  1. I naively filled out some PPI claim online Pemberton Associates ages ago, gave all info I had to hand. “Electronically” signed all documents. Was sent something in the post which was lengthy, eventually completed & returned. Cut a long story short but I started getting A LOT of emails from this company. Regarding all sorts of things, claims against pay day loans, claims against all sorts of things, there was that much I lost track. I was only ever really interested in PPI and I assumed everything I filled in was to do with PPI. I got a final response saying once they’ve checked my credit history there’s only two companies I could claim against - one being a mail order company (which I owe a mere £80 and the other being my current account, which at the time was overdrawn) I replied saying I didn’t really see the point in perusing a claim against these for the reasons above. To which they agreed. I then started getting emails regarding some payday loan I took out a while back, asking me to send them a copy of some letter. I had no idea what they were talking about and told them this, on top of the fact my balance was zero I didn’t understand why they were looking into it. Fast forward a few weeks and they’re now saying I’ve breached the contract and that i’m Liable for cancellation fee’s if £360 for each company they originally persued (sure there’s about 12 all together) The guy who was emailing me was horrible, very threatening, making out like I was lying, saying they’ve now realised I’ve breached the contract for a second time as I’d not returned documents (this isn’t the case - I’ve returned everything I’ve received) I was getting no where with him, ended up leaving a lengthy yet honest review on trust pilot to which he replied saying if I didn’t remove it they’d sue me for damages. Cut a long story short he reckons he’s issuing court proceedings first thing tomorrow. He’s literally not left me alone all night, threatening all sorts, telling me I am liable for court costs on top of the damages and fee’s already mentioned. Apologies for any spelling errors, currently in the middle of something & frantically trying to explain myself on my phone! Any advice greatly appreciated!
  2. Hi All I have instigated a PPI claim to Lloyd's bank regarding credit card PPI. I have sent paperwork including a copy of my CCA where the PPI box is ticked. They now wish to speak to me on the phone as they need further information Is this a wise move to answer them and can I shoot myself in the foot by answering questions incorrectly. Many Thanks
  3. Hi Everyone, Happy New Year to all I know this is probably a really stupid question so please don't shout at me (I'm not well at the moment) ... I am wanting to get my PPI reclaims underway and I wondered if making a claim would resurrect any old debts? If that even makes sense? Is it better to do myself or through the "Resolver" reclaiming tool from the Money Saving Expert website - it's free but there's no mention of doing as SAR? Thanks in advance
  4. Hi I'm a newbie here and could do with some advice regarding my Mother in Law. She showed me some old solicitors paperwork yesterday from when she took a mortgage advance cheque back in 1995 for £33,000. On the breakdown, there is a payment to Chartered Trust for £8057.00. She thinks it was PPI. Anyone know if this is worth pursuing and if so where to start? Thanks
  5. Well, here we go again! After successfully reclaiming ALL my mis-sold PPI's, taking 8+ years, or so I thought, another one has surfaced. This time, it's an odd one. Out of the blue, I received an 'Annual Review of your optional PPI'. Addressed to me, with an insufficient address, which the post office delivered. There was a ref. no. so I contacted the sender. They had no record of it! But someone must be paying a DD of £49.66/pm. Certainly not me. We knew it related to a mortgage we used to have but paid off about 5 years ago. My husband checked his bank statements and....yes.....he's paying £49.66/pm. He queried it after paying off the mortgage then (and reducing all unnecessary payments) but his bank told him it was a Buildings Insurance and that it could be used for any property he lived in!!! (He never told me that one!!). Of course, he stupidly believed them and left it thinking he had to have it. How low can these banks sink??? Obviously, we will reclaim, but it has to be through my husband which does make it a bit more complicated. My thoughts are, that not only did they take out a policy on ME (I would have refused point blank to pay it), but I'm guessing the salesman then pressured my husband to pay it on my behalf. Don't get me wrong, my husband is far from stupid (!) but he runs his own business and these 'trivial' matters get dealt with then forgotten! Me? I know every penny I pay out!! The next 'odd' thing is they have my personal details, mainly correct, except it says current employment status: employed 16+ hrs/wk. Wrong! I have been self-employed for 35+ years! That, in itself, means I was mis-sold since I could never claim. Sure, it says, if self-employed, that the business must 'fail' or 'voluntarily cease trading'. I've argued that one every time, since the business is 'me'.....what am I supposed to do??!! I have a feeling we could tackle them from various angles but would love to hear from anyone else who might have been in a similar situation? I think this is a mis-selling mis-selling!!...and they have walked right into a trap. I'm hoping my husband can find the relevant paperwork, otherwise we'll have to request it.
  6. Can anyone provide a copy of the software or is someone willing to perform the calculation and provide the output ?
  7. around 1999 we bought a car on finance from Yes Car Credit, I think it was a 3 year plan but after approx one year I became ill and lost my job, we could not keep up the payments so they came and collected the car eventually. ironically, the PPI we paid was supposed to cover illness, yet we were told not so, so we basically told them to pick the car up. my questions are: as we paid some PPI, can we claim it back? I cannot remember which bank we were with, does that matter? are Gladstone Brooks any good?
  8. I had a credit card in 2002 to 2003 with The Associates and they were later taken over by Citibank but during the Assoicates time, 2002 I had PPI on the card. Can anyone tell me please where I would send my claim for a refund on ppi. I was self employed in 2002 and was mis sold the ppi. With the letter for a refund do I have to send a copy of the financial ombudsmen questionnaire? Also can I send the form to the financial-ombudsmen on line? Appreciate any help you can give me.
  9. In about 2003 I bought a digital camera from a high street electrical shop on hire purchase. The finance was provided by a company called Halifax Cetelem. I think they are gone now but that their affairs are looked after by Barclays Partner Finance. I wrote to Barclays Partner Finance about PPI on this old HP loan but they have written back saying they can't local an account in my name. I am not sure where to go with this now. Did any other company's take over old Halifax Cetelem accounts? I did read online that some people have been successful in claiming from barclays partner finance but they seemed to have old copies of their loan agreement which I unfortunately don't have. Anything I can do?
  10. I had a loan account with Northern Rock which I defaulted on and they subsequently sold it on to Cabot. The account has been staute barred for about 15 years. I recently made a tentative equiry regarding PPI, via a claims company, as I heard that it shouldn't affect the statute barred status. I have been advised that Northern Rock have accepted the claim and a refund of approx £1100 is due and will pay it directly to myself. They also say that they will advise Cabot to update their account details too. To receive the refund I have to sign an acceptance form which says that this ends any PPI liability etc. However there is also a condition that states that I accept that the cash loan is still in force. My question is this: Even though NR sold the debt to Cabot will my acceptance of this condition for NR constitute activity that will affect the statute barred status, thus "starting the clock again" and therefore give Cabot licence to start demanding payments from me. And also as the PPI is seperated from the original loan, which now doesnt belong to NR, are they entitled to make this a condition of acceptance. My limited understanding was that as the debt was sold on, then my PPI claim was the only issue. I'd appreciate any advice as I could really use the refund.
  11. I had a Next Directory account opened in 1991 in which was paid off in full in 2004 and closed. On checking my old statements it has come to my notice that their are various monthly PPI amounts deducted (£1,244 in total) in which I cannot locate any agreement to or ever signing anything. I sent the standard template letter with payment requesting Credit Agreement details etc. I received a response from Next advising that when the account was opened a pack was sent to me explaining that PPI was automatically added and would appear on the 2nd statement. I was also invited to write to Next to advise if it was not necessary and how it could be cancelled. Therefore it was not their responsibilty for suitability of said policy as they were not regulated at the time. They also go onto say in the case of Next Directory consent is not given in the credit agreement but is contained within the T & C's which appear in the Directory and on the website and cannot confirm how the account was opened due to length of time ? Next say that they do not need my consent to share information with such agencies as this would be addressed by agreeing to T & C's when placing orders. Finally they are unable to provide a copy of a signed agreement and that by law they do not have to anyway but have sent a blank copy of Credit Agreement and final statement of account details. I have today received a further letter from Next advising that I contact the policy administrator First Assist re PPI complaint, who I called and they advised that it is Next's responsibilty for mis-selling ( as it was sold by Next) and not theirs ? Now my questions are obviously what do I do next ? Do I pursue First Assist / underwriters if regulated ? If underwriters how can I find who they are ? Also do I still submit a SAR to Next or am I wasting good money ? Any advice would be very much appreciated.
  12. After lots of reading and research, I'm going to attempt to claim the PPI for a loan that I took out with The Associates, before they became a part of CitiFinancial Europe.A I was a student at the time with, two young children aged under 3 at the time. It was the first time I'd borrowed money and I took the loan out to help pay for their nursery fees after a mess-up with my Student finance. So glad those days are behind me now! They have recently paid out PPI for a credit card that I had with them. They stated that they couldn't find any details of the loan but would look at it again, if I sent them documentation relating to my account. I did - I found my credit agreement, a statement of account that showed all the payments that I had made on the account (bar the final one). I also found various letters that showed the Associates account number and the account number when Citi took over. I even have a letter informing me of the "exciting change" of their name change from Associates Capital Corporation to CitiFinancial Europe PLC, on 11 April 2003 Despite all this irrefutable evidence, they will not investigate my complaint any further as they cannot locate my account on their system. As the loan was taken out in 2000, it is out of scope for the FOS. Therefore my intention is to issue a claim through the small claims court. I'm going to need some help with calculations. This is because I have read about 4 different ways of calculating the redress and it's doing my head in! My figures are as follows Loan amount = £1050 Insurance = £400.17 Arrangement fee = 75.00 Interest rate was 3.020% APR 48.8% Any suggestions and/or help with calculations will be appreciated. I've had a stab at it and will post up what I've done shortly. Thanks in advance CAG family!
  13. Hi there. My husband is trying to claim ppi from Littlewoods/shop direct. He has received a letter from then saying he did have ppi with cover plus. Start date was in 1994. It was fully paid. The thing is, they have enclosed a claim form from the FOS. Why would they do this? Many thanks
  14. Hi, need some advice if possible its for a friend of mine, she filled in a form for a credit card back in 2001 filled the form in and post it back to the abbey national and in the form she ticked the yes box for the personal protection cover, she filled the form in the branch, now she tried to claim misold ppi but they have refused her twice as they claim by ticking the ppi box she understood it was optional and it was her decision to purches the ppi,, they also claim they sent out policy documents which confirmed the ppi sale and even if this had not happened they still think you would have found benefits from the policy. can anybody give any advice on how to dispute this please, look forward to any advice thank you.
  15. Hello I had a large number of improperly executed credit card agreements which I had been paying for 20 years. After advice from CAG I decided not to make the remaining payments and they are all now statute barred. Due to the length of the time I had the cards their will have been PPI payments made but... 1) Some credit cards were paid in full before I got into financial difficulty many years ago which I don't have records for. 2) Some accepted full and final settlement payments to clear the account, 3) Some accepted a final payment and marked as partially satisfied 4) Some would not negotiate and I had no money left so they were not paid anything Which of the above can I reclaim PPI for Thanks
  16. Hi everyone, I'm new one here and sorry for my mistakes, english isn't my first language ))) The question is about PPI claim. I moved to UK in 2010 and opened my bank account in Lloyds bank. Because of I didn't speak in English very well the lady in bank sold me Silver account and I didn't know I can have a free one. I knew only this year (2018) in April and I did complain through Resolver and than escalated to Ombudsman. Today I received the answer with refuse. They write it's too late because of it's more than 6 years from opening account date and I should receive the letter with AES (annual eligibility statement) in 2014. How do you think can I fight for my PPI money back or not? thanks
  17. I had a secured First National Bank loan in the late nineties which I believe had PPI. At the time FNB was owned by Abbey National/ Santander. I submitted a PPI enquiry to Santander but they only came back with details of my old bank account with them. I believe that FNB were purchased by GE Money at some point. Should I be making my enquiries with them?
  18. Greetings, this is my first post and Im hoping that I may find some help Im divorced from my wife and a while back she randomly rang me to ask if I had received a cheque? I managed to find out that she had employed the use of the claimsguys company and they found a PPI on a joint loan we had years ago, her cheque was for just shy of £20k, she had rung them and they confirmed that this was her 50% and not the entire settlement I rang barclays bank that the loan was with and they went through it with me, explaining that yes indeed the had applied and then been awarded 50% of the total claim, there was a 22K policy applied, and the total sum awarded was £39673.80 the problem Im now running into with them is that they keep telling me different things, 1 call resulted in me being told that they simply had to issue a cheque for my half and to wait for it, then another call I was told that the case was closed latest news is that her claim was upheld and she awarded 50% of the settlement, but I wouldnt be receiving my half?? what do I do to fight this?? its a serious amount of money, more than I earn in a year and as a now single parent it would change my life many thanks edit to add her claims company have rerally tried to get her to tell me to contact them, but I found out that she lost over £7000 in fees OUCH.. if I can sort this without them, I would be far happier
  19. Submitted claim for mis sold PPI on Debenhams store card in Feb 2016. The card was sold to me whilst being served in Debenhams clearance dept in 2000. Queue of people waiting : assistant "crossed" the parts of the form including payment protection. Santander dismissed my claim : not mis sold : Couldn't refer to FOS as pre- regulation. However Santander then wrote back after the Plevin ruling. Possible unfair relationship because of the commission. They rang me last week for further info ie employment, savings etc at the time I took the card out (18 years ago!!). They say I will have a final response by 5th July 2018. Not holding my breath, but let's see. Am I correct in my understanding that if they refuse my claim I can then contact Genworth Insurance and if they also refuse I can then refer Genworth to FOS?? Many thanks as always
  20. Since Mrs Sev was diagnosed with Lewy Bodies Disease, I managed to get all her debt written off by the various DCA's that had been hounding her since her fortunes turned for the worse. It was a long fight and in the end we got there, thanks to this forum it's community and the infinite patience of the likes of dx100uk. I am in the process of going through old paperwork with a view on trying to recover as much as I can for her to help contribute towards her ongoing care. I have found old paperwork for the following: Barclaycard Visa and Mastercard Co-OP Visa Capital One Visa Monsoon / GE Capital Russell & Bromley / GE capital Harvey Nichols / GE capital Frasercard / GE MBNA Mastercard & Visa RBS Visa Mint Mastercard. Natwest Mastercard. The paperwork consists of: some old statements but also some of them have the original fold that the card was delivered in, and some the actual PPI letter. The original signed CCA is not in any of the documents. So, my initial question is this - Should I begin by sending an SAR to each of the creditors or will the proof that I have already be enough? We probably have statements going back as well, but these might not be for the full term going back to when the card was taken out. I may well send SAR to Barclaycard as I am sure that she took out a Barclayloan or two in the past. I'll be honest, the ones I hope most to get something from are GE and MBNA for their relentless harassment in the past. thanks in advance Sev.
  21. I am looking for some advice with respect to a PPI refund and compensation in connection with a former Endeaour loan. I had a compensation refund in 2015 which was based on premiums I had paid from 2002 - 2013. But I did not know if it had been calculated properly because although I had requested that the PPI be cancelled in 2013 all my loan account statements from Endeavour/HSBC and subsequently Sancopia Portfolio showed premium payments . I then spent 3 years trying to find out how HSBC reached their compensation figure and which premium payments were used for the calculation. Finally after escalating it to an FCA case I was sent the HSBC spreadsheet for the calculation which did not include any premiums from 2013 - 2015. HSBC say that the premiums from 2013 - 2015 were reversed and they have sent the FCA a screenshot form their internal systems which show that the premiums were reversed and refunded. FCA say they are satisfied that 8 of the 15 payments have been reversed. What I would advice on is whether this is correct if they are still showing on the loan account statement i.e if there is no corresponding reduction of the loan account to reflect these reversals. As a result of this long running issue, I have the internal HSBC PPI compensation spreadsheet with all formulas. I am more than happy it with the CAG if it can help others succeed with their claims. Advice would be much appreciated.
  22. Hi all As I prepare to challenge failed FOS claims I thought I would ask if anyone has done this successfully and can share their experiences and statement of truth. FOS determined that they could not handle an Amex complaint because PPI started before the regulations started, because I ticked the PPI box with Cap1 then I needed PPI, and finally currently that a PPI form Egg (Canada Square) sent them contining neither yes or no I want PPI meant that I wanted it... Finally I would like to claim for the time I have spent putting together my claim... would this be acceptable to the court??? ANY help advice would be gratefully received, thanks
  23. Hi I recently had a successful PPI claim with MBNA. I have received a 50% payout but as it was a joint loan, 50% is owed to my late wife. Initially, MBNA refused to pay me her share until I provided a Grant of Probate or Letters of Administration. After explaining I have neither, they eventually said they will accept documents from a Court or a Solicitor confirming that no Will, Letter of Administration or Grant of Probate was ever made. My wife had next to nothing in assets when she died so, as I understand it from the gov.uk website, I didn’t need to apply for Probate as, in the circumstances, I inherited everything. I can’t understand why MBNA will not just accept our marriage certificate and my wife’s death certificate as sufficient evidence and pay out. That was all the evidence I needed to provide at the time of my wife’s death when dealing with her bank accounts. (They were different banks, not MBNA). The amount owed is only around £400 so the cost of applying for Probate or Letters of Administration would make it all pointless. I assume the cost of obtaining documents from a solicitor confirming no Will, Letter of Administration or Grant of Probate was ever made would also be prohibitive. I was wondering is there any way I could fight this and get MBNA to pay out with just the marriage and death certificates as evidence. Any help or advice would be really appreciated. Maybe someone else has had a similar experience?
  24. I made a PPI claim online for an old Littlewoods account. I have a few questions. The account was opened in 2010 and sold to a DCA in about 2012/13. I paid very little directly to Littlewoods and very little again to the DCA. On and off etc. I'm not even totally sure I had PPI and the claim was made more in hope than expectation, but does it matter how old the account is and whether or not it remains unpaid? How long should I expect to wait until I hear something? I didn't even get an email receipt of the claim when I made it about a week ago. If anyone has made a claim like this recently would love to hear your experience
  25. Hi I have made a claim against DFS for PPI, in the midst of being unwell and major works taking place at my home, I had misplaced the reply until today whilst clearing up from the building works. I realise that I don't have much time to challenge this response as it was sent in May. Is this worth challenging? Thanks! DFS letter.pdf
