  1. Hello, First off, I didn't realise that forums like this existed and have already found some great discussions! I am a relative newbie to all of this, so thanks in advance for the help/tips. I have been storing some belongings for a friend for several months now in my home. They have remained in bags in my living room and there are around 6-7 blacksacks of goods there. Due to unfortunate circumstances our friendship has ended, however I still have the items in my house. I am attempting to get the chap to come and collect the items, however he is being suprisingly unwilling to claim them. We only ever had a verbal agreement that he can store the items in my home, as friends would. I am in email contact with this guy (has no fixed address) and have provided him with an inventory of all the items he has left. I have come across the Torts (Interference with Goods) Act 1977 which appears helpful for this type of situation. However, there are clear rules within this tort that relate to getting rid of the items as long as there is no dispute. Now that there is a dispute I am slightly lost as to what to do. The house will be put up for sale ASAP and I expect to be gone within the next few months ... I do not what to spend any money on moving his gear with me and I wish to cut all ties with him. FYI there are a few of his belongings which are worth a considerable amount of money. He has advised that he does not want his items disposed of (naturally). Last week he said that he would not collect any of the items unless he also recieves 3 items which we had a shared interest in. I replied to this and advised that I am willing to relinquish any interest I have in the shared items and he can take them aswell (these cost me around £300, however I am happy to give them to him to get him out). Now he's come back again and said he will not collect any of the items as there are some missing from the inventory. I am confident that this is not true, and perhaps a hope to keep the items in my home free of charge (as he has no fixed address). He was never a lodger in my home and we had no formal agreement for storage of these items. It was simply a favour I offered him at the time. Please can anyone help with some guidance/advice on how I can handle this situation as the Tort stipulates the rules for selling/disposing of items only where there is no dispute. Many thanks
  2. Firstly, Thank you everyone for all your contributions on this website, I have read through most of it and it was of real help to my particular problem regarding CCJ. I have a query if you can help and advise. I received a CCJ in April 2014 for parking in one of the sites maintained by Parking Eye company during Dec 2013. The reason was that, I moved from my previous residence and all the reminders and court communication were sent to my previous address including the CCJ appeals form. I collected the letters from my previous address and since it was a court judgment, I immediately paid the £165 in June 2014. My credit file shows a CCJ as 'Satisfied'. Now the actual problem is, all my possibilities to get a loan or a mortgage have diminished and I am being perceived as a financial offender or a kind of fraudster by financial institutions. My Personal loan application was turned down and credit card applications were declined. This has caused a lot of trauma mentally and I cannot help thinking on it everyday. Everything seems difficult for me now. I am in a permanent employment and have never missed any payments. The only thing I can do is to appeal or challenge against the default decision since I didn't had a slightest idea about it due to the communication being sent to my previous address. Please advise if the appeal is possible now since I have paid the amount and much time has been lapsed since the judgment. Your advise will be of great help. Thank you
  3. Hi, Firstly, sorry if this is the wrong section. I wasn't sure if it should go in the retail forum or not. Earlier this year I (an individual) entered into an agreement with a company whereby I rent a web server from them. At the time of entering the agreement the Distance Selling Regulations (2000) were still in force. There was no minimum term to this contract, and there's no obligation for me to renew at the end of each renewal period. I make manual renewal payments each month by logging into their website, and clicking 'Renew' next to the relevant service. The expiry date of the service is listed next to the 'Renew' button and the subsequent page allows for the selection of the renewal duration (1 month, 3 months, etc). If I want to cancel a server, I do not need to contact the company. Non-payment/non-renewal is considered cancellation. An administrative mishap last month led to their systems automatically deleting one of my servers which involves wiping its hard disks to the point where data recovery is impossible. This deletion has caused inconvenience and loss of data. I still have one server with them, but I am no longer able to trust them, and am worried the same mistake may occur with this server this month. I've therefore moved all data from it to another provider. Their current contract is still worded pursuant to DSR and allows a customer to cancel within 7 days without giving reason. I contacted the company informing them that I wish to use my right under the Consumer Contracts Regulations (2013) to cancel the server, and expect a pro-rated refund for the time remaining in this renewal period. They replied stated they did not believe my rights under CCR reply as I am on a "rolling monthly contract". However, it's my contention that every time I manually renew the server, a new contract is formed (for the duration of the renewal period I select) along with all the rights and protections afforded by the CCR. What do you think? Am I within my rights to cancel this renewal? Thanks

  6. I signed on at the job centre on Wednesday.When i was there my advisor gave me 3 jobs to apply for and said i had to apply for them before i sign on again in 2 weeks on the 5/11/14. She told me to make sure i apply for them along with proof i have as i could be sanctioned for not applying for them. Today iv gone in to Universal job match to find them and apply for them.Iv found and applied for 2 of them but i cant find the third even with the universal match job ID.It was definitely on there at some point because the advisor had printed it out to give to me. My question is surely i cant be sanctioned for this as i have attempted to apply for the job but it no longer exists?
  7. I have been contacted today by shoosmiths to repay a mortgage shortfall. In 2008 they began repossession of my home at the begining of the case i owed £71,000 to HSBC and £7,000 to EPF (EPF was acquired by HSBC after i had taken out the loan). So total owing was £78,000. The property was sold at just over £82,000 in 2010 under the mortgage rescue scheme. Shoosmiths are asking me to repay a "Mortgage Shortfall" of £8,000 This is not a shortfall, it is court costs (which i have asked for a breakdown of on many occasions and not received) I believe that calling this a shortfall is fraud they would have only six years to claim court costs by calling it a shortfall they have increased that to 12 years. I know that there is a clause in the contract allowing them to add costs to the mortgage but surely this clause must be unfair if it only allows an act which would otherwise be unlawful. I am currently unemployed so they have no chance of getting it anyway. I would like to stop them calling this a shortfall. They also spent 6 months arguing (HSBC and EPF which by this time part of HSBC) who was going to show this so called shortfall. charging more interest whilst they did it. I have to reply in 14 days any views or ideas
  8. Hi .. Hoping to get some advice... A few years ago I set up a DMP and was plodding along with that until I got my head turned by Unenforcabilty back in 2011, stopped all payments sent CCA's got some replies and some ignored me. Then a few things went wrong for my family, and I couldn't cope very well with everything that was going on, I buried my head deep in the sand and started promptly ignoring everything. Fast forward to the end of last year and I received Court Papers for a small debt I'd been ignoring, I didn't know what to do, made them a full & final offer which to my huge surprise and relief was accepted, then I paid and stuck my head firmly back in the sand. Fast forward to a couple of months ago (I'm still ignoring all the debt stuff - throwing away letters, etc) and I receive another set of court papers, again a credit card I've been ignoring, again I made an offer, which was accepted but I haven't paid yet as I am still waiting to hear from them. again a couple of weeks ago, I received more court papers, this time for an ignored overdraft, again made an offer, which they've replied to me with a counter offer, which I can afford if I lend the money. But right now I'm terrified of how many more times I have to go through this ... As I said, I've (stupidly) ignored everything, right now I don't even know who I owe the money too, or where to start or what to do. My last payments to them all where made through the DMP some time around May 2011. Most of the debts are £1-2000, which if it comes to it and court papers are received I can raise the funds for around a 50% offer of F&F. But this isn't ideal I know, and the stress of it is killing me, the thing is I barely receive any letters regarding these debts now... . And the one thing that has me really worried is a larger debt, a bank loan which was left with a balance of around £8000 when I stopped paying, If I receive papers for this one I wouldnt be able to raise enough money to make a F&F offer, then what would happen? Sorry this has been such a long post, and sorry if I've posted in the wrong place, I'm just not sure which way to turn, I was thinking of finding out who I owe the money to and then trying to self manage a DMP, but I don't think I'm anywhere near strong enough to handle that. Any advice would be massively appreciated...
  9. Hi All I hope you can help. The situation is that I was due a quite substantial refund from co-op electrical for faulty goods that they couldn't replace. Co-op electrical state that they have refunded the money "to the card/account that paid for the goods" however the card issuer states that "my account" has not received any funds, and quite reasonably they cannot check whether the funds have been added erroneously to another account. I have tried to get co-op electrical to give me the account details (mainly number) of the account they have refunded to but they will only tell me "the card/account number it was paid with" as they claim the actual number is information only their bank holds. It is now over 2 months since the alleged refund and I have got no further. I have sent them a subject access request on the advice of my card issuer which will hopefully crowbar an actual account number out of them, but frankly the experience I have had so far is so shocking that I want to report them to someone, but I cant work out who. The office of fair trading over see the sale of goods act, but says they don't take individual complaints against companies.

  12. Just looking for a bit of clarification on which type of debts dca,s can and can not merge to create a larger debt when going for ccj bankruptcy etc ??? I am sure i have read on other threads but can not find it now that there are certain types of debts that can not be joined together when taking court action. Thanks
  13. Firstly, thank you for reading my post.... Secondly, I'd like to ask everyone who can help for a post on my thread. I sold a car which, few weeks earlier had a new campbelt and a water pump done. The car was driving well and was in constant use. I sold the car as I don't need it anymore due to a job change. A couple who decided to buy it traveled about 120 miles to get it (on a train). They had a test drive, we agreed a sale price and they ended up paying via internet transfer. They left with the car and over an hour later they called to say they cannot drive faster than 40mph, one more hour later they called to say the car broke down completely and there is plenty of smoke coming from underneath the car. As I agreed to keep the insurance until end of the day for them, I rang the breakdown cover who attended to the vehicle, took them to a nearest safe place and left them. I found out from the insurance company that the recovery team suggested a broken campbelt (!?!) and that the car has been left on a petrol station and the couple rushed to the nearest train station to get back home which was 30 miles away! I texted the couple in the morning urging them to ensure they take responsibility for the car as it's their own property now and they should move it asap to not be issued with parking charges etc. They texted back saying they are giving me 2 options - 1 to take the car and give them the money back, 2 to deal with the dad of the girl who is a lawyer. I texted back saying that as far as I'm aware I have fulfilled my legal obligations as a seller and from now on would like to be contacted in writing. So, I have now received two emails asking to provide 'honest description of sale activities' and was given a deadline of 24 hours to do so. Everything I put in the ad was truth, at the moment of sale I was sure the car is in a good state and was absolutely shocked with what happened. I replied to the email with a very brief description of the events from that day stating that my knowledge as to what happened after the buyers drove away in the car is limited and I requested a full explanation as to why they want to take the case to court. I now have to deal with the person who claims to be a lawyer... Although I think I have done nothing wrong, and what happened is just a pure bad luck, I am afraid that there is a chance for the buyer to force me to take the car and give the money back! I actually don't know what happened with the car, I only know what was suggested by the recovery team.... I'd appreciate help and suggested course of actions as I am 100% sure the case will end up in court, with the difference that I don't have a dad - lawyer who can defend me for free...
  14. I want to buy a tablet for my daughter for Xmas but am getting a bit lost with the myriad of options available. She would probably use it to chat/check emails/surf on the go plus as a portable store for course work etc to save lugging a laptop around. She currently uses Windows 7 on her lap top and has an android phone. I was planning on something around the £300 mark but having just browsed on Amazon I might need to revise that upwards. Can someone explain in plain English the relative advantages of the various operating systems and wifi/3G etc? Thanks!

  16. Hello All, I attended my ESA tribunal. I thought I explained myself really well to the two judges really well why I was unable to work. Unfortunately however, I lost the tribunal and my ESA was stopped from the 3rd of October. Now, I don't know what to do... I don't want to claim JSA because I have a severe form of scoliosis and I think working will do me more harm than good. On the other hand... If I make a new appeal to claim ESA I feel like I'm playing the system a little bit and what are the chances of me winning the tribunal if I failed before? I have contacted the CAB and have arranged a meeting in two weeks time. But because I'm not getting any income at the moment I have to decide before the two weeks. So, right now I'm debating what to do. Questions....(1) Would I be eligible to make a new claim for ESA my WCA was in September of last year? (2). How long does it take to receive your first payments of either the ESA or JSA? I have anyone has been in a similar situation I would appreciate it your advice!

Well I've had my letter back from EGG who don't uphold my complaint for thefollowing reason (card taken out online in 2003 by the way) 1) Online sales at that time did not require i take out ppi as condition of obtaining card 2) Online sales at that time did not provide an advisory service. 3) Online sales at that time required you to positively confirm that you wish to purchase policy 4) Online sales provided full T&C and requested you read them before you submitting application. I have sent a SAR request off, which i know may take a little while. Am I dead in the water here. I don't remember asking for PPI or 'positively confirming' - i guess that means a tick - anything. They've said this is their full and final response. HELP! Hx
  18. hi, I'm really in need of some help. My partner has had a ccj for an old debt taken over by wescot. We have moved house quite a few times recently so I'm assuming that is how we missed the original court papers. Immediately we knew about the judgement we contacted wescot to ask what the bill was for. aparently it was an old catalogue debt but the only one he had was only for a couple of hundred pounds. This is now £1700! Have asked for details of the original bill but they have never replied to our emails. We asked for the order to be varied there is also an enforcement notice pending. The enforcement notice has now been suspended on condition we pay £100/month!!! We offered £40. This is an impossible ammount for us to pay ,what can we do? It has never been agreed he owes the money anyway but court action went through before we could get papers in. It changed court three times before we could do anything!! I work part time and get working and child tax credits my partner is not working we have two depenant children and a 18 year old in training. I don't get how we are classed as poor enough not to have to pay court fees but well off enough to pay £100/month! Any advice would be really apreciated

  20. Long time no see My son got involved with these damned payday loans & we are now trying to sort it all out. He has written to all the companies cancelling the CPA & requesting their bank details so that he can pay by SO. He has opened a parachute account into which his wages will be going so at least they can't dip in whenever they wish. He went to his Lloyds bank branch & they were spectacularly unhelpful but he did at least succeed in getting them to agree to report his debit card as lost. It concerns me though that surely his new card will still be linked to his old card & that these companies still will have his bank account number & sort code. Can they still help themselves in the meantime ? He needs to send the CPA cancellation to Lloyds but which address should he use ?
  21. Hi, My first post. I'm trying to help my son get his finances sorted out. Besides the fact that he needs to become much better at managing his money I think he has valid claims for the following:- 1. PPI mis-selling on two personal loans 2. PPi mis-selling on a Credit Card. 2. Overlimit charges on a Credit Card 3. Bank overdraft charges Problem is which do I tackle first? What Subject Access Requests do I need to send. All of the above potential claims relate to the same bank. Will one SAR cover all of them. How do we obtain copies of loan agreements and PPI policy documents and the T&C's for the Credit Card (searched the internet without luck) Called in the Bank yesterday, they couldn't provide the full Credit Card T&C's for their current Credit Card. A few pointers in the right direction would be appreciated. Thanks

My personal accounts are with First Direct whom I moved to from Smile after receiving bad service and a 'couldn't give a stuff' attitude to helping me when their system decided of its own accord to stop paying my standing orders even though my salary was there Anyway, had no issue with FD but am now looking to start up a small venture I will initially run in my spare time but am hoping to build into a business. Now I know I need to set up a business account but I know FD don't do them. I had an HSBC credit card some years ago I paid off and shut down because of the dire offshored Customer 'Service'. More recently I opened a savings account with their M&S Bank JV and had to ring up to reset my password, it took me 15 minutes to actually get this done as the person was struggling with their English. (it usually takes me 5 minutes tops to deal with anything with FD) I wrote to close the account and explained that the CS was why I was closing the account. Anyway I digress. The point of explaining the above is that I don't really want to go to HSBC or co-op. So anyone have any suggestions for one that: Has UK based CS Doesn't cost a fortune to run (brief research indicates there are a couple that have fixed monthly fees) Doesn't require a trading history (I will not be needing credit facilities from the bank and until such time as it is generating sufficient turnover will have a standing order in place to fund the account with the capital required to pay the monthly running costs) Any suggestions appreciated.
  24. I just joined a few days ago with a post about impending court action from my water company. Someone then told me they'd moved it from the section I posted it in, and put it in the utilities section. Another poster suggested moving it, and then another said I should start a new post, as I had put it in with another post of similar subject matter. I'm new to all this and really would appreciate some help on where to post, and sorry if I am in the wrong secton now. Thanks for your help.
  25. It would be very helpful to build up a picture of which parking companies manage which retailers carparks. If you know that XXX supermarket is managed by YYYY parking company, please let us know here. We aren't looking for individual carparks. Presumably each carpark owner only deals with one carpark operator. Thanks
