  1. Just a thought. If you are on ESA and you have not got savings above the threshold of £6000.00. Is it possible to try and save by the help of family members to save for an old age pension, not to be touched until your official retirement age? This is just a general enquiry on behalf of my friend who is already worrying for her retirement, if she lasts that long! Any advice would be welcomed. Thank you, and if it's in the wrong place please move the post to where it should belong. I put it here as she is on ESA. The silly thing here is, she can hardly live on her ESA as it stands at the moment, never mind save e bean!
  2. Hi all, A friend has been bullied and harassed enough to quit his job after only 9 months. He resigned and I was wondering if he could still take his harassment to an Employment Tribunal or is there a time restraint for length of service. Thanks in advance for any replies.
  3. Well finally OFCOM have finally find a result with the Vodafone Investigation they were dealing with. The investigation relates to a fairly wide period between 1st January 2014 and 5th November 2015
  4. One of my original credit card debts for 6k was with MBNA. they have passed this on to PRA group Ltd. however, checking noddle.. the original account was defalted in jan 2013. but now shows as a 'Satisfied Account'. the PRA entry shows default as june 2014, so mbna have passed the account onto PRA. then PRA have started sending in entries to noddle etc. If companies like experian remove after 6 years automatically, won't this PRA entry be over a year later. ? Another thing ive noticed.. is that on my credit report, i have Credit Cards shown, but there is one at the bottom, which has been purchased, was b/card CC. but now shows as as a separate company.. and the TYPE as BANK. not Credit card. should i be worried about this?
  5. Ok so this one can probably afford it . 6. Long time lurker on this site but now I need your advice please. Step daughter 23 has not worked for several months since she lost her job in a call centre for swearing under her breath (so she thought) while on the phone to a customer. She has recently been diagnosed with borderline personality disorder which may explain her actions. We have been looking after her to try to get her in a better frame of mind to move forward. We have not sought or received any financial assistance with this. We encouraged her to look for work and sign on for JSA as she seems to be improving. She had her interview today and they have told her that she has to attend the Job Centre for one hour every day for 5 weeks before she can claim. My question is is this situation typical?
  7. There have been some interesting changes in relation to the Civil Procedure Rules 2016. I am very interested in Part 89 in particular. >> https://www.justice.gov.uk/courts/procedure-rules/civil/rules/art-89-attachment-of-earnings Are these changes going to be of use and can they be used for all attachment of earnings? Your thoughts please.... For the full changes see here >> https://www.justice.gov.uk/courts/procedure-rules/civil

  10. Pension s cams, in which criminals cheat people out of their pension pots, are increasing. There are different types of s cam. They often begin by someone giving you a ‘cold call’ - contacting you unexpectedly about: an investment or other business opportunity that you’ve not previously spoken to them about taking your pension money before you’re 55 the ways that you can invest your pension money A cold call doesn’t have to be a telephone call. It can be any type of contact they’ve made with you unexpectedly, eg an email. S cammers may offer you tempting ways to invest your pension pot, eg investing it in a new hotel being built in an exotic location. Most of these offers are fake but can appear very convincing. Their aim is to get you to cash in your pension pot and transfer the money. Once you’ve transferred your money into a [problem], it’s too late. You could lose all your pension money as well as face tax of up to 55% or huge additional fees. How to tell if it’s a s cam Watch out if an individual or company: cold calls you about your pension money through a phone call, a text message, visiting you in person, or in other ways says you can access your pension money before 55 and that they can help you with this encourages you to take out a large lump sum, or your whole pension pot as cash, and to let them invest it for you asks you to transfer your money quickly, even sending documents to you by courier - never make a rush decision about your pension money uses words like ‘pension liberation’, ‘loan’, ‘loophole’, ‘free pension review’ or ‘one-off investment’ offers you an investment described as ‘unique’, ‘overseas’, ‘environmentally friendly’, ‘ethical’ or in a ‘new’ industry https://www.pensionwise.gov.uk/[problem]s FCA steps up s cams campaign ahead of pension freedoms The FCA has stepped up consumer warnings over investment [problem]s as the 6 April pension reforms deadline approaches. People should reject cold calls, check the FCA’s warning list and take financial advice to tackle fraudsters targeting their pensions savings, the regulator says. 11. Our workplace, a data entry organisation has come up with two new rules. As yet, I have only heard about this third-hand but expect to hear it from management when I go on my shift tonight (night shift). Apparently, if we want to go to the loo, we have to raise our hands like little kiddies in school and ask for permission. Degrading and humiliating in the extreme, especially to female members of staff - there are only 3 of us on our shift. Second, and utterly stupid "rule" is from now on, we cannot leave our desk. If we want something on another desk we have to stretch across. We are not even allowed to stand up! You can imagine what's going to happen. Someone is going to stretch across, the chair is going to go out from underneath them and they are going to get injured. You couldn't make it up. Seriously, if I wasn't the chief breadwinner (the only breadwinner) for my household and wasn't nearly 60 years old, I would tell them where to stick their job. We also have a manageress who is an out and out bully (to everyone except her "pets") who is a bully, tyrant and liar but that's another thread for another time. If anyone can give any advice on how to deal with this, please let me know. Tried the HSE but they don't give advice over the phone and it can take up to 30 days for a response to their online form. I am not a union type person but I'm now seriously considering joining a union as the petty rules and bullying are getting out of hand.
  12. The UK's broadband providers have been told to expect tougher rules on how they advertise their services. The UK's Advertising Standards Authority said it was considering the step to ensure people "aren't misled by pricing claims". It follows a study that indicated most users could not correctly calculate bills based on the information given in a selection of broadband ads. The ASA said it would make a final decision before June. A lobby group representing the broadband industry has suggested more research is needed before any changes are imposed. But one of the internet service providers has already said it supports reform. "It's obvious that a single headline price is much clearer and better for customers, and we're actually already doing it on a pilot project up in York," said a spokesman for TalkTalk. "But until the whole market moves to single prices, any company that advertises its products like this will struggle to compete with what look like better deals from other providers." The announcement comes a month after the charity Citizens Advice called on the ASA to review its code of practice because it said consumers were being misled by attractive-sounding broadband offers.   13. In 2015 there was a important and high profile Judicial Review regarding the serious matter of summons costs in relation to a Liability Order for council tax arrears. The case was that of the Reverend Paul Nicholson v Tottenham Magistrates and the London Borough of Haringey. In short, the court rules that Tottenham Magistrate's should not have allowed London Borough of Haringey to claim summons costs of £125 for each Liability Order given that the court did not have sufficient information before them to reach a proper judicial determination as to whether or not the costs claimed represented costs reasonably incurred by the Council in obtaining the liability order;
The court found that Tottenham Magistrates Court erred in law by failing to make further inquiries into how the £125 was calculated. Accordingly, J Andrews ruled that the costs claimed were unlawful. Just before Christmas a further judgment was released in the case of another Judicial Review on an identical basis but this involving Highbury Corner Magistrates Court and London Borough of Camden. a copy of the Judgment is below: http://www.bailii.org/ew/cases/EWHC/Admin/2015/3788.html
  14. I am a member of a local group here in Dorset, Pets Lost and Found. It is purely voluntary and now has 4032 members. They will post up quickly about stolen pets, lost pets, found pets, and organise searches for cats, dogs, birds that go missing. They go out and scan deceased animals, or take wildlife off to a vet etc. .They are very successful and have helped many people get back with lost pets, although there have been a few sad endings, of course. Its not a registered charity, but they did ask for donations for a petrol fund a while ago, which is very reasonable considering what they do. They also ask sometimes for help with admin, this is a kitty so that they can then help with advertising, tracker dogs etc. They sometimes pick up on other charities appeals, and point the members in the right direction if they wish to donate to those. They recently had the idea of asking for Xmas donations to give as many dogs (homeless or in rescues) a Xmas pressie. Someone pointed out that they couldn´t ask for donations, it was unlawful as they were not a registered charity. So to err on the side of caution, shoeboxes are being packed and handed over instead. Now, is this correct, that they cannot lawfully ask for donations? And could someone point me to a website or something where I can read up about this, as I´d like to help them out, but I don´´t know much about this. Many thanks for any replies.
  15. Hi, I wonder if someone could clarify the rules on the use of 0844 numbers for calling customer services? I thought the use of such numbers was outlawed in new rules that came about in June 2013 but I have been dealing with "Just Go Holidays" who tell me that the rules do not apply as tour operators are exempt. Just so I don't go making a fool of myself could someone briefly outline the facts? Many Thanks
  16. Hi Guys Can someone remind me the rules on charge back in relation to MAstercard and Capital One? Wont classify under Section 75 due to amount (£81) Arent you supposed to get a full and immediate refund while they do the investigation? I thought the FCA set out rules in relation to this?
  17. If I place a desposit with the dealership for a new caravan which is scheduled for delviery in March 2016 and then for whatever reason change my mind within the next month, am I entitled to a full refund regardless of why I cancelled?

  19. My neighbour and I are having problems with anti social behaviour from the school we live next to. We both appreciate that children will be naughty sometimes but due to the complete lack of supervision by the school during play periods they run riot. The main problem is stone throwing into our gardens which has already resulted in two broken windows but the school deny it has anything to do with them. My neighbour wants to install a CCTV camera at the bottom of his garden pointing directly at the play area but I am saying he cannot do this. Is he correct in thinking he can do this please?

  21. Hello I moved into a HMO approximately 6 weeks ago. I am a mature student and everybody else is a professional. It's a big place with about 10 people in total. I was speaking to one of my house mates (Josh) who told me that the landlord is crap and never carries out repairs. Josh has lived here for 6 years and he hates the landlord. He told me that he went 3 years without hot water, despite asking for it to be fixed - this was eventually resolved with help from the CAB. He also told me that although the boiler was recently checked, it hadn't been done for 3-4 years prior. Whenever the landlord moans at Josh for leaving his work tools in the house, Josh requests to see the boiler records for the past 3 years and the landlord immediately drops the issue. Is he supposed to have boiler records for three years? I don't understand. The house is a terraced one covering four floors with no natural light in the hallways. I have requested that they put in emergency lighting because I want to see where I'm going should there be an emergency. When I told Josh he laughed because he thinks that the landlord wont do it. How long should I wait before I follow up on this? Upon moving in, my room was dirty so I offered to paint it. I was given paint and brushes and I cracked on with it. I've done about a quarter of the room but because I have exams I have decided to put it on hold. If I moved out without finishing the painting would I be liable for anything? Further to the aforementioned, can anybody tell me what exactly my landlord is responsible for? I want to ensure that he is following protocol. Thanks.
  22. This thread is an informational post to see if people are aware of the new rules regarding Housing benefit Council Tax fraud. This only applies to those that have been CONVICTED of these benefit frauds at the moment. (This may change) "Higher rate deductions via Direct Earnings Attachment for Housing Benefit overpayments where there is convicted fraud – new legislation from 6 April 2015 New legislation will come into effect on 6 April 2015 which will increase the rate of deduction that can be made by a Direct Earnings Attachment (DEA) for debtors who have a debt for which they have been successfully prosecuted. This must only be used in cases where the claimant has been convicted of fraud for that particular overpayment. This cannot be used where the claimant has accepted an Administrative Penalty." For further information read the attachment or see here https://www.gov.uk/government/publications/hb-direct-april-2015-issue-158
  23. Hi All. I live in Wales and have been in a wheelchair for the past 6 years. I receive DLA (higher rates), ESA (support group), and housing benefit. I recently received a letter from the DWP demanding a refund for 'overpaid' ESA even though my cirumstances haven't changed and my only income is from my benefits. I have been trying to save somethig each month, and my combined ISA and current account have gone over the £6000 capital limit imposed by the DWP. I was under the impression that benefits received, particularly DLA, did not count as income for this purpose. Can anyone say where I went wrong?
  24. Hi I have had my halifax account for 13 years. Its a cash card account with no credit facilities available on this type of account. I did a direct debit charge back for £1167 which the bank refunded but then took back and sent to merchant which left my account -£1167 . I never noticed this and they closed my account and placed a default on my account . When checking default I found that they registered it at my old address and sent all letters to that address . I complained and they admitted the mistake and gave a £50 goodwill gesture and said they would remove default if I pay within 30days , I said that I would pay but would need 6 months which they refused and said 30days or default stays surely they must have broke some guidelines here
  25. I've been in PSL for too long and I've just been offered a house somewhere else, far away. They want me to take up residence and pay rent from Tuesday, even though I only got the offer yesterday. Is that above board? I'm bartering and stressing. I have rental obligations here and i can't just up sticks and move like that! I could give it my best shot, but let's be reasonable. Whateth say ye oh knowledgable ones. For I have an illness, one that afflicts my ability to deal with general lack of common decency among certain organisations.
