Hi folks - here's my question. In October 2018, I received a NIP for doing 59 in a 50 zone, and this went forward with a Fixed Penalty. However, the points for this would put me on 12 (I probably should have known, but it didn't actually occur to me to check). The HMCTS, in early January, returned my driving license and refunded my £100 fine, informing me that GMP would be in touch "forthwith" in order to proceed to court for the totting-up ban. I have yet to hear anything from GMP. My question: Is there a time limit between the offence and the court date, or between the HMCTS decision and the court date? In other words, do GMP have a time limit to prosecute me, or could this essentially be whenever they choose? I am accepting of the impending 6-month ban for my stupidity, and just want to "get it over with", however, if there is a time-limit and they run-down the clock, might I get away without a ban? Any advice appreciated. -
I’ve been stupid and was caught shoplifting in Sainsburys and looking for some advice. I’ve searched the forum for similar situations, but I still have a few questions. I was taken to the back office office and asked for my name, DOB and address. I didn’t want to give them photo ID so showed them my bank card. They appeared to just look at it to confirm my name and didn’t take any photocopies of it as far as I’m aware. I was very compliant, stayed calm, handed over the items immediately (very low cost: less than £9 in total which I then paid in full before leaving). I was then given a lifetime ban letter and was escorted to customer services where I paid for the items and then I was free to go. I apologised and asked numerous times if they were going to call the police and/or if the police will come to my address. They kept saying they weren’t going to call the police and that if police were to be involved they’d have called them then and there. I’m at university and they did say that it’s not worth getting a criminal record over etc, warned me not to do it again, and gave me the printed off letter. From reading the forum and just common sense, I’m assuming that this is not currently and will not escalate to a criminal/police matter since they weren’t contacted and that this isn’t a criminal record (i.e not a charge, caution, etc) and will not appear on any background checks? I was told I will be getting a letter regarding compensation charges but from reading here it appears it’ll be a standard comp charge which I don’t have to pay? I understand they’ll keep writing to me but I gave my university address and barely get post sent there anyway so hardly ever even check my pigeon hole. Is it safe to just forget about it and ignore the letters which I’ll be sent (but probably never get...) I’m also of the understanding that I’d only have to pay if any loss occurred and because I paid for the items in full, there’s no loss right? Plus they can’t charge me for wages/time already being paid for (security etc). my questions are as follows, any help would be much appreciated: 1. Why did they ask my DOB (I just don’t see how that’s relevant, what can they do with that info)? 2. Since I gave my university address if I don’t respond and just ignore their compensation letters will they contact my university and ask for my home/permanent address? 3. I paid for the items on my debit card, could they either track me and further personal details, including home address, from that? 4. I’ve seen a template of a response to the letter basically saying no further correspondence will be entered into. Is it better to just completely ignore their letters or send something like that back to them? 5. As queried in my post, would it be safe to just ignore the letters and put this behind me? I’m stupid and have learnt a big lesson today, so please, no judgement. Am I right to think this will not escalate to a police matter (providing I don’t go back into a Sainsburys store)? 6. Is there anything I should know or do, anything that will put my mind at ease. Thanks in advance for your help. Oh and when I said that I gave my university address I meant my halls of residence uni building (as opposed to a private rented student house) hence I’m worried they could ask my university for further details/my home address since my address given basically is the university. -
nhs contracts? Hi all, i am now working in the nhs as part of the theatre department and in doing so signed the usual contract agreeing to working on calls, late shifts and weekends etc, the problem is that some staff are not taking part in this arrangement because of various reasons ( my cats scared of the dark or little johnny wets the bed) sanctioned by the managers and therefore the remaining staff are having to work extra shifts to compensate. My question is, are we all being treated equally and do we have any basis for taking action against the management. Any help would be great. Cheers.

I was caught shoplifting from a Sainsbury's earlier in the week, huge mistake I know. Does this mean I can't order my groceries online from Sainsbury's too? -
Hi, I was caught shoplifting in boots today with my partner. He had no involvement in it at all. He was just with me. As we left, the street ranger came after us and told us the security of Boots would like to talk to us. We went back with him, thought there's no point in trying to fight it and admitted to what I did, and gave him the goods I had taken. I've never stolen before. It was a one off. I am on lots of medication for a long term disability, and have (mental health) BPD, which makes me impulsive, and silly sometimes. I told the security guard this, but he didn't respond. He was really lovely, not intimidating at all, and handled it really discretely. However, we were held in the room, which had a code to get into, and I asked to go to the toilet and was told no, and that I could go after. I was crying & shaking, and on the verge of having a panic attack (from feeling claustrophobic) he took our details, and "distinguishing features" (my tattoo on my leg) and then asked me to sign something to confirm I / we wouldn't return to the store. Now, he's said we will receive a fine each, from RLP, and threatened that if this wasn't paid, it would escalate further to the police. I asked him when we would receive this letter by, and he said he had no idea. now I'm just sat anxiously waiting. has anyone got any advice? I'm also signed off sick, so have next to no income, and my partner is supporting me. I'm awaiting disability allowance, but haven't heard from them yet. I was wondering if my mental health could be mentioned at all to them? I don't know what to do. Please help in anyway possible! is it right my boyfriend will receive a separate fine just because he was stood with me? Thanks so much. Oh I'm 21, and he's 22 by the way x Oh and i also signed to say I acknowledged I was banned from the store (I don't know how long for or if they actually recognise me?) -
Hi my son just received the above letter from Essex Police. Location was M25 Epping nr M/Post 5563b anti clockwise on a special road ( namley M25) between J23-27. at 12;42 on 4th May he was doing 62 in 50. He was driving and on his way to Luton Airport. I asked him about his speed and he said he was following the speed of other cars on the road. He also (assumed) that the M25 was a 70mph. To be honest,do many of us actually check our speed if we know we are doing less than 70.Its not an area he knows, and also i know ive probably driven up that part of M25 but cant say i took notice of any signs on side of the road. So any advice on what they might do. will it be points, D A C or a ban? he is worried due to driving a co van for a living.

Hello chaps, I am afraid I got myself in a situation. I will skip the emotional stuff and try to be factual. I managed to develop an online shopping addiction, which resulted in high volume of returns to the stores hence security started watching me. I was detained on exiting a TKMaxx store on allegations of a theft (worth 35 quid) and fraud for replacing price tags on 2 items. Never had incidents or a CR before. I was given a 12-months store ban and the police was called to take details but still waiting for a voluntary interview date. I was told that the theft was not too bad, but the fraud bit is more serious. I am still deliberating between admitting and denying but a solicitor said it all depends on evidence, which will only be known at the police station. However, there is an additional problem with returning the existing purchases. I still have a number of items (receipts in date) to be returned as well as a few internet orders still unopened. I usually return the orders to a store, which is free. Returning by post will cost me quite a lot but I am not prohibited from doing so. However, I am trying to work out how on earth do I get refund for items bought in stores if I am not allowed to enter the stores? My OH is refusing to get involved fearing to be seen as a co-offender and I am too embarrassed to ask friends. Any idea what can I do??? We are talking a substantial sum here, not pennies, so letting it go is not an option for me. If I change my appearance and go into a different store, will my credit card get flagged up during transactions and I will be detained, or will the till get a call from security asking to put aside all returned merchandise for later inspection? In any case, there will be a breach of a ban, and that in itself is another offence? What on earth do I do??? -
Hi, I'm a new user here. I was caught stealing 4 items worth £1 each from Sainsbury's. This is my first time shoplifting (I'm obviously not very good at it) and it will be my last as I'm completely in pieces about it, and I have learned my lesson but I won't go into all that. They issued me with a letter saying that I'm BANNED from ALL Sainsbury's stores FOR LIFE. They didn't pass my details on to the police, and I'm grateful for that. I can't begin to explain how debilitating this is for me. I know I caused it myself, but I shop for my partner who can't lift. I also have anxiety that's related to blood sugar issues and makes it hard for me to leave the house - I sometimes get caught out and I have to dip in somewhere immediately. I'm already hugely anxious about how this ban will affect me and I feel like I've let down my partner. I know I caused this on myself but I just can't face a lifetime ban for this stupid mistake. I was told I can appeal to the area manager for a lift on the ban. MY QUESTIONS ARE 1 - what should I include in the letter of appeal? What kind of tone should I take? Should I tell them my situation with my partner? 2 - if I admit to shoplifting in writing, will that make my case even worse? I already admitted in the store, so maybe this won't be an issue. 3 - Has anyone else had success lifting a ban like this before? Any advice on this much appreciated. I'm really ashamed and won't be shoplifting ever again. -
What on earth is happening with the Metro bank? The new bank which was going to put all the old traditional banks to shame. "Love your bank at last" is their motto but maybe it should be "Love your bank the last". We opened an account with the Metro a few years ago because they appeared to be full of promise and anxious to get away from the traditional model of unfair, inefficient, profit minded, conveyor belt customer treatment. We've had a pretty good experience with them over the years but this year it is all started to turn to a disaster. We are now finding that they are careless with personal data, unable to keep us informed of pin number changes or to send us the necessary bank cards with PIN numbers that work. Try to call them and you get bombarded with apologies – and "we know how you feel" and, do you mind if I call you by your first name – and "how do you feel today" as well as promises to call you back – which never seem to happen. We've now been without an active card against our account for over a month and still just getting promises. Right now, I received a promise that they would call me back within three minutes – but that was pretty well 10 minutes ago What a shame.. It was such a hopeful project. Maybe they become tired of being a good bank. There must be some explanation for this system's failings..

Today the Judiciary released their long awaited Consultation on McKenzie Friends. Most importantly, the consultation proposes a ban on fee-charging McKenzie friends in order to protect ‘vulnerable litigants’ from unregulated, uninsured and unqualified individuals. From 1 October, several changes to the law around smoking come into force. Here’s everything you need to know: Q: What is happening on October 1? A: From that date private vehicles must be smoke free if there are passengers in it who include someone under 18. Q: Is it just the driver who faces prosecution if the law is broken? A: No. If one of the passengers lights up in the vehicle they and the driver will face prosecution. Q: What will happen to those caught? A: They will received a fixed notice penalty of £50. Q: Does the law apply to e-cigarettes? A: No it does not. Q: What happens if there is a 17-year-old who is alone in a vehicle and smoking? A: If that is the case then no-one is committing an offence. Q: What type of private vehicles does the legislation cover? A: It covers any private vehicle that is enclosed wholly or partly by a roof. A convertible car, or coupe, with the roof completely down and stowed is not enclosed and so isn’t covered by the legislation. But a vehicle with a sunroof open is still enclosed and so is covered. Sitting in the open doorway of an enclosed vehicle is covered by the legislation. Q: Do the new laws apply to motorhomes, campervans and caravans? A: The rules apply to them when they are being used as a vehicle but don’t apply when they are being used as living accommodation. Q: How will it be enforced? A: Enforcement officers - usually the police - will use their discretion to decide whether to issue a warning or a fixed penalty notice, or whether to refer an offence to court. Q: Won’t it be difficult to enforce? A: Yes, according to some police officers, who also warn it might divert officers from other duties. It’s a point conceded by those who campaigned for the law change who hope that just the existence of the new law will deter many from lighting up in their vehicle. Q: Why is the new legislation being brought in? A: To protect children and young people from passive smoking. Those for the bans say every time a child breathes in secondhand smoke they breathe in thousands of chemicals. This puts them at risk of serious conditions, such as meningitis, cancer and respiratory infections such as bronchitis and pneumonia. It can also make asthma worse. Secondhand smoke is dangerous for anyone, but children are especially vulnerable, because they breathe more rapidly and have less developed airways, lungs and immune systems. -
Would or could - as they means you have not taken the action you are mentioning. Christmas - this is a word taken over by business to sell their merchandise, rather than about the festival to celebrate the birth of Jesus. If we replaced it with say Jesus Day, i doubt that most businesses would be happy to use it to help sell their goods.

Russia should be banned from athletics competition, a World Anti-Doping Agency commission report has recommended. Wada's independent commission examined allegations of doping, cover-ups, and extortion in Russian athletics, which also implicated the IAAF, the sport's world governing body. It says London 2012 was "sabotaged" by "widespread inaction" against athletes with suspicious doping profiles. Russia was also accused of running a "state-supported" doping programme. More ... I am not in favour of stopping any debates and to allow freedom of speech. But there have been a number of threads where debates have become silly arguments. The threads then get closed after they have run their course. People are entitled to opinions, even if you don't agree with them. If you don't agree, then just post a counter argument or ignore. No point attacking someone for their opinion, as you are not likely to change their minds. I am not sure political threads should be encouraged on CAG. It is principally a consumer advice site. The Bear Garden was i think intended for general chat about interests, current affairs. There are specific internet forums that cover politics. -
A ban on smoking in cars comes into effect just as people are being urged to quit smoking for Stoptober. From 1 October 2015, it will be illegal to smoke in a car (or other vehicles) with anyone under 18 present. The law is changing to protect children and young people from the dangers of secondhand smoke. This is a very silly and unthought out law. A person can smoke in public at the age of 16, so what if a person of 16 or 17 in that car is a smoker and decides to light up. Does it mean the kids can smoke but the driver/parents can't or will they be breaking the law as well. These do-gooders are really thick some times.

Hi all, I was caught speeding a few weeks back, 106mph on a motorway. Going to court at the end of the month. I had no excuses or mitigating circumstances, I'm planning to hold my hands up and apologise, be humble etc.... My job involves driving to many different sites all around the country. I take lots of equipment so can't really get public transport. I plan to take a letter from my employer which says words to this effect. I basically want to get across that any disqualification will affect me (fair enough) but also affect my company, colleagues etc.... What should the format of this letter be? Who should it be addressed to, what sort of content etc....? Thanks in advance! -
Letting agents’ fees should be banned to protect tenants in the private rental sector, a new Citizens Advice report has urged. New evidence uncovered by the charity reveals tenants are frequently ripped-off by fees often hidden by letting agents – to the tune of £337 on average. These charges come on top of advertised rent prices and deposits and in some cases can force people into debt, the charity says. The Still Let Down report says letting agents have refused to adopt measures that were supposed to bring transparency and competition to the market. Most agents charge for checking references, but costs range from as little as £6 to £300, according to the study. Renters can also be hit by charges ranging from between £15 to £300 for simply renewing their tenancies. Some agents charged £300 for credit checks that are widely available for £25. Smoking in cars carrying children is set to become illegal in England late next year in the biggest crackdown on lighting up since the ban on smoking in public places in 2007. On Wednesday the government will lay the regulations in parliament needed to pave the way for the new restriction on smoking, which is likely to come into force on 1 October 2015. The measure will criminalise smoking by parents, carers or other adults in a car carrying anyone under 18. Enforcement officers would be able to issue a £50 fixed penalty notice both for smoking in the vehicle and failure to prevent smoking in the vehicle. Hello everyone, i am currently in a very worried state. Today i was banned from asda for shoplifting. They took me to a quiet room on the side with CCTV which they said took my picture. No Police were called, they simply made me sign a form stating that i was banned from all ASDA stores. They took my student ID and i assume they wrote down some details from it, and told me that my university would be notified of what had happened. The goods were returned to the shop and i offered to pay for them anyways, which the manager declined. I remained very appologetic and cooperative during the whole ordeal. The total item value was £13. For which i only paid £0.70 at the self checkout by falsely weighing it as a different item. The £0.70 was obviously not refunded to me. I am now very worried of the following: -That i will be expelled from my university course. -That it will have an impact on future employment due to criminal record. -Will i be fined (by the RLP according to other articles here?). They asked me for my address but i only gave them a basic street of the student flats where i am living now. They said that it wasn't showing up, i then gave them the postcode for the area which i am unsure the lad even attempted to write down, and it is a pretty large area that the postcode covers. So overall, i am somewhat positive that they dont have my address. I have learnt my lesson and i will never again do anything like this in my life. I am absolutely terrified. I would appreciate any advice or counsel that anyone here could provide. Thank you. EDIT: I have just read that ASDA uses a company called Drydens for their civil recoveries, but i am still unsure if it will apply to me? -
A MAN who hit a bailiff with a cricket bat, then challenged his sentence for it, has been given a suspended jail term. Richard Burton, 35, attacked the bailiff David Knight when he went to his house in Phipps Road, Oxford, on March 5 last year. He was convicted of assault by beating at Oxford Magistrates’ Court on October 14 and was given a 12-month conditional discharge. He was also told to pay £100 compensation, a £15 victim surcharge and £200 costs. But Burton appealed against his sentence at Oxford Crown Court on Tuesday. The court heard Mr Knight told Burton he was a bailiff as he went into the house. Judge Zoe Smith said Burton went into the kitchen and first picked up a knife, then put it down and picked up a cricket bat instead. He raised it above his head and brought it down, hitting Mr Knight’s left hand, causing bruising and swelling. Dismissing the appeal, Judge Smith warned Burton that bailiffs played an essential role in the criminal justice system. She said: “People employed to carry out the duties of bailiff must have the protection of the courts and it is only right people who harm them should expect imprisonment. “The job this gentleman was undertaking was essential.” She gave Burton a three-month prison sentence but suspended it for 12 months saying: “We were impressed by the character witness you put before us.” Burton was also ordered to carry out 120 hours of unpaid work and pay Mr Knight £150 compensation and the Crown Prosecution Service’s full costs of £526. Gregory Transport, (Somerset), wants caravans banned between the hours of 6am and 6pm in the months of July and August. Wouldn't it be more sensible to ban lorries during those time and even more sensible to ban lorries from taking a couple of miles to overtake another lorry so blocking the road. I think there are a lot of caravaners, (and non caravaners), who might have something to say about that. The man is demented.

just wondering if anyone can help with this, my son was on a drink drive ban about 11 years ago and not been driving since, now he has applied for his licence, paid the 90 fee and was sent a letter to arrange for a medical before he can get his licence, they have given him 6 weeks from the 22nd April to get the medical done with the cost of £98.50 for a blood test ect., he has not got the money until after the six weeks they have stated, could this result in him losing his original £90.00 fee for the renewal and have to re-apply with a further fee of £90 Please can someone give some advice on this.

Hi, I've been reading a lot of threads here similar to mine so didn't know if there was any point in me posting but in the end thought it was best to because I don't know what to do. Last month I did a really stupid thing and tried to shoplift groceries from Tesco. It was nearly £200 worth. I was caught, arrested, held in a cell overnight and the next day I was cautioned. I'd never done anything like that before and I'll never do it again, I don't know what I was thinking. I just want to forget about it because I'm ashamed it ever happened but about a week afterwards I got a letter from RLP saying I owe Tesco £197.50. I don't have that kind of money so at the time I was terrified but since then I discovered CAG and after reading up on RLP I've decided to ignore the letter, and any more letters they decide to send. Only thing is, today I got an e-mail from a solicitor company called Buchanan Clark and Wells saying they've been trying to contact me and I need to speak to them urgently. They've given me a reference number to quote but I'm scared of what they're going to say. If I do phone them I'll have to do it outside as I'm 19 and still live at home so I'm trying to hide all this from my Mum and her partner. I know it's completely my own fault but Tesco banned me from the entire retail center the Tesco's store was part of as well, apparently indefinitely, which is really stressing me out as it's practically next door and it's getting harder and harder to make up excuses not to go there... and it's only been a few weeks, let alone however long the ban is for.
