  1. Hi all, I'm planning to send a SAR to HSBC on behalf of a friend who holds a credit card, a current account, a savings account and a loan account with them. My friend lives in Jersey, where all dealings with HSBC have been conducted. Can anyone please confirm if a single SAR is sufficient to cover all of the above accounts and the correct address to which it should be forwarded, given the location being Jersey and I am unsure whether or not banks fall under the same legal jurisdiction and share the same administration offices as do those in the UK, or are classed as separate entities? Thanks in advance.
  2. i am writing on behalf of my wife. she was employed as a manager for just over 6 months, her employer phoned her up just under a week ago and told her they was terminating her contract as of immediate effect. This was done without any probation meetings and no meetings prior to raise any concerns. I don't want to go into much detail as at the moment she has just started by raising this problem with ACAS. The employer has since claimed via a letter a fictitious probation meeting took place AFTER the dismissal via phone call! This was probably done by them to distract from they acted unprofessional and possibly against employment law. She had disclosed all her health problems at the original job interview and recently was found to have some other problems arise during her employment. She has had time off because of her disclosed health problems but these have been for hospital appointments and she was told to put them in as sometimes sick and sometimes annual leave. Just before the phone call terminating her employment she had informed her Line manager she was going to the GP as she has been under a significant amount of stress with her job, within 10 minutes of notifying the line manage she received the call from the owner of the company terminating her contract. The doctor who assesses her gave her a fit for work note stated work related stress. i would like to point out that they are not going down the health route for sacking as that would be discrimination and they was made aware of that by my wife about 5 months into her employment after they was complaining about time off for appointments. She told her employers she was going to acas as she felt she had not been treated fairly to which the owner said they have a lot of businesses and have a lot of solicitors that they can seek advice from if she chooses to go down that route. anyway i went off course a little but i felt i needed to share a little info as a lead up to my question. As she has already seeking advice from acas under the new data protection rules would/should she make a SAR request to see exactly what info they have or wait until it goes to tribunal? is there a template for an SAR request with the new rules listed and also what can she ask for... also is it possible to ask for any emails, possible taped phone conversations although my wife was never told of any phone conversations that were being recorded, texts, correspondants etc which my wifes name is included in. any info would be greatly appreciated thank you
  3. Hi everyone, I'm hoping someone can offer a little help and advice. I wish to serve a SAR on the bank that previously held my mortgages (I had two linked to the same property, due to undergoing a - relatively amicable - divorce and being obliged to buy my spouse's interest in the house - who had no desire for the property...just the cash). I've lost all of the documentation, pertaining to said mortgages. I would like copies of the original offer and subsequent agreement along with all terms and conditions (including those if/as and when they may have been amended). Additionally, I want the bank to provide a full list of mortgage repayments made by me and received by them along with details/notes of any and all communications between our parties, howsoever conducted (written, telephone, carrier-pigeon etc.,) as well as any manual notes and/or interventions which may have occurred with regard to my account, throughout the term of the mortgage. Does such a SAR template already exist or is there any member of the forum who may help me to properly draft a suitable Subject Access Request? I'd be extremely grateful for any help/advice/referrals. Many thanks. Jib T
  4. Hello Caggers Any help surrounding a SAR with Lloyds and HSBC. I've been going backwards and forwards with Lloyds for nearly 4 months," no record of my account in their system,please supply full account no." Raised a SAR and finally they find me in their system but are requesting certified only documentation as proof of name and address. I must add I live overseas so any correspondence is a really drawn out process, it appears to take 5 weeks for a letter to get to Australia from Lloyds. Do the banks normally stipulate certified paperwork only? It feels like the bank are putting up as many barriers as possible. Having the same problem with HSBC who haven't even acknowledged my SAR.

  7. Hello all, Long time lurker, first time poster. The wisdom and knowledge of this forum has gave me the confidence to ignore all previous calls/threats but this latest letter is something new, that I haven't seen listed before, so feeling a little anxious. ARC have taken over my QQ account after QQ failed to accept my monthly standing order payments and insisted on a DD only (we all know why). I have since moved to another bank and get my wages paid into that new account. The old account still exists. I received this letter this morning. ARC have been phoning me 3-4 times a day but I have blacklisted all their numbers and it goes straight to voicemail. Any advice welcome. I have not sent the 3 letters, choosing to ignore all correspondence instead. Thankyou Kev
  8. I believe that a former employer may have acted unfairly against me whilst I worked there and I'm intending to SAR them to see if there is any evidence of this which I can use. I do not know where the evidence may exist or in what form, whether it is in emails, phone calls (which I know to be recorded and stored) or paper records so I would like to make a SAR for every piece of information they have. I also obviously do not want to disclose the reason for my request and find that the evidence I'm looking for may miraculously disappear. I am uncertain whether it's better to make a SAR in the next couple of days (before GDPR comes in), or wait until next week when GDPR is introduced. Under the present system, AIUI I pay the statutory fee of £10 but I then have an unqualified right to request all information. However, under GDPR the statutory fee is abolished but they will be able to charge a 'reasonable fee' where the request is 'manifestly unfounded'. Is there any guidance as to what a reasonable fee might be (lower/higher/the same as the current statutory fee?), and what qualifies as a 'manifestly unfounded' request - is a general request for all data rather than a targeted request considered 'unfounded' in itself?

Lloyds Current Account O/D £900.00dr sorry been paying them £1 month recently payplan. 10 year old debt - fallen of CRF. obviously being fleeced as debt not really gone down. What letter do I send to Akinika ? unsure of this one as current account. Thanks Peeps

Hi, I opened a credit card account with vanquis in September 2005 and stopped paying them around early 2008 as they were hammering me with charges and i'd pay them what they asked for and the next month there'd be another charge. Obviously they must have defaulted the account and sold it on to lowell. I've only recently been checking my credit file and noticed that the default date for the account is september 2013. The cynic In me feels that lowell.s may have done a bit of sleight of hand with the default date as I doubt vanquis would have waited over 5 years to put the account in default. I no longer have the account details for this, so is there a way I can Sar them without the account number and will this reveal the correct default date or would I need to request that seperately?
  12. Hello. I am just about to edit a Subject Access Request to a company for my friend who has had a relatively long running dispute over the amount they charged him for work they did. Other than requesting copies of any and all letters between them and any internal memos or emails that he is mentioned in, is there anything else that you would recommend I include? Thank you.
  13. Hi there. Just on the off chance my husband sent a request to Barclays to see if he had PPI on any of his cards. It turns out he had it on his Barclaycard Mastercard from Sept '97 until Dec 2004 and on his Barclaycard Visa from Sept '97 until Aug 2015. What would be our next step forward please? Thank you.
  14. Hello all. I've just found this forum and have been reading through some of the very helpful guides regarding PPI. I am currently in the process of helping my sister with a PPI claim against Capital One. We've never done this sort of thing before so do have a few questions we were hoping you could help with. Initially we contacted Capital One to ask if she had PPI. They emailed back and said yes. I then sent off a SAR to see what information they hold on her as we're not sure if she was mis-sold, so are trying to establish a few facts. They responded with a pack that contained loads of statements, memos etc. I don't think it included everything I asked for, they said to ask again for specifics (like which telephone call exactly) and they will provide them. In the statements it shows PPI, there is also a signed copy of the CCA which indicates my sister asked for PPI. She is a bit suspicious of this but that is neither here nor there, the fact is it's signed and she has signed up to it according to this document. We want to know whether it is possible she was still mis-sold though. Ideally, we need a copy of the literature explaining what exactly PPI is and its policies that you would expect to have been sent out at the time. This will allow us to check if she was eligible or not and perhaps claim on those grounds if she wasn't. If she was eligible then we can at least draw a line under this and not bother complaining. Is there any way of obtaining this document or information? I understand a CCA request will just be the loan agreement which they already provided a copy of in the SAR. I imagine they must have sent out a PPI leaflet as opposed to discussing it over the phone with her, as the memos do not indicate any phone calls prior to the start of the PPI agreement (although they are hard to comprehend). She was in part time employment at the time, had not been in full time employment for six months prior to the agreement which elsewhere I have read may be deemed as reasons for ineligibility and thus a mis-sale. So we're not really sure how to proceed from here, if at all. Thanks for reading, I appreciate any help regarding this.
  15. I have been in writing to Drydensfairfax Solicitors back in March 2016. They are acting on behalf of their client Max Recovery Limited who purchased a debt. I had previously asked them for a credit agreement and copy of the deed of assignment. Back in March 2016, they wrote to me in reply. They provided me with a basic office copy of a credit agreement. They claimed that their client, Max Recovery, had provided them with a copy deed of assignment, and that they had attached this to the document for my perusal. Upon checking the documentation, this assignment was not present as stated in the covering letter. For the past year, I have had no response from Drydensfairfax. Today, I checked my credit agreement, and I am horrified that they have placed a default on my credit file on the 30th May 2017. Under section 87(1) Consumer Credit Act 1974, I have NOT been provided with a written default notice prior to this default being placed. Can anyone please advise me what to do next as I feel that the default is illegal!? The other concern is that Drydens should not have put the default in their name as the debt belongs to their client Max Recovery Limited. Am I correct in thinking Drydens have done this default incorrectly it should be their client!?
  16. nowlo everyone, I was hoping you'd be able to give me some advice on my current situation. I really want to keep on top of things. Natwest Loan £2,505.78 Natwest Credit Card £1,686.25 Natwest Overdraft £500.00 for my credit card, or shall I say Triton debt management. At the time I was awaiting confirmation of JSA, housing benefit etc and had no income. They accepted a monthly £1 token payment. End of last month they constantly kept calling me, I answered to shut them up. They told me the first agreement wasn't valid as I had no income and therefore it shouldn't of been made. Said the person that called me was 'new' (like that's MY problem) . I was forced into doing an income/expenditure there and then. Somehow they figured I could afford £7.99 a month . I couldn't, but felt really forced. I agreed. Since then I did a proper inc/exp for myself, and down to bear minimums for outgoings I'm still -£8.99 minus a month. I wrote a letter, which I sent recorded with an enclosed copy of my inc/exp saying I cannot afford the repayment agreed, and as of 5th Sept I will be making a £1 token payment, via postal order for the next 3 months (on 5th of every month), when I will review my financial situation (and could freeze interest). what I'd like to know is, was this right thing to do? What are the chances of them freezing my interest? They would have received my letter a long time before that payment was applied for. I'm worried they can keep applying for this amount. How can I stop them? What rights do I now have? Can they take me to court? I'm using my PPI for the Natwest loan. So that's covered. Any help appreciated.
  17. Hi I wondered if anyone had any experience of this problem? I am negotiating with Mercer's to set up a reduced payment plan to pay off my debt to Barclaycard. They want me to take up a direct debit. I've been told by my debt counsellor not to give out my card details. I've told Mercers this and also that I'm afraid that they will take out more money than I have agreed on. They told me that it would be illegal for them to do this. I want to believe them and I am keen to get the ball rolling but I would prefer to pay by cheque but they have turned that offer down. Are they trustworthy?
  18. Hi all I sent a SAR off to barclays on the 20th of May - I got a reply today from them saying they could not process the request as the "cheque is not valid" I had enclosed a blank postal order for £10 They have not returned it or told me why it was not valid What is my next move Thanks
  19. Some years ago, Cabot acquired five credit card debts I had with BOS/Halifax/IF/Barclays/Lloyds. This amounted to a substantial sum and was the result of 'getting my fingers burnt' in property development. There is no entry in my Credit report for any of these amounts, or from Cabot. For the past several years I have been paying an agreed £1/month on each account to Cabot, no payments missed or late. They seem quite happy with this and don't bother me. This amounts to the princely sum of £60 / year in reduction of the substantial debt, less whatever they spend on administration/letters etc. I am almost seventy and have negotiated substantial debt write-offs with NatWest, Capital One and Tesco directly. Cabot would not write their debts off. With my sisters help I have tried to negotiate a settlement of £2000, (ok the total debt is around £40,000), but they keep saying no. I have pointed out to them that if I live to 80 they will only get £600 and to 90 they will get £1200... ..and I will have no assets to leave, but they are adament I keep paying £1/month each account. I could simply keep paying this and let it die with me, but I want a 'clean sheet'. I have requested a SAR within 40 days. 1) Assuming they respond in the timescale but do not send any signed novation agreement or original /certified copies of the original agreements bearing my signature, can they actuallly DO anything if I stop payment? 2) I am selling the modest house I have in the UK (no equity) and going to live with family in France. If I just leave the UK and don't give any French adress what would/could they do? 3) If I did either of 1 or 2 can they retrospectively place entries on my credit report? thanks

  21. Hi Everyone I have been charged by Monument £1020 on late payment and overlimit fees. My credit limit is only £250 and I owe them about £1075. Last week I sent them the letter from this website requesting statements along with my £10 cheque. Yesterday I received a letter back from them giving me a spreadsheet with all the charges. They also gave me my £10 cheque back! Can anyone advise what I need to do now?? Should I print off the template letter on this site, asking for the £1020 to be refunded?

Quick summary: - I owed about £200 in tax, which was passed to Rossendales - Tax was paid directly via HMRC website - Rossendales requested proof, which I sent - Rossendales then tell me HMRC say this relates to another debt (even though the payment reference shows the correct debt) and for me to send a payment proposal. - I send an SAR to Rossendales requesting among other things, a transcript of the conversation with HMRC about this being the "wrong debt". - Rossendales write back saying: "Sorry, we are not the Data Controller, send your SAR to HMRC" Question - is Rossendales obliged to deal with my SAR or can they pass the buck to HMRC?

Hello everyone, I have applied for current accounts with Natwest and RBS which have both been denied (even though I was originally accepted) I want to know why they have refused me as my credit file is in good condition, no defaults etc so do I need to send an SAR? if so, is there a specific template? Any help or advice would be appreciated.
