I'm still hoping there's a way for you here, I wish I had the brain (and the money) to help hunny.

If so, Come on everyone!

 

It's immensely cruel to say you'll help financially then not make the final effort (life ppl who 'forget' to donate to this site once they get their bank charges back)

The judiciary (in my view) are still afraid to set a precedent. Give it time...and more brave people.

I was going to suggest something similar. What you need is someone with a smallish claim, but with an element of ERC included. If enough people donate, you'll get a definitive answer on whether redeeming early is a breach, or a exercising a right. Personally I think it's a breach, because it's not a core term. The mortgage can exist wiothout it since the right to redeem is alrady enshrined in law.

 

I don't have any ERC claims, and I have none that I could claim on, but I would be happy to donate to it.
