  1. Ive been away on holiday and came home to find a card posted from above company saying to get in touch to sort a repayment plan etc with the agents name and phone number. Its a debt form Capital one for £794 a nd having looked on my credit file i defaulted on this in 9/2/2008 is that when i made the last payment? Being in Scotland can i have the debt Statue Barred as its 5 years and i have never written to them to acknowledge the debt.
  2. Hello All, Would be grateful for the help with the following. I had an original debt of £15k with Lloyds in 2003 out of which I paid half but could not pay the other half. Robinson way eventually were the agency that has been chasing me. Last year they sent me a flurry of letters and I asked fro SAR. They eventually gave me a bundle of documents. Which has many online searches on my CRA file and also the copy of my current account with Lloyds but I think it did not have the copy of agreement of the unsecured loan. since then everything is quiet. I have not heard anything and this week I checked my credit file again there is no default loan mentioned. I owe to other credit cards as well. I am opening different threads. 3 to Lowell and 1 to DLC but none of them appear on my credit file bar a CCJ. I have opened another thread for CCJ as advised by DX. Now what should I be doing with this loan? 1) Leave it and wait for Robinson way to get in touch? 2) Since we communicated, can they still enforce it? Thanking you in Anticipation.

Hello , Does anyone have any experience of dealing with BARCLAYCARD (my account was originally egg) The have no signature/original terms - they sent me a copy of terms on barclay card headed paper but i opened the account with egg - it was transferred to barclays? It has £940 default balance last payment March 2012 now passed to Robinson Way collectors - Originally took out the card via online around 10 years ago. was paying it regular until March 2012 I have sent the prove it letter giving 12+ 2 days and they just gave me a black barclays terms I asked them to remove from credit report but they wont do it any help or advise would be much appreciated x
  4. Hi All I was retired due to ill health a few years ago and was unable to pay my two credit card balances. One of the card debts was passed to Robinson Way. At the time I had 4 children at home and was receiving Income Support plus Incapacity Benefit. A Pro-Rata instalment agreement was set up with both creditors to pay a fixed sum to both each month in order to pay off both creditors by the same date. . Two of the children have now left home so my income has effectively dropped by well over £100 per week despite subsequent annual benefit increases . Nevertheless, I've continued to pay Robinson Way as per the original agreement each month via a Bank Giro statement they send to me on the bottom of a letter. This month, they've increased the payment by a few pounds. I phoned them and they said the account had been under review last month and they had notified me by mail of the increase. I honestly did not receive their letter. I told the person on the phone that I considered this very unfair. I said I would pay the sum I had always paid as anything else was unaffordable. The person told me that if I did so, the account would fall into arrears and I would be breaching my contract with them leading to legal consequences. They want an Income and expenditure document within seven days or they will issue proceedings. I cannot do this as my dad died recently and I'm having to deal with his complicated affairs. I explained these personal difficulties with the person on the phone, but she was totally unsympathetic. In addition, the fact that a pro-rata agreement is in force with Robinson Way and another creditor, cut no ice with them - they tell me that I can increase my payments in their favour without any legal consequences. Can you provide me with some advice please? Right now, I'm dreading the arrival of next month's statement as I seem to have paid less than Robinson Way have demanded. I did submit a new Income and Expenditure document to them late last year, but they claim not to have received it. Thank you.
  5. Hi all, I'm new to this site, in fact it's the first time I've ever been on a forum...scary stuff lol!! I've read a number of threads and feel my story maybe corresponds with others on your forum, hence I thought I would join and hopefully gain the knowledge and strength to get this resolved quickly, and without repercussions! On Monday this week, out of the blue, 2 letters came through my letterbox in different envelopes: 1. Robinson Way Ltd's letter said 'we hereby give notice by an agreement dated 10th Nov 12 your account has been sold & assigned to Hoist Portfolio Holding 2 Ltd by Robinson Way. All future payments, correspondence to be made to Buchanan Clark & Wells who will be managaing the account on behalf of Hoist.' The letter is a bit confusing, the so called debt says 'ex freemans' for £198-43. I am assuming this may be the catalogue people, Freemans, but I am not sure. I cannot recall ever having opened an account with Freemans (I ran 2 other catalogues 15+ years ago but always made sure I paid it off in full). 2. Buchanan Clark & Wells letter said 'formal demand' confirming they've been instructed by Hoist Portfolio Holding 2 Ltd to recover an overdue balance £198-43 on their behalf. It says their client is unaware of any legitimate reason for non payment and would prefer an amicable settlement. BCW are prepared to help in clearing the deby by offering me an exceptional opporturnity to settle on highly favourable terms, they are willing to accept £99-22 in full and final settlement, which can be spread over 3 convenient monthly instalments. To take advantage I have to contact their office within 5 days. I was initially really really worried, having trawled the internet for over an hour, going round in circles, I found your forum and read some of the threads which seemed similar, although different creditor names were mentioned, not Freemans. I haven't phoned either company as I do not think there is a debt, and I think that if you ring them they feel you are susceptible to [problem]s and could then get inundated by more [problem]s. Do I ignore these letters or should I contact them? If so, what do I need to say, etc. Any help anyone could give would be greatly appreciated. Thank you for taking the time to read my thread x
  6. Hey everyone, I am new to the forums and although I had joined a few weeks ago I haven't been able to come online to air my problem(s). I will cut to the chase and give only the details rather than a fluffy story so here goes. I have in the past received letters from the Halifax but after becoming almost homeless I ended up in emergency accommodation for the university I attended. For a short time I dropped off the radar and didn't hear anything (nor did I think anything of them...out of sight out of mind etc.) Since then I have moved a few times and after a fall out with my parents (who I am now fully estranged from) my father gave them my address after a letter had come to their house. Anyway I was unable to pay anything as I was studying and looking after my young son so I then had westcott debt services onto me last year. I paid them some money but again fell into hardship and they chased me for a while. Then all of a sudden it was a new company after me...Comquest agency. They fell by the wayside after a month or two and then I never heard anything of it. That was a couple of months ago and then a couple of weeks ago I had a letter from Robinson Way stating that I now owe them money. I responded via email to state I had received the letter and I would only contact them via email or letter. Since then I had and still am unable to pay them anything (I've a lot of other things to worry about as well as them). So they sent another letter and I had not responded as I haven't had the time to. Then 10 days ago I was sent a letter from Drydens Fairfax Solicitors (I will attach image to this post). Basically they state I have ten days (those ten days end today) to get in touch and pay in full or call and pay what I can etc. Thing is I have nothing to pay them as I'm currently unable to work due to personal reasons and the doctors will not allow me to go back yet. So I'm not sure what to do but I only have today to do it. The debt is 5yrs old from a student overdraft (long story short I had my son and spent most of the money on looking after him and rent). Dear all I have prima facie evidence of misconduct perpetuated by Robinson Way and Company Limited in relation to its sale of assets to Robinson Way Limited and its attempt to change their name on claims with Northampton County Court Bulk Centre. This has come about when DWF were legally required by a court order to disclose the court order showing that the substitution of claimants lawfully took place. What was disclosed was emails and a statement which show that they tried to change the name without following the correct process under the Civil Procedure Rules (The email clearly makes reference to wanting to save time and money). I am going to write to a number of authorities about this but was just wondering if there was anyone in particular I should send my letter to. Thanks

  10. Hello I was wondering if anyone can help, this is new to me so I'm sorry if I posted in wrong place. I received a letter the other day from a company I never heard of called Robinson way, saying I owe them £154.99, as I have never heard of them I goggled them & your site came up, so I thought I would ask for advice. I don't know if they are a fraud or not, but they say I owe this money, yet I have never heard of them or dealt with debt collection & don't know what to do. Two days after getting the first letter I received a second from Buchanan Clark & Wells, saying the money is owed to GT Universal, I do not ever remember having dealings with them, but maybe when I was younger I'm not sure, how do I find out if this is a real debt that I owe? I have lived in my current home 10 years & have never had a catalogue or debt whilst living here, no one has ever contacted me regarding any money owed, then this out of the blue. If I owe it I'll pay it, but how do I know it is genuine?   11. Hi all, I've been on this superb site for quite a long time as a viewer but now need a little help. I have had lots of contact from Robinson Way in the last few months demanding payment of over £7,000 for a debt that I owed to London and Scottish Finance for a Hire Purchase Agreement. I had a lot of correspondence from Robinson Way about two years ago. I asked for proof of debt and sent off template letters and I received some attempt at showing me the agreement, albeit not in the prescribed terms as it should have been. Then, Robinson Way seemingly forgot about the debt until a few months ago when they started getting in touch again. The letters are always in the same format, debt owed to London and Scottish, passed to Robinson Way and then passed again to Horwich Farrelly, their in-house legal team. A payment was last made to L & S in late 2007 and not a penny since. The letters warn me that I may be going to court soon if I don't pay up in full. Here's the interesting thing. This debt does not show in ANY form on ANY of my credit reports. Not Experian, Equifax and Call Credit. Furthermore I haven't responded to Robinson Way in any way recently...but how should I proceed going forward? Specifically: - The debt isn't statute barred as the last payment was late 2007. It will be statute barred later on this year. - Can Robinson Way / Horwich Farrelly add the agreement / defaults to my credit report after all this time? Or is it too late now? - How should I respond to RW after all this time, yet again?! Any advice most gratefully appreciated. Thanks SM
  12. Hi there. Back in 2011 I had a former student overdraft with Natwest totalling £1600, after a few financial difficulties I had breached my overdraft to the point that it was at £2100, having returned to University after working for a few years I did not have the money to settle the amount over and bring the overdraft in line till I got my next student loan, which was a few months away. Having looked into claiming back of bank charges I believed I may be able to claim them back under the hardship clause, as I was a student, unemployed and stuck in a vicious cycle of bank charges. I calculated my bank charges, which totaled close to £2000 over a period of about 5 years, compiled the relevant letter and sent the request off to Natwest. Rather than replying with a rejection of the claim or further discussion Natwest replied with a letter saying that as I am in financial difficulty to help me they will close the account and organise a repayment plan with me, I spoke to them to dispute this as there was no way I would be able to repay the OD anytime soon. Wrongly I buried my head in the sand and the OD has been passed from Natwest to numerous different debt collectors, who have in turn passed it on to other debt collectors. The debt is now owned by Robinson Way who are requesting £2,399.88. Either in full or by repayment plan, and threatening a home visit in 7 days. Could some body offer some advice, this account defaulted around September 2011.
  13. Hello Urgent assistance please. Robinson Way served a county court claim on me and my husband. We requested a copy of the agreement in March 2010. They responded: Further to your recent request for a copy statement / agreement for you account. We have contacted the original creditor and they have advised that all relevant information has previously been sent to you. and that the balance outstanding as stated above is correct. The account is now long overdue for payment a......... ...we sent out another letter based on a std one off this site (failure to comply) and got the following reply dated 18th April 2010: We refer to your recent request that we cease collection of this account as we are unable to provide the documentation that you have requested. The fact that we are unable to obtain this documentation does not mean the debt does not exist or that we are not entitled to pursue you for the sums outstanding. Your data will continue to be processed in line with the principles of the Data Protection Act 1998 and the account will continue to be reported to credit reference agencies, where appropriate. If you neglect to make payment to us, further action may be taken against you. We require your payment proposals within 14 days. ...we kept getting letters to pay and outstanding and offers etc., but today got the county court claim. How can they possibly claim against us Particulars state: The claimaint claims outstanding monies due and payable by the defendant under a credit agreement whereby the defendant agreed to repay with interest the value of the credit obtained. Please help as not sure what to do now. Thanks
  14. Basically a few weeks ago I received a letter to my home address which was addressed to my parents. At the time I didn't realise and opened the letter which was from Robinson Way. I realised my mistake once I opened the letter and returned to sender as not at this address (probably the biggest mistake) I contacted my parents and they told me to just ignore it. Since then the frequency of the letters is increasing and I've received a further 3 letters in as many weeks even though I keep returning them. How the hell they got my address Ive no idea but my parents are most certainly not living here! The only thing I can assume is because 5 years or so ago I was obviously listed on the electoral roll at my parents address, but now Im registered here, but what I fail to get is that my parents are registered at their own house 40 miles away. Ive let my parents know, they dont seem particularly concerned but its beginning to stress me out and Im concerned that Im going to end up with bailiffs turning up. The only way out of it that I can see is to give Robinson Way my parents address, which Id rather not obviously have to do. Does anyone have any advice on dealing with it so Im not being pursued for this.
  15. long story very short... ...Halifax cc taken out in april 2006. Can't now afford it. My credit file is shot so i'm not bothered re-defaults. I asked Robinson Way for a copy of the cca, they got a photocopy from lloyds, the prescribed terms are all there but it is unsigned in the box which requires the lender's signature and date. Can i contest this or should i just offer them a pound a month. The debt is £2500 and i'm currently self emploed, i earned £150 last month £300 this month. My house is charged upto the hilt, £55,000 to the bank £70,000 to a relative. It's worth £100,000. I have no assets. Any advice would be great. Cheers

  17. Please could you advise me and help me through this problem with Robinson Way Limited? I have just received a letter named and addressed to me, saying that they are chasing a debt owed to 'equidebt - ex nationwide. It is for quite a lot of money. The fact is I have never heard of this debt, nor have i ever taken out or bought anything from Nationwide or equidebt for this amount. No default even shows up on my credit report or history, as i have just bought a new house (we've only lived here 12 months) and my credit history was very good, throughout the house buying process, with no debtsoutstanding. They are threatening to advise their client to take me to court. I have never heard of any of these people. After looking at the support and advice of others in this group, I have sent the template letter to them, stating that i know nothing about the debt owed and to send me written evidence. Is that ok to start with or do i need to do anything else? Who are these people and who are equidebt? Will they be able to black list my property and involve my wife? Will this damage hers or my credit history, even though i have now sent them a letter disputing their claim? I would really appreciate any words of advice or wisdom. Thank you
  18. Hey hope you can help with my problem Originally about 6 years ago i defaulted on a loan from Yorkshire bank (£5k). Ended up having a ccj against me and so came up with a payment plan with the bank which was stuck to. About 5 years ago this debt was passed on to robinson way and i have continued payments ever since Recently however Robinson way have been trying/harrasing me into upping the repayments. This came to a point a few moths back when i asked them how much i owed. They came up with a number that i thought was completly wrong so i put in a dispute and asked for acutal written proof ie a copy of the original TSB loan agreement to how much i owed. After waiting a few months they are now saying they cant get a copy of the original loan agreement. So its now come to the point where they are basically saying i owe X amount on nothing more than there word. I get a statement with how much ive paid each month to them but in 5 years ive never once had any statement of how much i owe Not sure where to go here. I was happliy paying it off but their recent bullying and phone calls to get me to up my payments have led me to see if they can keep chasing this debt
  19. I wonder if someone can help. I keep getting Voice Messages and text messages from Robinson Way. I dont know who they are, and I havent received any letters from them, so I dont know what they want. When they do call, and I answer the phone, its just a message asking me to call them?? I was wondering if I should call them, or just ignore the phone calls. Look forward to some help.
  20. Help/advice required please. Some years ago, i had a credit card with Sainsburys which fell into arrears and a notice of default was served. I then received notification of the transfer to Robinson way who took an aggressive approach. In september 2007 I wrote, asking for a copy of the credit agreement, enclosing my £1.00 payment and 14 days later received a reply stating that this could not be traced and returning my £1.00 In 2008 I received a number of harrassing and threatening calls at my place of work which stopped when I referred the matter to trading standards. On the 1st of July 2012, I received a copy of a document which alleges to be my credit agreement (which i had been advised in 2007 could not be found) and one week later a summons, via the Northampton County Court, in respect of the alleged debt (now over £7k with interest and costs). How should i deal with this matter? Does the failure to provide a CCA within the required time make the debt unenforceable and what steps should i take re the summons? thank you for reading this, hopefully you can help. Regards

Hi There, I have about 4 debts with different DCA and I have been making an effort to write and offer them amounts that I can afford to pay as full and final settlement. the response I got "we refer to your offer to pay a sum in settlement of your liability for your account. we can confirm your offer is accepted provided you pay on time. wehave reduced the amount due to the sum you agreed to pay. Once this reduced amount has been paid, your credit file may be updated with the credit reference agencies as "partially settled". If you fail to honor this agreement the original amount will be become payable in full. Do you think I should accept this or if I push them I will be able to get it changed to settled and maybe get the default removed??? I feel a bit uneasy with these terms
  22. hi guys 1st time poster long time follower of the forums, herres my problem robinson way have been chasing me for a debt which they will not tell me about, it can only be one of 2 as ive sorted out my stupidly in youth debts 1. i had a car insurance poloicy 6 years ago, the bafoon on the phone insured the wrong car, took my reg but entered incorrect information about the engine size etc... it was a 1.8 renault laguna 1997 she put in a 2.0 td 01 laguna, anyhows, after speaking on the phone she told me i had to set up a new policy which would work out cheaper per month but id still be required to pay a £197 deposit, which i already did for the revious policy which was onviously null n void due to the mistakes on her part, i told her i already paid so just use that, she said no it was gone through no fault of hers and i had to pay again, obviously i politly told her to jump. I moved to a different company got a better deal and more professional service, but since then they have been trying to chase me for 197, their mistake, not mine recorded phone calls which have convieniently gone missing would have revealed i told her one thing she entered something else ive wrote phone years ago to sort it again to no avail so i ignored it, so here we are 6 years later robinson way have sent me 100's of letter of all kind of threats etc.. but today i got a letter from a doorstep collection agent working for them saying they have been trying to contact me. I live in northern ireland, and as ive always understood things bailifts debt collecters etc.. have no juristiction or rights to come to a persons property announced or unannounced unless invited, obviously they can issue letter and court proceeding if required how do i get this fella to go away or what are my rights here??? many thanks Malek
  23. Hi All, It's my first post here, and I apologise for jumping straight in with a question. I've searched the forum, but can't find any other experiences the same. I'll start from the beginning. Many moons ago I had a credit card with Capital One. Unfortunately, I was young and stupid and couldn't afford to pay for it, along with a number of other debt. The capital one debt ended up going to court, and I now have a CCJ on my credit report. We borrowed some money from my mother in law about 5 years ago and cleared all our debts. I have heard nothing else from anyone, until recently when I started getting letters from Robinson Way regarding the Capital One debt. At first I ignored them, assuming that they had made a mistake, but they have continued and now I'm a bit worried. I called the court, who said on their system it shows as 'Case Discontinued or Written off'. She said that quite often this is entered in error when they should have said it was paid. The judgement was entered on 15/04/08 and the above message was sent on 27/08/08, just over 4 months later. The court lady said I should call the solicitors, ?? Farraly, who advised that there hasn't been a payment made and that the above message was sent due to them being unable to get a payment. I have looked over my old bank statements, but can't find evidence of the payment, although I'm not even sure we paid it because some of the debts were paid directly by my mother in law. I guess the bottom line is, I don't know where I stand. I haven't received anything from them for a number of years, as they had me marked as gone away, despite the fact that I have been living at the same address for nearly 10 years now.   24. Hi guys, Today I received a visit from a doorstep collector from Robinson Way. I didn't answer the door because I thought it ws somebody trying to sell me something! She dropped a card through the door asking to call to arrange a new appointment etc etc It is in relation to a debt of over £1000 that I ran up with O2. I can't be sure of the exact dates that I was a customer of O2, but I do know that it would've been late 2003/ early 2004. There is no record of this debt on my credit reports from Experian, Noddle, or annualcreditreport.co.uk. I have no idea what the date of default was, but the earliest correspondence that I had was from 18/05/07. So the million dollar question is, what do I do? I can reasonably assume that the account defaulted at the latest on 18/05/07, which means at most it will be statute barred in less than 7 months. Would this visit from them suggest that their 6 year limit is running out, or is it just a routine visit? Do Robinson Way\ Horwich Farrelly\ or 02 share information with credit reference agencies, or is there no record of it on my credit reports because it is alreadly likely to be statute barred? Thanks in advance for your advice folks.
  25. I have a loan which was originally through Cahoot, taken out in about 2003. This fell into arrears approximately 9 years ago and for one reason or another, I didn't repay this after getting into a complete financial mess. I am now being chased by Robinson Way for the total amount of £7k. However, I've checked my credit files and there is absolutely nothing showing on here. The last letter I had from Robinson Way was in May 2012. I have never written to Robinson Way regarding this debt and I am certain I didn't make any payments to the original company during the last six years. Does this mean the debt might now be statute barred and how would I find this out? If it is Statute barred, how does this affect my credit rating which I am trying to rebuild?
