Hi there,

 

I had an account with Argos Additions,

was checking my credit report recently and noticed there was a default from them which I had never recieved!

 

Wrote a letter requesting an original copy of the defualt

 

they replied saying by law they are not obliged to keep the original copy of the default a

nd I could refer to the Finiancial Ombudsman but they would take nothing to do with it as it was before April 2007.

 

The account is now all paid off and the girl from the customer care dept said 'its paid now so whats the problem?'

but the problem is I have genuinely never received it.

 

What stance do I have?

Do you think any penalty charges were added, if so look aound the forum as I believe you can request the default removed in that case as well as recovering those charges

Any news, I think to could send the S.A.R - (Subject Access Request) look for any penalty charges, if you were defaulted due to those ask for them to remove it from your file held with the CRA.

Then request repayment of charges.

Well I originally asked for a copy of the credit agreement but they said they arnt bound by this, after looking more around here I found out infact they are, so ive written another letter to them yesterday and see what they come back with.

 

Ive also got another couple from RBS to which I never recieved and they recently sent me copies of, but I dont think they comply. Will need to look more into this and myabe get someone to check them out for me. Again I sent them letters yesterday asking for the Credit Agreements. Will wait on their responses.

use a SAR to be sure what they have

 

they may say under the provisions of the CCA they can get around the requirements of sending a exact copy of your agreement but if you use the sar, then they have to include it if you ask for it

I'm midway through the tunnel, but getting closer to the light.
