Hi All After taking all the advice on board from everyone on this site with regards to my personal costs, I have decided to withdraw from Friday’s court date (i only had a costs issue outstanding) and will inform the court that my claim is now settled. I think this is the best thing to do taking into consideration my personal circumstances right now (Too much going on) and the possible Fast track repercussions. I have contacted the court and they have said that if I am discontinuing with the claim then the listing fee is refundable and the application fee could be too (£340)…..Phew. So no money lost!!! It has been extremely empowering to have recuperated all the charges, interest, AQ and Court costs from ScABBEY irrATIONAL to the total sum of: *****£6494.93***** Donation on its way to CAG!!! I would have loved to Caro however i have a uni residential weekend away and so have to make my way there soon after court. Grrrrrrrrrrrrrrrrrreat!! Its not a jolly weekend either have to do loads of work and a presentation at the end of it...hence why Fri is such a bad day!!! Im also missing my work Xmas party that weekend which was a black tie dinner and dance night away in a country house. So no fun for me next weekend.... Arrrrrrrrrrrrrrrrrrrrrrrrrgh!! Like London buses...you wait ages for 1 then they all come at once. LOL I'll go to the library nearby soon after and make a post on what happened. Ill try and remember what the judge says this time. Hi all Last time i prepared so much for the application hearing and it was over before i knew it. The Judge just read my application. I dont think i should take that big old bundle....i have to go away for the weekend for uni and will have a suitcase of books with me!!! I think im just gonna take a costs schedule with me and photocopies of receipts. Just waiting for feedback from BF (hopefully if you have a min) ive sent re my costs schedule so that i can take an amended copy of costs with me to court. (can i do this??). scABBEY told me i couldnt claim any costs prior to the court claim being handed in. Is this true? I will also put together some notes so that i am clear on what to say about scABBEy putting money into my account and not informing me in writing and without my agreement to settlement...something like that, and as Caro mentioned the money is in the bank and has not been used so i havent accepted settlement. Can i mention that i spoke to 5 members of scABBEY staff before proceeding with this case prior to continuing with this claim, informing them that i would be continuing with my claim should settlement inc costs not be received...and they did not and have not made any effort to settle my costs even though i was promised they would get back to me? Can i mention that i was told by scABBEY "what gives me the right to claim legal costs, as i am only a litigant in person" I really want the judge to know how i have been treated and bullied by scABBEY, how they have stalled and how i have an outstanding Data Protection Act claim for £30 which scABBEY is refusing to pay and is connected to this claim? If im prepared hopefully ill not clam up...im gonna be myself i am not a trained lawyer and at this point i dont think any major arguments will take place re my claim...what dya think? Hi All I have received a notice of hearing of application this morning. Its for 1st Dec @12pm. Couldnt have come at a worst time. Can you please help and let me know what i need to prepare for this. It follows an application i made as follows: RE: LIP V’s Abbey National Plc Case Number: XXXXXXX Draft Order I LIP (the claimant) intend to apply for a draft order that: Abbey National Plc (the Defendent) have not provided Standard Disclosure as requested in an order by District Judge XXXXXXX on Thursday 28th September 2006 sitting at Guildhall Buildings, Basinghall Street London. District Judge XXXXXX ordered that: 3) Disclosure of documents shall be dealt with as follows: a) The parties shall give to each other standard disclosure of documents by serving copies together with a disclosure statement by 4pm on Thursday 19th October 2006. b) Any request to inspect the original of a copy document shall be made by 4pm on Thursday 26th October 2006 and any such request shall be complied with within fourteen days of receipt of the request. This information is still outstanding from Abbey National Plc (the defendant) and has still not been provided to LIP (the Claimant). I signed an affidavit at the Court on 20th October 2006. The claimant therefore requests that the defence is struck out, and judgment ordered by default. The charges and interest have now been paid into my account and the funds are awaiting clearance, but the issue of costs is still outstanding as the defendant was unwilling to meet all of the costs involved, despite the case being allocated to the fast track. I enclose a list of all costs to date, which I would appreciate the court ordering Abbey to pay if deemed appropriate. A copy of a signed affidavit from myself, the Claimant is attached to this draft order. I believe the facts stated in this Draft Order are true. Signed: LIP Dated: 16th November 2006 OK i just need to know what to to prepare and take. If i need to amend my costs what should i take with me. What do i need to say and do. I read that thread too, its not the same at all. Just to be clear, I only want to get back what the grABBEY owe me. Like i said before i have already won but they have been stubborn on the issue of costs. As Karn has pointed out i am entitled to claim these on Fast Track. Im sure they would not hesitate were it the other way round. I have been chasing shABBEY for the last eight months. The costs i am claiming back are minimal in comparison to what it has actually cost me. I have been bullied and intimidated by grABBEY. This is the end bit of my fight and i dont really have anything to lose is the way i feel. Even though they have paid what theyve paid, I have nothing to be grateful to them for, after all it was my money in the first place. Quite frankly its disgusting the way they are abusing the court system and treating people. Im just hoping my Judge sees it this way too. LIP:rolleyes:
