  1. Can I claim bank charges back from these dates 2003-2011 The account is still open but i havnt used since 2011 as the bank charges were causing me problems with a loan. I would go over drawn by £1 they charge me £20-£30 (cant remember eact amount,) I asked them to cancel overdraft but they talk me into getting personal reserve which made things worse as if not paid back in few days they added more i was always going overdrawn as a result I changed to natwest basic account with no overdraft and have manage my finances alot better as a result
  2. Hi there, I have been considering writing to Lloyds to try to reclaim bank charges dating back 6 years on a current account i have now closed with them. I have researched alot on the forums and of course since the 2009 ruling, gernerally payouts are only to someone in hardship. I have been through all bank accounts statments and highlighted, totalled the charges and now had=ve to draft up a letter stating my hardship and reasons why i think i shoud be reimbursed. With regard to hardship, i have not been made redundant, been terminally ill or anything like that but felt the charges upon charges put my in a very difficult position and am going to write on that basis. Does anyone have any advice for me?
  3. Hi there, I'm trying to reclaim PPI from Barclaycard and have received a letter from them stating that I applied for my card by post and was therefore not mis-sold. I actually applied for the card when I was 18, as it was my first credit card I applied in a local Barclays branch and the application was completed by a member of staff and all I had to do was sign the form! I have requested a SAR and received a blank copy of my original application form with no signature on??? Please could I have some advice as to what I should do next? should I send another letter and if so what should I say? Any help would be much appreciated
  4. I have been in contact with GE Money . They have sent me a pile of statements for the last 6 yrs since the loan began ( i only asked them to send the charges since that date but got all the payments ,etc) .. Can i still reclaim charges for failed direct debits etc .. the "person" from gemoney on the phone is trying to fob me off with you can only get failed direct debits charges back with good reason ie lost job ..Im not going to listen to that as i don't believe he is being totally honest.. Can you good people at CAG tell me wha to look out for on these statements and can i reclaim the charges for unfair not reflecting the true cost of the charge or somethng like that ... he wants me to underline the "charges i think are unfair" .. on the statements i have solicitor interim legal fees, admin fees, dd recall charges,additional interest fees ,interest-due date change ,debt counselling inv, all charged on my gemoney loan all running into thousands ..... is there anyone on here that can help me decide what to reclaim if its possible .... thanks hopefully in advance

My partner took out a loan with HSBC details as follows: HSBC Loan: Taken out October 07: Loan £12400 PPI £2400 over 37 months settled in Oct 10 but claimed whilst unemployed £1100 When he took it out he was told it would enhance his application if PPI was included or words to that effect although when he was made redunadant he could have paid the monthly payment with his redundancy pay a nd it would also have been covered by sick pay if necessary but because he had the PPi he claimed against it for the 3/4 month period he was unemployed. Can we put a claim in? we have all the origional documents? Thank you in advance for any help
  6. My wife has got involved with a reclaim company called ****** They keep sending her stuff and I'm unsure what she has and hasn't returned to them. They keep sending letters containing a form that is titled "Letter of Authority" she swears blind she's not signed one and only gave them the vaguest details about any loans she had in the past and it appears she really can't remember them!! Yesterday she received a letter directly from CO-OP regarding 2 loans one of which they were prepared to settle and the other not, she can't remember either! Not really sure what the reasoning behind the yes to one and no to the other is but there is an explanation of sorts. The only paperwork in with this letter pertaining to these loans was a photocopy of agreement for the loan they won't payout on. The details of the loan they will settle on are as follows:- First payment date 11/8/04 Settlement date 6/10/05 Refund of PPI payments £14.96 x 14 = £209.44 PPI included in settlement figure @ 6/10/05 = £151.50 Interest @ 8% simple on the above = £239.51 Total Refund Due £600.45 I know it's pretty limited info but would that be considered a fair offer? I'm also unsure where she stands regarding the ******* as this offer didn't come via them but straight to her from the CO-OP? Many thanks for any input
  7. I've been asked, but don't know- any advice gratefully received as usual. A feller bought it in the early days of the Business, so for the last 10 (? -not sure as to exact dates, can confirm) years his widow has been receiving his pension; she has now informed the MoD that she is about to begin co-habiting (having been single until then) so no longer can claim it, all honest and above board it seemed to me. The MoD have now requested she REPAY the last x-amount of years worth of pension they have paid her. Are they for real?! I assume- and hope- they can't do that? TYVMIA

  9. Hello. I've started on a PPI campaign but have absolutely no records of account numbers so I'm just sending SARs to the credit card companies I remember dealing with. Problem is, some of these companies seem to have had their credit card arm bought out by other companies since my accounts were closed so who do I contact? For example I had an Associates card & a Providian card. Now I don't know what happened to Associates but I do know that Barclaycard bought Providian (after Providian became Monument) but that was after my account was terminated so Barclayclard won't have any record of me, right?

Hello there, I have deep concern in regards to the DWP and what they're claiming I owe them from my late fathers estate, he unfortunately passed away 2 years ago of Motor Neurone Disease and left my mother with a few outstanding debts. We sold a property prior to his death and the money was transferred to me in advance due to the fact his ability to eat, drink, think and communicate deteriated rapidly and it came to a point he could barely type on an ipad to speak so therefore did the best he could in offering me the money they had prior to his death. Upon his death, I used the money to pay off existing debts outstanding upto about £35,000.00, once the debts were paid I then invested their money into a property which I and my sister now pay the rest of the mortgage on to give my mother a roof over her head and the final yet small amount of funds available went to the solicitor for doing absolutely nothing yet charging for it. The DWP although two years since my dads death are saying there was a period he was overpaid pension credit and we now owe them £5800(ish) pounds. I have no doubt that we owe them this money because although he was dying and was entitled to pension credit, there was a point we had enough money to not claim the maximum amount entitled however due to ill health my father didn't change that and I wasn't aware that this would be the outcome. My question is, is it possible to pay back half the outstanding balance and call it a day or will they basically demand the money in anyway shape or form, they've told me via telephone that I have a month, unless I can't pay up I have two years in which they want a lump sum (based on bank statements) The thing is I'm not executor, I'm just trying to stop my mum from suffering anymore.
  11. In 1993 I took out a mortgage. I was told that a condition of the mortgage was that I paid £14 per month PPI for accidents and unemployment. After about 15 months I changed building societies and I'm not sure if I paid for PPI to the new lender. (I just cannot find out) I have been reading the Limitation Act. am I right in thinking (a) that for mortgages and other secured debts the limitation period is 12 years and (b) the limitation period for reclaiming PPI is also 12 years. If I am right then this still leaves me outside the 12 years BUT is it true that the limitation period runs from the time when a person could reasonably have known they could have a claim. In my case this was the case where Lloyds realised in 2011 that they would lose any court actions over PPI. Am I right in thinking this. If I am could 2011 therefore be the start of the 12 year limitation period. Generally the Limitation Act 1980 seems fairly straightforward but there are parts that I find difficult to understand. Can anyone please help me out; it seems to me that the limitation period of 6 years for say unsecured debt applies IF your lender doesn't contact you about the debt, and you don't acknowledge the debt in writing, and -you don't make any payments towards it... My questions; 1, Must ALL three conditions exist or just one 2, What is meant by the term "Acknowledge" 3, Does the six year period start from the time a creditor is informed that no more payments will be made and none are made 4, Does the six year period restart anytime within the six years if the creditor just tells the debtor that they owe money 5, Does #4 apply if the debtor refuses to answer correspondence
  12. as the title suggests - requested i smart to work on our behalf with future mortgages, futures mortgages rejected the claim stating it need to be made through the broker, loans.co.uk. I smart then scribbled out future mortgages on the documents and wrote loans.co.uk on them in order to make a claim to them for the ppi. Meanwhile they contacted us to say that they couldn't move forward with the claim without further reference numbers which i didn't have but if i found the reference number then to just contact them and they would reopen my claim. I have since contacted loans.co.uk myself and asked for the ppi claim to be settled to me and they have made me an offer - ismart are claiming their 30% as per contracted. Surely the paperwork they have, and the fact they altered it, and then backed out of the contract means they have no legal right to ask for this money? Help
  13. Hi, I need some advice please. Last January 2012 I paid for a course for my daugher to do semi permanent make up, the course cost £4000 and was paid for on my credit card in two installments of £2000, this had to bee paid before she attended the course. At the time she mentioned that she was not happy with the proffesionalism of the instructor, however she completed the course and after some time eventually received the machine that was included in the cost of the course. She has in the last week discovered that the company that she did it with did not have the credentials that they claimed to have had and that in turn has resulted in her qualification being invalid. The company has now gone into liquidation and therefore she has no chance of obtaining any refund. I wondere if it is possible for me to get the money refunded from my cedit card company?   14. Hello I have seen loads on ppi but cannot find an answer to my dilemma . I have been lucky enough to be offered a compensation for a 7 year endowment mortgage which was mis sold alongside an misold assurance policy. They have made an offer of £5k and have mentioned some vague workings out against their comparisons for what they say I would have paid in a repayment mortage and insurance policy that would put me in the same situation. They suggested the fos would help me to see if there offer was reasonable or not but the fos service says they cannot do this unless they look at all the facts. The rbs offer says deal off if I go forward with the fos in terms of a claim. The trouble is their letter and workings out is very vague and does not say what comparative source they were comparing with my policy so I have no way of knowing whether this is a fair reflection of compensation or not. I don't know if its common place for them all to worked out a certain way from a source so that I can check what is being offered is fair or otherwise. I am new to this issue so would it be wrong of me to ask them for how they arrived at their figures of suggested compensation or should I just trust it will be right and go ahead. I have already discovered they did not include my costs for a new mortage I was forced to take out upon realising it was badly performing . Any sources of help to check out or advice if its fair to ask for how they worked it out would be great as I'm lost. Thanks again
  15. I am new to this and wondered if anyone has successfully claimed back charges from Acenden recently? I have written to them asking for a refund using the template letter on here giving them 14 days to re-pay me or I will sue them and yesterday had a letter basically saying sorry that I had a complaint and that the complaints team had requested my file and would be carrying out an investigation !! They go on to say that they will aim to provide me with a full response within 4 weeks of their letter. Any advice please??
  16. Evening all, My elderly father has reclaimed ppi on a credit card a few months back, through one of those companies that take a hefty cut from it. They have approached him today and asked does he want them to claim back the ppi on his bank loans, to which i told him to say no, i'd help him do it, so he'd keep all of the money he gets back. So, after looking at a few posts on here, im stuck already. Where do i start? This bank loan is 5 years old and he has just made his last payment on it, and the one before he took out about 7 years ago, and after 2 years the bank offered him a larger loan, and they would pay off the first one, if this makes sense. he had ppi on both. Do i need to get him to send a SAR if he can't find his copy of the contracts before we do anything else? Many thanks, Danielle.x

Hi, A CCJ was issued against me which has been satisified entirely, I know a portion of the monies were made of penalties for letters, phone calls etc I am wondering if it is possible to recalim those costs even though the CCJ has been satisified? The loan was orignally with Welcome then ownership passed to MKDP who were awarded the defaut jugdment. thanks

  19. Hi, I am asking about a friend's credit card account, but haven't seen the actual letters received. She told me a claims management company had tried to deal with their PPI reclaim, but the credit card company said that as the debt went to bailiffs, the PPI can't be refunded. I am sure this is not true. Does anyone know for certain? What PPI letter can they send so they don't have to go through claims management companies? Thanks for any help.
  20. In 2008 My son tried to get PPI fees back from First Plus as he was sure that the Insurance had been mis-sold to him. He sent off an SAR and after delays was sent "screen dumps" and a tape that appeared to be edited.(clicks etc). His claim was refused and in an attempt to force First Plus to take him seriously he suspended his payments to them. Ultimately they used Evershed solicitors (based in their Head Office) to take him to Court to obtain a Repossession Order. I had obtained advice from members of CAG at the time and made him aware of their advice on this matter. Following a hearing in Court the end result was that the judge ordered him to pay off the arrears and to continue to pay off the loan/PPI. No judgement was recorded in the Court ( I have checked recently) but he decided to obey the judges' instructions to avoid losing his home. I paid off approx. £8k of arrears and started to pay his monthly instalments from May 2009 but was forced to stop payments in March 2012. Subsequently, First Plus have not contacted him until January 2013 when an unsolicited letter came asking him to submit a claim if he felt that PPI had been sold to him incorrectly. I intend to assist him to put a claim in but feel I need to request assistance from CAG members so that we do not do anything that might allow First Plus to wriggle out of repaying him. First Plus also registered a "Default" on my sons' Equifax file in 2008 when he suspended payments but have not bothered to record the fact that the Default/ Arrears have been paid nor is their any record of the payments to them from May 2009 to March 2012. Thus the last entry on his credit file looks to be that he had defaulted on his loan and that the £35k I have paid on his behalf goes totally unrecorded. Is this legal or just another example of the "dirty tricks" practiced by First Plus? Any help or comments would be appreciated. Taiko

  22. Hi All, I was just wondering what peoples general views were in relation to reclaiming credit card penalty charges. I have in the past summer 2011 successfully reclaimed charges from Barclaycard on two account which was offset against the card balance almost wiping it out. I have been reading recently though some options regarding the ability to claim back charges older than six years. Is a claim for charges earlier than 2006 & greater than £12 still likely to be successful or have people experienced banks successfully using the limitation act claim to end such a claim. Similarly would a claim for charges from 2006 involve the claimant proving they are unfair or the financial institution disproving the claim to prove that they are fair? since the OFT didn't say that £12 was a point that they were fair just a point that they would not take action against the banks. If you have previously written to reclaim charges but have still been in dispute would the six year limit start from when a complaint was first Lodged for instance a claim in say 2008 would still allow charges to be claimed back to 2002 even now? and how likely is a claim for the refund of charges applied to an account that was in dispute due to admitted miss sold PPI, the account had a balance of £700 & the PPI was eventually settled for substantially more than this meaning that the account balance consisted solely of the PPI charges & interest along with the late payment charges applied upon them. I was just interest & would be grateful to read peoples general views on the subject of charges reclaim success.
  23. Help the CAG!! Download our toolbar Cagger since Jun 2006 I am looking for help with a claim against Mortgages plc, regarding the unfair charges applied to the mortgage account when in arrears. The original claim started back when claims for unfair charges with the banks were being to court. I followed this route and it ended beiing stayed in the courts for 2 years. It has taken a while to get it lifted, It was only when I was aware that the FSA were taking action against the mortgages lenders for unfair treatment. I made changes to the POC from a template from this site, I have filed a allocation questionaire recently, The claim is for less then £2000, but the defendants solicitors want the claim struck out and have also requested a fast track proceedure. The claim was presented back during the bank charges period and ended up being stayed, whcih lift some 12 months ago. Recived an order from the court, with a date for a case management conference 21st Feb 2013 I have to provide information 2 clear days before the hearing. (a) a case summary with suggested directions which the other part shall attempt to agree (b) a statement of the issues agreed by all parties © a written estimate of the costs incurred to date with an estimate of the total costs if the action proceeds to trial. (e) if either party intends to apply for directions, which is not agreed, written submissions shall be filed and served by both parties not less than two clear days befort the hearing (f) The District judge is prepared to consider and, if appropriate to aprrove, agreed direction in advance of the hearing, but the case management conference shall not be cancelled unless such approval has been notified to the parties beforehand. Mortgages Plc also claim that the account was with their sister company mortgages 2, but all the correspondence, and mortgage payment were made to them.
  24. Hi everyone, I need some help with a current PPI claim I have through Natwest credit cards. In February 2013 I decided to check on a credit card ( which had defaulted payments) to see if I had ppi. I am currently making monthly payments to an external company who have acquired the debt, and pay based on personal circumstance. Today I have recieved a letter from the financial ombusment, who have made me a offer with no exact figures of how much ppi I paid as the bank is not admiting liability. This letter also states thy f I have any outstanding debts with the company I will not recieve my claim as it will pay off the outstanding debts. So a few questions; Is there a way around this? I.e should I go to an external company? As I did have the ppi and I wouldn't have gone I to areas if I had of known it was on the card because I could have used it. Should I accept this offer, with no details of how much I paid? Can I make sure the pay me and not Natwest. Thanks X
  25. Hello When I took out my first mortgage in 1997 I was told I had to have payment protection insurance and now believe this was mis-sold. The company who told me I had to have the insurance was Berry Birch & Noble who have since gone into administration but the policy was with Legal & General. I have tried writing to Legal & General twice about this and have tried calling them but can never get through to anyone who will discuss this with me and I've not received a response to my letters. Do you have any advice as to who to contact at Legal & General or am I best going to the Financial Ombudsman as I believe they have a fund set aside for people who were mis-sold PPI through a company that has since gone into administration? Any assistance you are able to give would be appreciated. Thank you Maria
