Hi everyone,

 

First time poster here, but great site! I spoke to my bank regarding financial hardship and requested an evaluation. They sent me a financial statement to fill in and return, so I decided I will send it back including this letter. I would appreciate any observations and suggestions for improving it.

Thank you for your letter dated 08/01/09

 

I appreciate that the legal case regarding bank fees is still in progress and that at present there is a stay in place preventing consumers to seek compensation until a verdict has been reached. But as you have also mentioned in your letter, the stay can be removed due to financial hardship. I have contacted the FSA and feel I qualify for financial hardship due to my circumstances.

 

I am a full-time student and as such I am not currently working. I am supported by a loan from the LEA but as you can see from my financial statement it does not meet the most basic of my requirements. Whilst I am currently seeking employment it is proving difficult considering the current financial climate. Even if I am successful in achieving employment, it will be a long time before I can consider myself in a safe financial position. As you can see from the current balance in my current account, I do not have enough money to meet next month’s rent demands (February) and will have to seek a short-term loan to compensate, the interest (2331% - Wonga) of which will further negatively influence my financial position. This is currently the only method of financial support I am eligible for due to my weak credit history.

 

I have enclosed a completed financial statement at your request. As I have mentioned previously, you can see my income does not cover my priority expenses. I have not included any luxuries in this statement. I have also included information of 2 large non-priority debts. Whilst they are non-priority, I have to begin making payments towards them in the near future to avoid legal proceedings.

Therefore I request you pay all the default charges that have been applied to my accounts from the date of their creation. From the records you have sent to me I have concluded the following:

 

The charges total at:

 

D/XXXXXXXX - £687.00

 

D/XXXXXXXX - £?

 

I also request the charges that are due to be removed from my account D/XXXXXXXX on 01/01/09 and 02/01/09. The total of these charges is £56.00. The cancellation of these charges would also be acceptable. I also request the return or cancellation of any fees due to affect my account D/XXXXXXXX.

I look forward to a response to this letter within 14 days.

Well after 3 letters and 5 months of worth of waiting I finally had my answer today and they have accept my hardship plea and offered me the full amount I am owed :D.

 

I can't tell you how happy I am, the relief and excitement is amazing. I encourage anyone who is still waiting to keep fighting, trust me, its worth it!

 

Many thanks to the team here and all the users, the information has been extremely helpful. Chalk another win up for the small guys!

Yeah of course. I'd be more than happy to share my process with you all.

 

My main advice would be to have complete confidence when you are talking with them. I took everything on this website as fact, even when the bank didn't, if you stand your ground, they will cave in.

I am a step behind but stil waiting for Halifax to reply.

Did they ask you anything else??

 

They did send me the form to compleate together with the financial statement which I did and they said that it will be reply within 4 weeks from the day they will receive my Financial Statement.

Was there any letter that you have sent after???

Yeah basically what they said was they didn't see how I could be in arrears with my out goings. My financial statement was filled in correctly, but I guess they were just stalling for time and testing my resolve.

 

I sent back a letter saying there was no error with my financial statement and I explained each figure on the statement with a seperate paragraph.

 

I think overall I only actually had to send 2 letters but I probably called them about 5 times.

As I rely on means tested benefit(JOB SEEKERS) it will be probably a quiker respond from them which I doubt...but miracle do happen.

Your letter is been drafted very well and I will have to have a look again. What I have sent them was a copy of Martins money one under the hardship templates.

It looked very good to me and only at a later date I have discovered this site. I am realy happy to see that people are united no matter what....

Anyway at the moment I am still fighting Halifax with 2 other credit cards.

I will not give up whatever they do until they pay back what it did not belong to them to start with.

If you have any difficulty in accessing the Martins money site let me know. I have subscribed to his site as he will keep you informed with lots of cheap deals....Have a look. It seems great to me.
