I wouldn't put it past them, but am not wasting the cost of a stamp on them.

 

If they want to go to court, then lets go then. I have letter from studio 14 November 07 admitting their is no signed agreement, so would take great pleasure in looking at their betrodened faces when the judge boots it out.

if they do take it to court, even AFTER they themselves have admitted they dont have any kind of credit agreement, they must enjoy paying other peoples costs because they should know that they havent got a leg to stand on.

 

more than likely they will just keep badgering you with letters and such, hoping that youll finally crack and pay up.

Reply from Consumer Direct this morning about the Kilmarnock Cowboys.

 

"Thank you very much for taking the time to inform us of this issue. I have referred the case details to the relevant Trading Standards department for their information, to ensure that they are aware of this trader and their business practices.

Our experience shows that the best way to deal with this is by recorded delivery letter, as this will make the whole process appear more formal and help you prove you have been reasonable. I would suggest you address the letter to the manager or managing director of the debt recovery agency and Express Gifts Ltd and keep a copy. Briefly outline the complaint and request that the “account is put on hold while in dispute” this means that no additional costs should be added and the debt recovery agency should stop contacting you. A letter also lessens the chances of any existing relationship between you and the trader collapsing and enables you to prove, to a court if necessary, that you have been reasonable in trying to sort this out."

Don't know what they think I have been doing the last 20 months, 'send it by recorded' I have done about 5 times, still don't listen. But at least they bothered to get back to me, more than can be said of some companies. Will have to wait and see what TS have to say on the subject, if anything.

Recieved OFT's reply to my complaint regarding Mucky's and Studio's failure to supply any agreement. Not telling me anything I didn't already know, but at least its on file now along with the thousands of others I am sure they receive every day.

 

"We have noted the details of your complaint, and we will consider this alongside any other complaints we have received with a view to any licensing action we may decide to take. Unfortunately, we cannot disclose any details about any action we may take, due to restrictions on the OFT relating to disclosure of information (Part 9 of the Enterprise Act 2002).

 

Providing copies of agreements regulated by the Act

 

As you may know, s63 of the Act covers how and when lenders must provide consumers with a first (and where appropriate second) copy of a regulated agreement. It is clearly in the lender’s best interests to retain details of the original agreement and any subsequent variations or changes made to it, particularly as consumers can request a subsequent ‘true’ copy of most types of agreement under ss77 and 78 of the CCA (and on payment of the appropriate fee). There are rules about what is likely to constitute a ‘true copy’ under these sections of the Act. Further, if a consumer does make a valid request for a copy of their agreements under these provisions and the lender does not comply with the request, the agreement may not be enforceable in the Courts, subject to any other mitigating factors.

 

Should you require specialist advice or assistance on the circumstances of your complaint (including in relation to the above provisions about copy requirements), you may wish to contact your local Citizens’ Advice Bureau or seek advice direct from a legal advisor.

Been nearly 12 months since heard anything about this one, Muckys were the last on the block.

Now letter this morning from this lot

P&A Receivables Services plc.

Anybody heard of this lot? Can't say I have.

Are the associatied with any other cretins?

They are based in Sheffield and have capable, well trained, multi lingual staff whose capablilitys include

U could always use the customer care or mediation service.

 

The mediation would be good.

 

ALf.... Studio stop harrassing me for a unenforcable debt and remove all from my credit record and i dont report studio for data protection and failing to have all the proper paperwork under the money laudering regs.

After reading this letter from P&A a bit closer I notice it says

"payments must be made to Revenue Collection Services?

Well I had a sniff about and what comes up for these people is

I like to be nosey, gives me a buzz LOL;)

I see.

P&A Receivables Services plc address is also Sunbury on Thames so would presume they are another shoot from the same bulb. All these intertwined companies, worse than Ragwort, take over if you don't eradicate them

 

No matter, they are still getting nothing until I see a signed agreement, which won't be happening as Studio has already said they ain't got one.

Just bin having a dig through all the paperwork for this one and came across the Default Notice.

 

At the time of its issue didn't know much about invalid aspect of defective ones, but after looking at it again now, I think it is defective.

 

It is dated 20th Sept 07 which was a Saturday, so not sure what would be the first day it is deemed to be served, would it be the Monday 22nd or Tuesday 23rd.

 

It gives a remedy date of 3rd November 07, which is also a Saturday. Either way it is still only 14 days from the date of the letter, not service.

 

There is also no amount stated to pay to remedy the breach, ie arrears.

Quoting in breach of payment terms of your agreement, of which there isn't a signed one,

 

CRA is showing date of Default 27th January 2008

 

Can anyone confirm that this is indeed an defective default noice?

apart form the obvious differences, name addy etc, this is identical to mine and even sent by the same company.

 

It does not give days for delivery which it needs to. It does not give 14 clear days after delivery which it needs to. Also you have said it was dated a saturday well then the earliest you could have got it would be the tuesday as u dont get post on a sunday. to be a effective defult notice the remidy date would have needed to be the 6th November 2007.

 

About as useful as the sample credit agreements.
