      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

She drives a hard bargain! I'd love to take you skydiving, but £30 is all I can spare for sponsorship. :) Just find 37 more people to sponsor you a tenner and that's that. I be sure to bring a hidden camera to any future CAG meet I attend, then I can be straight off to the tabloids to make my fortune. Wooohooooo!

There are locations all round the country. Check out the official BPA website here Welcome to the British Parachute Association . I'm not fussed where. What about Peterborough? That's pretty central.

I suggest we settle on a location before progressing further. Peterborough is a lovely place to do it. The skydiving centre is actually near Wansford west of Peterborough. Very nice area. I'm on the south coast and it is about 3 hours for me. I'm not just picking something for my benefit. It is 'reasonably' central. There is a nice picnic area and a nice bar that does hot food (burgers, chips etc.). There are some nice B and B's nearby and lovely pubs. They also welcome caravans and campers. They have a bunkhouse and showers too. I've not used these facilities so can't comment on their quality. It would be a nice day out for anyone not jumping as well. I'm all ears though for other suggestions. All the BPA drop zones are on the website. Any more potential recruits then?

I'm up for it. I'd have to get a car to get to Peterborough, but I should have one by June.

Fantastic to have you on board Dave! I'm sure your attendance will help boost numbers. I've wanted to buy you a drink for a long time since seeing you on TV. Actually, I didn't even know this site was linked to you when I first signed up. I was just googling in desperation. May have saved my dad's life I kid you not. So that's 2 reasons to buy you a drink. That would be a large one then? Well, if you do drink, I hope you accept one from me. I do keep asking about non-Paypal site donations, but never seem to get anywhere!

There are schemes like this officially sanctioned by several charities. I'm not too bothered which charity we choose. Cancer sounds fine to me though. I do think it would be good if we all did the same one and then tallied up how much we'd raised in total though. We could all post up our individual amounts. Not everyone has to get sponsored and not everyone has to do the same scheme if they choose not to obviously. I suggest we recruit till the end of March, people can still sign up after, and then fix the location, date and charity. In the meanwhile, people can ask questions and air their views. I think this will be a great day out and am looking forward to it already!

Me too - trust me, if I didn't have such a fear of heights, I would do it (I honestly feel dizzy walking across a bridge!).

Is there going to be a London CAG picnic on a Sunday again this year Dave? If there is, then do you think this Skydiving event could be done on the Saturday? We could try and get some good publicity for the whole weekend. Also, people might be more inclined to travel to Peterborough (if that is the final choice) for the skydive and then stay the night in the area to attend the picnic. Weather permitting of course! Last year was a bit unfortunate.

I would like to know if this is likely to get 'off the ground' so to speak. I'm a bit disappointed more people didn't sign up after Dave said he'd jump by the way. I know if Dave jumped off a cliff we wouldn't follow (I hope!), but I thought a site leader donning his goggles would attract a few more brave souls. :lol: :lol: :lol: There's still time. Let's be having ya! :grin: :grin: :grin:

Me too Tiglet :) I have considered it, honestly I have, but due to medical reasons, it's deffo a non-starter as far as I'm concerned :(

Well I don't know if it will be going ahead BO! I may be going on my own again I guess. If no one suggests some dates or gives a 'final and firm intention' of jumping i'm a bit lost TBH. :( :( :(
