Do all DCA's start the conversation with "I.m calling in relation to a banking matter" That's what I get from Blair, Oliver & Scott.

?

Either that or 'AN URGENT PERSONAL BUSINESS MATTER'

Of course they could always tell the truth.

''Hello we want to bully and threaten you into paying us a huge amount of money for a debt we bought for pennies, although we dont have a properly executed CCA, the debt is over 6 years old and we are not sure that you are even the right person but we will continue to harrass you and make all sorts of threats and tell whatever porkies we need to to CON you into paying.''

Of course none of us would want to undermine the seriousness of any persons request for help or anything like that. But a little bit of humour now and again can only be a good thing.

Hi

Can anyone help me?

I had a letter from Link Financial informing me that they now own a debt from First National in my name.

This debt was for a relative of mine who has the same middle name as me. My name and date of birth is nothing like the relatives apart from that middle name. I phoned Link and told them that they had the wrong person, they now want a speciman signature from me written six times. Thay also want a copy of my passport. This debt was from 2002. What right do they have to demand this from me, they said if I did not do this that they would go ahead and take me to court, I am 100% genuine on this and have never had any accounts with First National, the company they say I owe money to. I will be able to prove this in court but obviously dont want that to have to happen.

What would be the best course of action for this? I object to letting them have my passport details. I gave them my mobile number when I called at first so that it could be cleared up, they have since called me 3 times telling me I must pay.

Please can someone give me advice.

Thanks

About a year and a half ago, I was contacted by the Wedding Directory Planner (HAQ Publishing Ltd) enquiring if I was interested in placing an advert with them.

To cut a long story short, they put together an advert for approval. Pretty ordinary, but I contacted them to say they had my postcode wrong.

In the meantime, their previous years planner arrived for me to look at (as I requested) and I was really disappointed with what I saw...a real mish-mash of adverts with no real structure between any of the wedding service providers. Not for me, I thought! I never bothered to contact them again.

A couple of months ago, they sent this years Planner with a bill for an advert I have never approved!

Today I received a threat of legal action if I don't pay within 14 days.

Any advice please guys?

Hi Steve p and welcome to the forum.

First of, you would be better off starting your own thread. That way your query would get more attention.

I would have thought that if you didn't approve it then it would be up to the company to prove you did.

It might be of use to you to try this forum www.mobilediscodirectory.co.uk/forum.

They probably won't be able to help with your particular situation. However, a lot of the dj's on there specialise in weddings and may have come across this company before and know their reputation etc.

I know its a litle childish, but recently during a raining down from Idiots and Jokers and I saw their number on my call screen, I enjoyed turning on "Money's too tight to mention" by Simply Red by the computer and after security I said, ok I'll just go get my debit card and left 'em.

The longest they held out was 2.85 minutes.

I was hoping for 3

This subject reminds me of FoneJacker, a sweet and very funny TV series, and a must see for anyone wanting to divert a Debt collector

fonejack / v. 1. to seize control of a telephone conversation by farce esp. divert it from reason and logic

Taking cold-calling to an artform, the fonejacker is a man on a mission. He's addicted to making prank telephone calls, taking on various guises and voices to satisfy his need to confuse anyone at the end of the line.

Listen in as a bloke called Alan tries to get a rickshaw driver in central London to pick him up from Heathrow airport, cringe when an unsuspecting rube is asked to be the getaway driver for a heist in Kilburn, and marvel at Jean-Pierre's chutzpah as he repeatedly tries to put a deposit down on sports car.

The show also features a variety of regular characters terrorising an unsuspecting public including wide-boy car salesman Terry Tibbs, The Mouse, Mr Doovde and financial [EDIT] George Agdgdgwngo.

Ah yes. I have a pay-as-you-go mobile phone and recently, JBDR's monkeys have been leaving texts and voice messages on it to the point where the mailbox is full. They left 10 in one day. I have no idea how they obtained the number, but the actua;l debt they are chasing was not incurred by me and originated in 1996. I haven't called JBDR and have no intention of doing so but some of the messages are quite abusive. I'm going to sit on this for a while as I debate how best to use the evidence to screw JBDR royally.

Block their number. Do not call them back, and under no circumstances reveal any personal details. You have to prove nothing. The burden is on the DCA to prove the debt is yours and to do this, they must produce a properly-executed CCA. Keep a log of names, times of calls etc., for when you eventually sue them for the intentional infliction of emotional distress.

What you need to do is get recordings of all the calls. Then make a formal complaint to JBDR about their abusive calls which of course they will deny making. Once they give you their pitiful Final Response in which of course in writin they deny making the calls you then make a formal complaint to the OFT, the FOS, TS and your MP enclosing a transcript of the calls and advising said bodies that you hold the original recordins of the calls.

I've already transferred the voice messages onto tape and taken photos of the texts with a good-quality digital camera. You just know that these morons are going to persist. I happen to be a lawyer myself - though not yet licensed in the UK - so I'm looking forward to having a bit of fun here.

The funny thing is that they haven't got my address or landline number. I cannot think how they got the mobile number. I purchased the phone when I arrived back in the UK after living overseas for some years.

I will follow your advice and, for good measure, I will make it know that the tactics of JBDR have cause me, and my wife, considerable distress and alarm.
