      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Good points Tim, at the end of the day you have to do what is right for you. Although the 1 down side is that for every person who accepts less than full settlement, I think Abbey just use this as justification to further continue to delay & frustrate others into accepting lesser settlements. But anyway, it's your call, it's a result!

Guess I just need to play the waiting game.

I received a letter in the post this morning from Abbey's solicitiors it reads as follows: -

RE: Yourself -v- Abbey National PLC - Derby County Court - Claim No. ********

 

Following your recent letter regarding the settlement of the above claim I can confirm our client is prepared to accept your counter offer of £3333.65

 

This payment of £333.65 represents full and final settlement of your claim, but of course without any admission of legal liability by Abbey National plc. Please confirm the agreement in writing by signing and returning the additional copy of this letter and we shall then arrange a cheque for this amount to be issued and paid into your Abbey account.

 

I should be grateful if you would inform the court that this matter is now settled.

I shall be returning the signed copy of the letter tomorrow.

 

As mentioned in my previous posts I am over the moon to have got £3333.65 out of the Abbey. I know many of you think that Abbey would have settled my claim in full, but I really did not want to risk a long drawn out court case. They originally offered me 50% so I have got that increased anyway. My overdraft is £2180 so once I pay that off I am left with a bit more than a grand in my back pocket.

 

The amount I claimed was £4284.86 this is made up of 137 seperate charges and interest on these at 8%. Abbey have actually taken charges and interest of £3992.44 so I have effectively let Abbey off with £658.79 which equates to £4.81 per item. I think this is more than enough to cover their costs.

 

I would really like to thank everyone who has read my post and replied and will definately be recommending that all my friends and family take similar actions to recover their charges.

 

As soon as my cheque arrives I will let you all know and will of course be making a donation towards the running costs of this site.

Well done Tim, congratulations. You made a perfectly good decision to acccept 75%, and as you say, when all bills are settled, it only amounts to a few hundred pounds less. Nice work!:D

 

Your first post was on the13th of March, and I've been following pretty much ever since. When you started out, did you ever believe you would be accepting an offer of over £3k from Abbey?

My claim is slightly larger than yours, but I don't have the overdraft probloem - they wouldn't give me one!!! I intend taking it to the wire but you have done what is right for you.

Whatever decision we make it has to be the right decision for us at the time it is made.

Hi there,

 

This is probably my last post under this thread.

 

Abbey paid a cheque for £3333.65 into my account on the 7th June at Milton Keynes. I checked my account this morning and the cheque has cleared (you never know! it could have bounced !!).

 

Yes I won !!!!

 

Many thanks to all of you on this site for your help and I hope this thread helps many others in there fight against the banks.

 

I will be forwarding a donation this evening towards the running of this site.

Well done to you Tim. I note in their letter that they asked you to inform the court that you had settled. A bit strange I thought. In addition did Abbey remove the default entries from the register and not just correct or amend the register?

I've had the first sod off letter, so have sent my LBA which they would have received yesterday but I also faxed it over to them last Friday so they've got till the 23 June to cough up or I'll be hitting MCOL !

 

Well done , I can totally understand why you went for the 75% and if that clears the bills, then its all good!!

Abbey - Won DPA Claim - Aug 06 and got bailiffs in to recover my court costs of just £30.00

Abbey - Won Charges Refund of £1050 - Nov 06

Egg - Recovered £220 due to Customer Services misinformation - Feb 2007

Nat West - Prelinimary Letter to recover on Credit Card charges £30.00 sent March 2006. £25.40 offered - rejected and the bank reckons that this is it's last word on the matter. We'll see if that's still the case when it reads my N1 form sent recently. It has until the 17th April to respond or the N1 will be submitted.

I've been following many of the ABBEY threads in hope for some insight. It would seem from many of the threads that ABBEY are one of the toughest banks to recoupe charges from? So being at the very bottom of the ladder I wonder how long I will have to wait before seeing some light at the end of the tunnel:mad: ... I had to give up work last year whilst having chemo therapy.. And now, as a result of regular bank charges (of upto £120 per month) I am now finding myself and my children at threat of homelessness... if it wern't for the excessive charges I could of managed to stay in the black and our home. Now I'm in debt upto my eyeballs... However thanks to this forum I have found the will to look forward and fight the good fight along with you all. I no longer have a cheque book, but will be submitted my request (data protection) for my statements for past 6yrs into bank tomorrow along with £10 cash..

 

So tomorrow is 'D' day for me.... day one! Here's hoping that my shrunken brain can work out the total amounts owed once the statements have finally been received lol..

 

Everyone... please keep your threads updated as your inspiration is invaluable!!
