My situation is different. Due to financial difficulties my mortgage has about a year's worth of arrears. I am actually selling my home before it's repossessed. The mortgage company (which is not a high street bank) have charged £65 for every month payment was not made in full plus several £100 for sending out a "debt advisor" to visit me. Naturally I agree to pay back the mortgage and arrears but do I have to pay all the added charges? Thank you.

Was the £65 for a service that they provided or was it a penalty for paying late? Did they manually do anything to justify the charge? If not then it seems to me that it is unlawful.

 

I guess the debt advisor could have been a service, but did you have a choice in this? You could have got debt advise for free from a debt advisory service. What service did they provide for the £100?

 

Most people here are claiming back charges, but you are talking about not paying them in the first place, which is a different matter. You could consider paying them if you have to and then claiming them back later, but this is just a suggestion.
