  1. My OH had a unsecured loan with A & L in 1995 in which she settled early but recalls that in order for her loan being successful ppi was added. It wasn't a large loan but nevertheless she paid monthly ppi premiums for about 3 years. The problem being is that she cannot locate the original agreement details but does have a couple of letters in relation to early settlement and rebate figures with loan account number and old address details. So she sent off the usual SAR letter to Santander and has now received the attached response. Has anyone received one of the same or is it the usual Santander reply letter ? Cheers

Hi i am new to the forum and any help you can give me will be greatly appreciated, Several weeks ago I sent a SAR request to Santander to see if I had PPI on a loan I had taken out, when i received a reply back today I thought I would have nothing more to do than open the envelope and look through the files, unfortunately this has been impossible, due to the quality of the loan agreement they have sent out to me. I have uploaded copies of the agreement they sent to me. .( this is the quality of agreement they sent to me).. Now i am not sure what to do next, and if i have grounds to ask them to send out another copy but of a better quality that is readable. kind regards

  4. Hi recently SAR Barclays and have received a list of documents from them, can someone give me an idea as to what they should have sent me. They have sent me a print out of statements which point out telephone calls made to house and late payment charges going back 6 years dont seem to see any T&Cs included. I know I have had an account longer than that, is this all that they are required to send me, any help would be appreciated.
  5. I made a standard CCA application of Santander in respect of a current account, originally with Alliance Leicester following an online application in 2006. I got a fairly prompt response returning my £1.00 and making the following comment: " ... we have now completed a search of our systems and can confirm that this account was not regulated by the Consumer Credit Act and therefore does not have a credit agreement. ... " As a further check I then made an SAR for everything relevant. After an inordinate delay Santander sent me maybe a dozen pages of copy statements saying that that was all they were obliged to provide. I spent an interesting two or three months arguing with them, being told that that really was all required, that they hadn't had my application, that they had had my applicatin but I needed to repeat it and enclose anoher £10, that I hadn't included a cheque, and more such nonsense so I made a complaint to the Information Commissioner as I'd already threatenend. This eventually produced a thick wad of stuff and a letter saying that as a matter of goodwill they were making this so-called second supply available to me free of charge! Clearly I then searched the bundle very carefully and there is indeed no sign of any agreement although copies of both my original CCA request and the bank's response are included. I've earlier told Santander that we're in dispute - this is mainly around unreasonable charges (such as £140 for exceeding the agreed OD by around £3) but also issues around their management of the account and ignoring letters, instructions and the like - but although they initially paid no attention to that, bringing in their own tame debt collectors (Moorcroft) and flooding me with letters demanding full repayment of an inappropriate sum, at least they've now quietened down. Is there any validity whatever in the claim that such an account would not have been regulated as they claim? And presumably with a copy of the agreement they are, at least for the moment, stuffed both as regards enforcement and negative reporting. Thanks.
  6. Hi there I am trying to find out the insurance under writers for Barclaycard in the 1980's and 1990's. I think it was a company called Consolidated Financial Insurance Group Ltd but I have been unable to find out anything else about them such as who the parent company was? Does anybody have an idea or could you direct me to a register of under writers for the various financial institutions? Barclaycard are being very unhelpful in supplying information about my PPI policy and this is a possible further avenue for investigation. Many Thanks.

  8. I have given my goods back to Brighthouse, due to me not having the money to spend on it, but now im in a safe financial state, I would like to ask if I can have my goods back. Im not sure sure if they have sold it on, or they kept it. Its obviously to late to ring and ask. So wondering if someone on here could shed some light on what they have done with the goods. Thanks.
  9. Hi I wonder if anyone can help. I have various CCJ's which are being paid and a recent check on my credit file shows that all my previous old defaults/CCJ's have disappeared since it was more than 6 years since they were applied. One particular one is a credit card from Halifax which is for £5.5k. It was only ever defaulted and I am now starting again to receive letters for settlement. Over the years this has probably been passed on and I recently received a letter from Marlin who were appointment by Cabot Financial. I ignored this and they have now passed it onto Reston’s who are threating court action. One thing to note here is around this time in 2009 I did contact the CCCS to start a debt management plan and only ever made 1 payment to them. I am unsure who the CCCS actually sent the money to but I am guessing they split it over all my creditors by apportionment. My question is because this payment was made, is there any point writing to Reston’s saying the debt is statute barred? Would I be wasting my time as they will have a record already of the last payment being 5 years ago? I am tempted to just ignore the Reston’s letter but I have a feeling they will go for a CCJ. Any advice would be most welcome. Thanks
  10. Dear all, The Friday before last (4/7/2014) I went to make a debit card payment for dinner with clients and the transaction declined. I checked my account on my phone (Barlcays App) and my two barclays personal accounts (current and premier) 4 savings accounts and 2 business accounts were collectively showing to be overdrawn by £5,000,000. On 7/7/2014 all available funds in the account were sent to reconcile to Coventry OPS 05 ADV. I logged a formal complaint on (4/7/2014) and after countless calls to customer service advisors who gave excuses ranging from a technical error to an account review and no resolution I sent an email to senior executive at Barclays. Later that day I was contacted by a member of the Barclays customer relations team at their Head Office in Canary which was on Thursday of last week (10/7/14) however he has not been of much help at all, he has not provided any clarity as to what is going on or any time frames as to when I can expect to have my funds released. I have gained an understanding myself and believe it is a Suspicious Activity Report (SAR) that has been filed to the National Crime Agency (NCA) or similar however I have nothing to hide and although its been a good year for business everything is above board and I do not understand why they can't simply ask me for clarity... This freeze on my accounts/blocking of funds is causing serious problems for me and those dependant on me/my business. I was wondering if anyone has experienced a similar situation and if so when the issue was resolved and if there is anything I can do to speed up the process or any other information that might be helpful. It's so frustrating being in the dark and having hard earned money taken away from you with no explanation ! Thanks.
  11. Hi, Back again, still battling on, been a while, mainly been ignoring the thieves and vagabonds that seem intent on trying to part me from my money... Hope someone can help with this one, assisting family member who has received an SD two days ago which we will request to be set aside as is in dispute and CCA request as yet is not satisfied (years overdue). Have been trying to view templates or copies of an SAR suitable for this but keep getting a message saying I do not have permission to view the pages? What do I need to do? looked at new CAGmail for SAR but was just blank and referred to a complaint to the ICO which doesn't seem right? The alleged creditor is Lowell for an alleged debt apparently purchased from HBOS. Can anyone help with a suitable SAR? I presume this is to go to HBOS? Or Lowell? or both? Should I just use and modify the template from the ICO? Hope you can help, Cheers Bongo!

Hi Just after some opinion I had a HBOS current account that has been with Wescot and has now been sold to 1st Credit Arranged payments were being made on it until about Jan 2012 In my many correspondence with Wescot , amongst other things they claim that there was never an OD facility on this account but when you consider that for most of it's life there were periodic debit balances of over £100 and no charges that is easily shown to be a lie. Anyway it was sold to 1st Credit so I wrote asking for the statements etc that they should have been sending me. They have come back with statements from opening until Sept 2011 . The odd thing is the final statement says 25th August 11 balance -716.10 12th Sept closing balance £00 but nothing to show where that money went The summary sheet also shows closing balance 00 and £444 of fees paid Since that date a further 6 monthly payments of £1 have been made which reflects in the balance The account number in question is definitely a current account with cheque book etc but the final pages refer to it as being a cardcash account. Now I did also have one of those but a different number. Has anyone any thoughts In summary they are chasing me for £710.10 but the statements show a balance of £0. The statements refer to it as a current account but the sheets relating to charges etc refer to it as a cardcash It seems to me that they have no idea what is what

As this is such a long time ago, I am not sure whether it is worth me making a Subject Access Request with them.   15. Hi , my wife had an old Halifax account that she hasn't used in over 5 years (last used around Feb 2008) and she accrued a debt of over £1400 on the credit card + £500 on overdraft. The original debts were well below these figures but added charges + accrued interest on top, makes these figures as things stand. We then left for Australia as part of my work, and only recently been back. Fast forward now, and the greed machine have been grinding away hard, the latest company to have taken over is Bryan Carter LLP (no less !). This outfit now sent a letter three weeks ago to my wife threatening court action and CCJs. After reading few useful (always!) articles here, I decided to CCA Bryan Carter (+ £1 as per law) and I was about to SAR Halifax. To my surprise, Bryan Carter sent back a reply within 2 days, and they say: "We thank you for your recent letter the contents of which we note. If you require documentation under Consumer Credit Act 1974, you may request this directly from our client with the appropriate fee". In the meantime, please contact us with your payment proposals". How can they chase this debt then if they cannot or do not hold any valid, relevant and original agreement? What is the course of action in this case? Thanks for your help and for reading this.
  16. Hi All, My dad has today received his SAR response from Barclays of which I am going through for him. Your help will be greatly appreciated in answering my queries. 1. On the Prequal PPI under BID policies my dad has one for First Plus, does my dad complain to Barclays about this? 2. On the retail account details it lists Barclay loans plus the First plus loan mentioned above and 2 monument visas. My dad had 6 loans with Barclays some with PPI. The Barclay loans show a "Y" or "N" under the account PPI Flag section, but the monument visas and first plus loan show "I" under PPI flag. What does the "I" stand for? 3. If my dad did have PPI on the monument visa which was sold to him in branch at Barclays, does that mean he complains to them and not monument? Thanks in advance

    Apex and Egg

    I had an egg loan sold to Apex credit. I sent them CCA request 3 years ago and they replied with a CCA. However I have never paid them and they have never chased me. I am trying to sort out finances at the moment but am wary of phoning them after all this time. Does anyone know why they have not been in contact ?

Hi i have 2 items with brighthouse that cost 18.40 a week (including osc which after reading this forum i understand i didnt have to take out despite them insisting on it) the account should have been paid on saturday just gone but due to unforeseen circumstances i am unable to make a payment until next tuesday which will make it 2 weeks in arrears the following saturday. I have had a shop manager on my doorstep today telling me that if i dont pay by 12pm tomorrow (thursday 17th jan) that they will be taking my goods. in my contract it states in the repossession part if you do not keep your side of the agreement but you have paid at least one third of the total amount payable under this agreement, that is 438.88 we may not take back the goods against your wished unless we get a court order i have paid this amount and more. when i said this to the manager he told me that because it was worded "may not" instead of "can not" then he could take the goods with out a court order. am i right in thinking this is a load of tosh? i have told him the date i can pay it but hes being very arrogant about it and id like to know my rights in this as it all seems a bit wrong. Ive not received any letters or a default notice in writing only him phoning me but i missed his call and him on my doorstep. when he undoubtedly turns up to try and collect the goods do i have to let him into the property? thanks in advance

Hi can anyone help me, I have sent a SAR request to HSBC, I used the following address: HSBC Bank Plc Service Quality Team Arlington Business Centre Millshaw Park Lane Leeds LS11 0PP I sent the letter Signed for delivery with Royal Mail. My problem is when I track the letter on royal Mail it says that they (RM) have the letter, does that mean that no-one signed for the letter at the address and it is sitting in the Post Office. Is there another address I should be sending the request to, how long will I be expected to wait for the information? Grateful for any help!
  20. Hi guys... Basically, since i upgraded my contract back in march 2011, i have had no signal. I moved a day or two after i upgraded, and my new area has no signal. I called orange, and they basically said "tough sh.." so ive been in contract, paying for the past 16 months for a phone i cannot use. O n 29th may i signed into my account, and found out my price had been increased! - I was not informed of this... apparently texts were sent, but i didnt get one... So, as the text would be stored on Orange systems, I have put a SAR request in... under the DPA, Orange are not entitled to request more information than absolutely necessary in order to process the request... this has been going on since may 29th, and no luck is progressing , ive refered my case to CISAS... what i want to know is Orange has my details, account address, bank details ETC, so therefore my SAR request below would stand correct? below are last few messages... I recieved a letter in the post this morning from orange saying that they want a copy of a utility bill showing my full address (Orange could provide me with this) and a copy of my passport (they are already well aware of my ID) - their letter also states they will not deal with my SAR until i complete their form... which i do not intend to do, but the letter also states "A fee for the sum of £10 made payable to Orange (we are entitled under the DPA to charge a fee of this ammount)" on their actual SAR form it states "Under the DPA 1998 you have the right to ask if we process your personal data and if so to be provided with a copy of that information. Please complete this application form (typed if possible) and return it to us together with a payment of £10 (cheques should be made payable to Everything Everywhere t/a Orange. We will reply within 40 days of reciept of the completed form and fee" now please correct me if i am wrong on my possition that my email started the 40 day limit on 13th June 2012, as i gave them permission to debit my bank / card with the £10 fee... my CISAS complaint does not revolve mainly on the price increase, but the numerous complaints i had with orange for poor broadband service, lack of billing, failure to provide service, and failure to reply to complaints... The CISAS have accepted a previous message from Orange as a "Deadlock letter" as Amanda has stated in it " We are happy for you to seek independant advice on this matter and we will not reply further" but wont actually issue a deadlock letter... I intend to take ORange to Small Claims court, so my SAR (see how detailed my request is below) will be my main weapon against them, with the numerous complaints ETC I filed with them. i also like the fact that orange wont respond to my complaint for lack of service as she cannot "locate my previous correspondance" (totally rude, and absolutely irresponsible in my view)... - but it all goes in my favour with CISAS... I have asked for CISAS to basically give me £120 (contract payments for mobile service not being recieved) and a formal letter of appology from orange for lack of support / reply to complaints, and a termination of my account with no fee. I feel this is well below what i am entitled to. I have put no claim in for damages ETC... so would you guys say this is would go through well? if CISAS cant deal with it appropriately, I will take it to small claims, and the SAR will be key with "Cell Data" showing i have been unablee to use my phone in my home area.

Hi, I put a PPI claim in to the FOS on behalf of my husband October 2010,at the time he was still managing to pay his CC and loan, however it all went belly up in April this year and as I have heard nothing for months from the FOS I'm wondering where it will leave this claim when the HSBC take action against him which from the letters received yesterday could be soon Ro

  24. I am thinking of applying for a mortgage this year, so thought it would be good practice to check the old credit file. I found that a default had been lodged on my Call Credit file for £5,650.00 by "Barclays Partner Finance" ( default date has been set at 11/05/2011 ) when I am sure they have changed the date of default forward, as I defaulted on that loan way back in 2008. But on top of that, they forwarded that same debt onto a Debt Collecting agency called "CapQuest Investments Ltd" who have set their own default for the debt - Date 31/12/2009 amount £5,961.00. I am not sure if this debt has been sold on to CapQuest, or if they are just acting for Barclays Partner Finance, but in any case, is it legal to lodge 2 defaults for one debt? The default lodged by CapQuest, is on all 3 credit reference agencys, but the default lodged by Barclays Partner Finance, h as only been put on Call Credit, either way, my chances of getting a mortgage with even one default is remote I think? I just need to know what the best way forward is going to be for me? I have read somewhere on the forum, that people have managed to negotiate with the Debt Collection Agencys to remove the default by paying off the debt in a lump sum, and if this is possible, then would I be right in saying that, Both companies would have to remove the default, if the original company holding the debt agrees to remove their default?   25. Hi all, As suggested by other members of here I am trying to get a default removed if possible that Next has set on me back in 2012, even though at first they denied it. I have tried all the begging letters without success and I'm hoping that from the contained SAR info that something is a miss. I have noticed that the debt collection department letter and the signed credit agreement letter are for different address's, this change anything? Also as you can see I haven't signed anything and NExt state that they're not obliged to provide a copy either?!?! Any advice and help as what to do next would muchly appreciated Thanks in advance
