  1. Hello, At the end of September 2013 I sold a ford Ka and mailed the V5 to the dvla. I then left the UK in February 2014 upon finally unpacking the last boxes I have noticed that I did not receive a conformation letter from the dvla yet I have for the car I had up to leaving the UK. Is there anything I should do? should I contact the dvla asking? I do not think I have anything with the registration number on either. Thanks.
  2. Ive recently asked my bank to provide me with the Credit Agreement relating to a loan from a while ago. The document I received back had my signature on it but instead of an authorising signature from the bank it had the name of the branch handwritten instead (in upper case). Is this still considered to be a valid signature?
  3. Hi. Have just been given a weekend paid for caravan at a Parkdean site by a friend who can no longer go. I called Parkdean to advise that my friend is no longer going, but she has given it to me. I was informed that there was a £20 admin fee for changing the name. Whilst i'm grateful that my friend has given me a free weekend away, i can't help but think that they're taking the mick charging £20 for changing the details. I sent a message via Twitter, and have had their twitter team call me and reconfirm that there will be a £20 charge which will not be waived. I've asked what it was for, they said it was to cover the manpower it takes to swap details and reprint the documents. I asked what documents, i thought it was all done electronically, which she said yes it is, no printing is involved, but still confirmed the £20 stands. I would have accepted a £5 fee as would probably take maximum 15 mins to swap details, and that is based at the ridiculously paid rate of £20/hour for data entry. Can anyone tell me if i should just accept it, or if i have any grounds to stand up to this charge?

  5. Hello Everyone, My friend has her first work programme appointment on the 24th June 2013 and was unable to attend due to being very anxious, being sick and had panic attacks! I rang Ingeus and spoke to her Employment Advisor, he was busy when I rang so I left a message that is was important he call back because it was to do with my friend's appointment and that she was unable to attend that day! He did call back and I duly answered the phone call, I told him why my friend was unable to attend and if she can have another appointment date and that I will come with her, I've explained about her anxiety and panic attacks and also told him her advisor at the Job Centre knows of her circumstances as I've had to cancel an appointment she had with her job centre advisor before, I requested that my friend will need a private room as she will not cope being in a room full of people! All what we asked was granted and I also told Ingeus advisor to send me a letter to confirm my telephone conversation with him! Today a letter arrived there was no mention of speaking to me nor mentioned about requesting for a private room all the letter says! 'We have attempted to contact you by telephone but was unable to reach you. We have therefore arranged an appointment for you on such a date etc, etc. I couldn't believe what I was reading' Good job I wrote a letter confirming my telephone conversation with him on the 24th June and mentioned everything we spoke about, I've kept a copy of course and sent the letter to him! I need to write a letter to him about the letter I've received today not mentioning anything of our telephone conversations, my brain has gone pickled at the moment and I want to be careful how I write the letter! He has lied and also not stating the fact of out conversations has anyone come across this sort of problem with Ingeus it will be good to know about them a bit! Thanks helen

  9. Hi all, Wondering if anyone can offer advice on an open small claims I have currently against a sole trader. The defendant has not filed a defence on a small claims issued against them even though it has nearly been 14 days. It has surprised me as they were so adamant they were right during our dispute. It has led me to think that perhaps I have not filled out the claim form correctly with the trading name possibly being incorrect. From their website they have a few different names listed, one for correspondence and one for their retail shop. There is also a third name which just appears on a few of their web pages. The dispute is over an order made over the phone using their website as reference. Their correspondence name had headed Great Asian Gifts and Souvenirs followed by a residential address, presumably their home address. Their shop is called Great Asian Memories followed by their shop address. The third reads Great Asian Memories and Gifts. (The actual names are rather more distinctive but similar to this). I put Mrs Ann Smith trading as Great Asian Gifts and Souvenirs, however I possibly should of put trading as the retail shop name as that is who the order was placed with. I did make a note of the retail shop name in the POC if that makes any difference. The pre action protocol letter was sent to the correspondence name and residential address which they acknowledged as receiving so I would be surprised if they could say they never received it. However could the claim be struck out since the trading name I put may not be the correct one (it may not even exist) even though the named individual is correct as is their home address? An annoying technicality if so but my fault which is fair enough. Do you think it is likely they're just going to leave it till the last minute in the process, whenever that may be, to mention this? Since the claim is fairly small, would it be best to just start over again if this happens? Grateful for any advice.
  10. Hi All, I recently discussed the purchase of a new car with a dealer and test drove on Sat 25th. On Sun 26th I obtained the best quote from the dealer via telephone and gave £200 to put my name against a vehicle and was told finance docs and quote confirmation be emailed to me that evening. I will note at this point that I was not told that my deposit is/is not refundable and was not given any t&c's or information in regard to my cancellation rights. An email came through that day only containing a scan of some number plate choices and a £200 til receipt (non-itemised). I emailed the dealer a few times in the week requesting the finance documents and on Thurs 30th I received a copy of the forms. At this point my circumstances had changed due to an offer of new employment and I was in a position where I may no longer require the vehicle. I advised another salesman at the dealer of this on Sun 2nd, having arranged an interview for Mon 3rd. I emailed the salesman and discussed on the telephone with him on the 3rd that I may no longer require the vehicle and requested that he put a hold on everything, only to find that he has already taxed and financed the vehicle in my name. I will make it clear again that I have not yet signed any documents to confirm the purchase or the finance. I now no longer require the vehicle having been offered another job closer to home. From what I can read on CAB & Which websites distance selling should apply and by not advising me of the 'cooling off' period, my right to cancel and registering a car in my name without consent that they have committed an offence. Of course I don't want to go at them quoting things like that but I would like to know where I stand in regard to getting my deposit back and what the heck I should do to get the car de-registered and un-financed in my name. Any help would be appreciated! Thanks!
  11. Evening all, A lady has explained to me that her estranged husband had broadband from AOL in his name, but hasn't bothered to pay the bill... AOL have now cut off the broadband, she lives in a rural area and has asked BT for broadband but they have refused, is it possible that there is some kind of adverse marker on the line?? many thanks in advance
  12. I've been receiving letters from Lowell Portfolio, all addressed to my married name, for about three years. They relate to a credit card that I stopped paying in February 2009 when I moved and couldn't get the address changed because I couldn't provide ID in that name (I reverted to my maiden name in about 2002 after I separated from my husband but couldn't get the name changed on this account). They claim to have taken over the account and, although I didn't receive any letter to this effect from the credit card company or a default notice, these would probably have been sent to my previous address anyway. I ignored the letters but they keep coming. Every time I move house they stop for a while and then start up again. My concern now is that the last letter I had is over a month ago which is an unusually long time (although I have continued to receive their recorded phone calls every couple of weeks). The letter stated that they were considering applying for a CCJ and I am worried that they will go ahead with it. Are they likely to do that? Can they apply for a CCJ for a person that no longer exists or would they have to contact me under my current name first? They have presumably been tracing me under my current name as I haven't had any accounts in my married name since that one. There are no accounts in my married name registered at any of the addresses they have contacted me at. Should I challenge the debt and thereby acknowledge being the same person or continue to ignore it? I really don't know what to do for the best. Thanks.
  13. Hi new to the forum just looking for advice Having checked my experian report i have a default from HOIST PORTFOLIO HOLDING 2 LIMITED in 2011. I have never dealt with this company. i have since settled this debt in february 2013 to a company called Buchanan clark and wells who outline in the letter they are acting on behalf of JD williams. So how did the above company manage to be the ones who defaulted me? Also the payment history has just changed to one red circle with all previous history erased. Any light on the situation would be helpful Thank you
  14. hi am new here and like some advice please right on the 5,3,2014 i sold a item on ebay for £800 pack it ship it off they payed in full and for logistics to pick up they said they received the item on the 7,3,2014 i the got a email saying We received the floor scrubber this morning. Our qualified electrical engineer has assembled it as per the instruction manual.(didn't send one with it) The machine is badly smoking and has an electrical fault. Please could you explain what is happening as in the description on Ebay is states the machine is in working order. a)sorry to hear this, the karcher was in full working order when i sent it out as i tested it i would not sell if it wasn't in full working order. The machine was recently serviced so could you please send me a report from the engineer so we can resolve this. what type of floor was the was the machine being used on? after a couple of email back and forth i get email say this note the Engineer came out on the 10/3/2014 three days after the bayer told us that there qualified electrical engineer has assembled it The brushes are not rotating and there is an electrical fault with the motor. Please find attached the report from the Service Engineer from Hines Services who we had to call out today to get a full report from. I would like a full refund on this plus the cost of carriage and the call out charge for the engineer today (£60) so to cut a long story short she open a case on ebay ebay the goes i favor of bayer but ebay ask for tracker the bayer does not give one so the ebay goes in my favor i win the case and don't have to refund the bayer..... the next thing is that my step daughters boyfriend who lives with use gets a county court letter address to him from the bay making a claim against him for selling this item on ebay he has never had a ebay account when it was me what can i do about it kind regards lee
  15. Gareth Pierce-Jones changed his name and has resorted to court action after he was linked to a serial debt defaulter with the same first name, surname and identical date of birth. His case highlights the intractable difficulties people face trying to rectify errors on their credit files, which are checked by lenders every time a customer applies for credit cards, mortgages or mobile phone contracts. Mr Pierce-Jones, 35, has been repeatedly hounded for another person’s debts since 2010. He changed his surname from Jones to Pierce-Jones in August 2012 to try to solve the problem, but the other individual’s debts remained recorded on his credit file. The debts were listed automatically on his credit file, and Mr Pierce-Jones had to contact the agencies and the debt collectors each time to request that they were taken down. Mr Pierce-Jones has been turned down repeatedly for credit cards as a result of these issues. “It has completely crushed my credit score,” he said. “I am due to renew my mortgage this summer and I want to make sure this is completely cleared up.” One particular debt collection agency, Motormile, began sending letters in 2012 claiming that Mr Pierce-Jones had defaulted on more than £1,000 of payday loans. Despite acknowledging Mr Pierce-Jones was a victim of mistaken identity, the letters continued to be sent to his home in Bracknell, Berkshire.   16. Hi Guys. Hope you can help. On 22/02/2014 I parked in the entrance to a private car park whilst i went inside the building to get the key to open the gate. By the time i came out i had received a parking ticket. The ticket reads: 27 Parked in a special enforcement area adjacent to a dropped footway. Location: New Southgate. At the time i had parked in the entrance of the car park, my car was parked at an angle so not to obstruct the road, and enough room was left around the Vehicle for pedestrians to cross safely away from the road it self. (Between the car and the gate). Also my Hazard lights where on and i was away from my vehicle for approximately 5 mins or less. When looking at google maps the road shows as Goit Side. Although the ticket location stated New Southgate. What can i argue on this ticket? Thanks. in advance
  17. Hello, I sent SAR request to Lloyds giving them all detail that I think they would need and I notified them in SAR request about recent name change, attaching copy of my deed poll. They wrote back to me saying that I need to send them an original of my deed poll (I changed name back in January) and returned all documents I sent to them with my SAR request, yet they haven't returned the cheque. What do I do now? I don't feel like sending them originals and from all the info I already provided they should comply with the request.
  18. Hello there, First of all, I'm a 27 year old man, I got my self into debt a long time ago which screwed up my credit report completely. Fortunately for me, the debts were removed and my credit report cleaned up a little, but still couldn't get credit from anywhere. I then did something stupid and started taking out loans & contracts with the permission of my family using their name but due to losing my job, I cannot now afford to pay these bills and neither can my family. They are now being hounded by debt collectors agencies and it's causing me sleepless nights and my family won't even talk to me. What can I do to stop this nightmare? I owe around £2000~ in total, but none of that being in my name and I have around £40 spare every month. I know what I did was completely stupid. p.s. I was made redundant and I'm looking for a job, but I have no money income at ALL. Thanks for any help..
  19. Hi all, I'll keep it short. I have a DCA chasing me for a debt from just less than 6 years ago. I received the papers from Northampton and sent in a defence and it looks like it's going to court. I would be mortified if my friends and family found out i was having to deal with issues this way - will my name appear in local newspapers/on the internet? I receive the local paper and quite often they list the criminal cases and outcomes at the magistrates court but never seemingly the debt related stuff.. .can anyone tell me if this sort of information is available/easy for people to find? Also the original creditor and dca have been sending correspondence to the wrong address. I have correspondence from them back in the day proving they did have the right address however everything they have sent me has gone astray. The only reason i know about the court case is that it was re-directed whereas most innocuous looking stuff is returned to sender/binned etc. If i haven't been receiving their correspondence due to an incorrect address and it is their error does it matter that they show that they sent it, i.e. is it a defence?
  20. Hello, I have recently changed my name via Deed Poll. I want to tackle my debts atm. I notified my bank so they will most likely amend my data with all the CRA. Do I need to notify any of my creditors/dcas? And how to be sending CCA/SAR requests as from now? Just print my new name or add in the text previous name?
  21. How do I take over a debt for my mother with Barclay card. I called them to put the balance in my name so her name will be clear, but they said they can't do it. Is there something like restitution agreement I could use in this instance that would allow me to have it in my name since she's not able to pay it and not really responsible for this debt?
  22. Hi I was on a short while ago about a PCN picked up in Whitby and 'enforced' by CEL. The last letter said it was being passed from DR+ back to CEL with advice to commence court proceedings. Just had letter today on CEL headed saying part of debt has been assigned to Debt Enforcement and Action Limited in Baker Street, London (£113.75). CEL "will no longer be involved in this part of the debt and payments must be made to DEAL" (?) "The balance of £16.25 has been retained by CEL as part of ongoing agreement relating to monies that may fall due to The Co-operative and we reserve our rights accordingly." Is this legal speak or complete crap? Do I need to be bothered? I am thinking not, but wanted to check with those who know more. Thanks in advance for your advice.
  23. Hi I hope I have posted this in the correct forum. I found out at the beginning of this year that a close family member had taken out a credit card and catalogues in my name and defaulted. I believe the credit card has been settled (their word only) and payments are being made on the other debts. The problem is myself and fiancé have been saving hard for a house deposit and will now be refused a mortgage! is there anything I can do to get these defaults removed without getting family member in to trouble? any help greatly appreciated!

They have changed their registered name that Cash4Phones were trading under C4P Trading Limited to Yemonia LIMITED and moved from EC2 to W2 (although their C4P Trading Limited site shows this as the registered company name and not Yemoniaicon LIMITED as showing on webcheck on the companies house site http://www.cash4phones.co.uk/corporate/contact-us.aspx). I have been waiting since 11th of October to be paid £132.40 and they are now ignoring my emails and no one picks up their phone. Had started small claims court:mad2: Proceeding but cannot enforce judgement as don't know where they are now and I also don't want to waste any more money unless I have too. have put in a complaint to Watchdog about their new [problem] about not paying, Watchdog had ran the original 'excessive wear and tear' [problem] which I found yesterday http://www.bbc.co.uk/programmes/b006.../cash-4-phones. I have also contacted ActionFraud and put in a case so have a crime reference number, I do hope that this action, if enough people do this, results in the owners being arrested and their business being closed down. As for re-claiming any money am not confidant any longer and has already cost me another £25 to put a claim in the small claims court, am told will cost even more if judgement has been approved and then I try to enforce...
  25. I've done something pretty stupid. I claimed benefits (housing + CT) to which it would appear I wasn't entitled. The overpayment exceeds the threshold for prosecution in court, and I have been told that in all likelihood it will go to court. I've already had one Interview Under Caution and I'm due a second this week. I'm trying to limit the damage in the future to my good name, which won't be so good when this becomes public. I was thinking of changing my name so that if this does come to court I will be prosecuted in my new name. Is this a good idea? Has anyone else done this successfully? Or when you say your name in court do you have to say your former name as well, even though to all intents and purposes that name has been given up as a result of the deed poll? Or is likely that my local authority will make my 'old' name public anyway? I'm ready to face any punishment given to me. I feel so awful and stupid. One small ommission on the original claim has ballooned into something and I'm scared of the consequences. Unfortunately I'm not prepared for the public shame and humiliation of a court appearance and subsequent reporting in the press. Thanks in advance for your thoughts/experiences.
