Poo-ey. Jut reviewing my moneyclaim form online and I've somehow?!?!? put in the wrong figure. It's £4 too much. I've put 799 and it should be 795. How do i go about changing it? Will I have to cancel the claim and pay for it all over again? I've just rung the helpdesk number, but they've all gone home! Please dont tell me I've ballsed it all up!

It'll be OK as it is just £4, I am sure. I wouldn't bother changing it, it'll cost you £35 to do it. Nationwide will pay you what they see fit anyhow!

 

Just had a thought actually - if you did it after 5pm then they won't get round to doing it until after 10am tomorrow - if you ring up ASAP in the morning they should be able to change it without charging you. If it has already been filed, like I said at first, don't worry about it.

Wow, that soon? Ooh, that'd be nice!

 

Y'know I said that there was another charge due to come out at the end of July? It never came out and now I know why. I received a statement this morning, nearly 3 months worth, and it says that it will come out 28 days from the date on the statement. It's 1 charge - £30. If they don't threaten to close my account, I might leave it, but if they do, I'll go through this all again! Serve them right for trying to take my money from me!

 

I know I should really do it either way, but I wanna keep me account open!;)

Claim was issued on the 1st August, was sent to the defendant on 1st August and will be deemed served on the 6th August.

 

They have until the 20th August to reply.

Right,

 

I think they are playing dirty. You remember that charge that never came out at the end of July? It definately wasn't there when I filed my MCOL on 31st July, cos I was wanting to add it to the amount.

 

Just checked the internet banking and it apparently came out on the 26th July (it DEFINATELTY never showed).

 

So that's a returned DD for £55.98 that has already came out of my account, and another one according to this paper statement of £30 due to come out 28 days after the date on the statement which is 24th July (21st August?-ish)

 

So once this one has been settled do I then go after the rest? I guess it's too late to tag it on now? I know it only works out to £85, but every bit in my pocket is better than in theirs.

Yes, go after it when it is finished because they might actually include it in your claim. Have they acknowledged yet...have you checked online?

Still heard nothing from N'wide. I keep thinking I've done something wrong somewhere.

 

On MCOL it still says issued 01/08/06, and on the paper form I received from the court, it says it will be deemed served on 6th (yesterday). Shouldn't they have acknowledged it by now, at the very least?

 

Do I just wait now until they acknowledge? Or defend? Or what?

There has been £113 deposited cash today. Well within the last hr, as I've been checking all morning.

 

Not sure what this amount represents, as it's more than just interest, but less than interest + court fees?

The Nationwide Fairies have indeed been during the night! :D

 

It's still not all there, but another payment of £596 has gone in. It actually says "Refund of Interest Charge Credited on 05 August 2006". There's still another £169 missing though. I'll keep checking throughout the day

 

Can I be 'Settled' yet?

Please be aware that the amount we have credited to your account is less than the amount you have requested on your claim. We have thoroughly investigated and calculated the charges that have been applied to your account, which may include deducting any previous refunds you have had, to arrive at this figure.

I must make you aware that the nationwide Group uses the Financial Services Authority rules when dealing with customer's concerns. I've enclosed a leaflet that explains our Internal Complaints Procedure should you not be happy with my reply.

What do I do now? Do I write back stating that unless I receive the full amount the claim still stands? As fas as I am aware there has only been 1 time that they have refunded me my charges, and I took that off the final amount. They haven't even paid the court costs, which am I right in thinking they have to? Unless that's what they mean by 'cover your costs and lost interest'. It's still £169 short. 1 refunded charge does not amount to £169, I know that!

Email Charles Bacons office asking him to send you a full breakdown of the charges that they have refunded you and advise that as this figure is considerably different to yours, you will not be advising the court that it is settled until you are satisfied that you have got back all unlawful charges.

 

Costs and interest *should* be the fee and the 8% interest.

The fee + 8% interest =£130.47. so only £20 short of the figure they have actually paid. Plus there's no mention of the 2 other charges that are due to come out, neither no mention of account closure (yet).

I've sent the email to Mr Bacon, and although I've got a read receipt, I've had no reply either through email or 'snail-mail'.

 

Today I got a letter from the court a 'Notice that Acknowledgement of Service has been filed.'

 

It says that the defendant now has 28 days from the date of service of the claim form to file a defence.

 

It also says that they intend to defend all of this claim.

 

Should I be worried? Also what day would be the date of service? The day that it was deemed served?

 

I'm still expecting a full breakdown of the charges they have refunded, but as yet have heard nothing, nada, zilch.

The acknowledgement you received is standard procedure so don't worry about that. It gives them a bit longer before you can file for judgement if it is not sorted.
