  1. Bit fed up now: Been involved with social services on and off since I was 18 due to registering as partially sighted. Never really got help from them. In December, I had a meeting with my then social worker and a friend. (the friend was there to help me - I can't always explain myself) I was then passed on to someone else and this is where the problems began. She thought it was ok to take me to noisy places, despite having hypersensitive hearing. (Hyperacusis) She can't understand that I need at least 24 hours notice. Or that I can't deal with strange people. I asked her to come to a meeting with me at college. This ended with her and "disability support" both suggesting that my psychiatrist is a liar and that I don't have Autism; but have anxiety instead and that counselling would solve this issue. No-one has ever diagnosed or even suggested I have anxiety. She then took me somewhere, which I wasn't happy with; as it was with a large group of strange people. I was then given a lecture on how I have to get a job. Bear in mind that DWP / ATOS have declared me unfit for work and have placed me in the support group. The letter from DWP says I don't have to look for work. She then told me I have to meet someone and without my permission, passed my mobile number on. I was then contacted and asked about an appointment I suggested a date and wasn't given a response. I was then sent a text message 25 minutes before this appointment asking me if we're still meeting today. There were 2 weeks between the message I sent and the appointment. Call me unreasonable; but is it too much to ask for someone to confirm an appointment and give me more than 25 minutes notice? Around this time, I started getting ill and was having a load of personal issues. (I was being harassed) I had to keep putting appointments off and was sent an email. This email basically told me if you don't meet me on Wednesday, I am not working with you. Am I not allowed a life? I'd made plans with friends to do stuff. My social worker then left. After this, I sent an email to social services explaining what happened and received a phone call where I was asked to identify my care needs. Something I am not able to do. I also have a few complex medical conditions. She informed me that she's my new social worker. I received an email yesterday regarding a meeting next Monday. Except, I can't make it. I have no way of getting there and don't know the area at all. The response to me saying that was, being told the name of the road. That still means nothing to me. I have a vague idea where it is; but it's about 7 miles away with no direct bus route. The closest bus that would take me there, involves a 30 minute walk to a strange place. I am getting fed up now. I am constantly being put with people who don't understand my needs and think doing things to me that hurt is ok. I have explained time and time again that noise hurts and that I can't deal with strange people. But no-one's listening to me.
  2. Hi I have been asked by a neighbour ( has no internet ) for advise re a fixed penalty notice that they got today. It is dated 25/5/2018 and the offence was 13/5/2018! They were caught doing 57 in a 50 stretch on the M1 , They wanted to know why it has taken over a year for this to arrive! The said neighbour drives for a living and was in their works van. I am going ask for more information as know they only recently got the van they are using TIA Sandy
  3. hi to all im a new user on here and need some advice please! here is a brief description on the matter back in 2013 i signed up with talk talk for phone bb and tv services, after approx 3/4 weeks of no services i rang them up and told them i would like to cancel the contract as they had not provided me what im paying for. after numerous phone calls about the above issues talk talk said the contract would be cancelled and that would be the end of the matter there would be no charges due to early termination of contract etc. although i never received anything in writing from them i left it as the matter was delt with. fast forward to two days ago and i got a claim form from Moriarty law working on behalf of jc international acquisition. they are claiming £572 for non payment of agreement from talk talk I'm confused about this as i was under the impression it had been sorted years back!. i have sent a reply to the court with a acknowledgement of service i can get some information about this as i intend to fully dispute this. how do i get information about this old account ? any letters that was sent to me , phone calls ?? how do i file a defence for the court I'm confused by all the info on this if anybody could help id be so grateful many thanks for your help
  4. hi guys, so i have the name, mobile number, email address and bank details of the professional that i hired, unfortunately they never gave me an invoice and i never gained their address. The job they did was below standard and they even damaged our property for me to be able to take action against them i need their address, so since i know you need to obtain a court order for the bank to release the address, what form do i need for this to happen.

  6. Hi all, Around 18 months ago I brought a used car from 'Bristol Street Motors' on finance. The car is a 62 plate Peugeot 208 currently at 43k miles and is currently financed for a total of 4 years. A few weeks ago I noticed a blowing noise coming from the car - so took it to a local garage to have it checked out they pointed out that the catalytic converter had split and after looking up the part it was around £800+ fitting. After doing a bit of research and found that most sites saying the earliest one of these should need replacing at is 10 years / 50,000 miles. I rang Peugeot customer care and got told to take it to a main dealer garage and get them to inspect the car and tell them exactly what is wrong obviously they agreed with the local dealer about the catalytic converter needing replacing and quoted a similar price of £920~ all in to get the part replaced. T hey rang Peugeot customer care back and they offered a measly 25% 'good will' gesture towards getting the car fixed. Only having the car 18 months I feel pretty annoyed that I'm facing a £700+ bill to get a car fixed that I've done pretty much only 8,000 miles in since purchase. Just wondering if anyone had any advice on how to proceed, many thanks in advance.

  8. My partner has a problem with a tenant. The tenant was taken to Court because of non payment of rent for many months and left just before the bailiffs were due. As the tenant owes something like £6550 in rent plus Court fees and legal fees it would seem equitable that their deposit is used to offset their debt. However the TDS service doesn't seem to look at things this way. I understand that the deposit was originally paid in by the tenant but they surely have foregone any claim to it now since the debt is so large and the £2000 deposit would go some way to reduce the debt. My partner is not chasing for the balance but would be enormously p***ed off should the deposit be repaid to the tenant. The TDS appear to be Judge and jury stating that their decision is final and non contestable. No decision has been made by them so far but reading what other landlords have said, it is by no means certain that the deposit will be used to offset the debt. Can anyone offer any advice as to the best way to deal with the TDS please.
  9. Hi, My good friend has been on sickness benefit for a long time at one point she was on dla too. It may have change and she may just be on a pension now, I do not know but will find out. she was taken very ill and is in hospital. However they say they will release her soon. However there are some urgent functional problems in her home that have not been repaired that need repairing plus lesser urgent but equally important work needs doing maybe costing altogether £5,000 upwards. This is aside from cosmetic re decorating that seriously needs doing too. I recall a lady on the programme 'benefits street' got a benefit loan of a £1,000 which she pays back in small amounts, to redecorate her house from orange to purple. What benefits, emergency funding etc. is available? I can pitch in and help, but sadly I can not pay for the work to be done which I would prefer to just be rich so I could just have it all done in a few days for her! Thanks in advance, Clear33
  10. HI Everyone, Im hoping you can provide me with some good advice. My sisters best friend gets married today, My sister has spent £150 + on her bridesmaid dress, She now cannot attend today, She has recently become very poorly through mental health and deteriorated in the last three weeks. The crisis team have been involved and a consultant psychiatrist. She has been off from work as her job as a nurse since before christmas and from the 7th June will only receive £81 a week sick pay, ( her outgoings amount to £1200 a month) Her friend ( the bride) has suggested that she does not come to the wedding. i fear this may be through not wanting the hassle or embarrassment, My sister does not know this as she is very confused. The dress has been altered but only very slight adjustments, I.e one stitch in the bust panel and shortened on the straps just a few inches. I need to try and get a refund for this dress as she simply cannot afford to have a dress she has paid £150 that she hasnt worn and financially cannot afford, What grounds do i have if any to try and get a refund. Also this was paid with using a credit card Many thanks for your time
  11. Hi all Got an interesting question that I've not been able to find a definitive answer too. My dad is disabled and gets the full motability allowance, but is no longer allowed to drive. So for the past 3 years as I bought a car specifically large enough to take him and my mother (both are also elderly) out and about... We were able to nominate my car for use as a disabled vehicle. This means it's been transferred to disabled use and we are exempt from VED. But at some point in the next 12 months, I will need to change the car as it's getting on a bit and starting to cost more than it's worth in repairs. I paid £2100 for it and so far have spent £1800 in repairs and maintenance. Since the cat tax rules changed... when you buy a car it is the new owners responsibility to tax it. But I can't find out how that applies to vehicles that need to be re-registered as disabled use. because that involves going to a main DVLA licensing office (nearest one to me is about 25 miles away) to make the change and have the new VED applied. Given that I will need to bring any car I purchase home or direct to the DVLA offices... I won't be covered and I can't make the change to disabled use until I purchase the car. So it means being in limbo until such a time as it can be done... and depending on where the car is located could involve much more expense to me if I had to go there, buy the car, come home and go to the local licensing office and then make my way back to pick up the car. Not to mention changing over insurance and so forth. It's very unlikely I will be buying from a car dealer. I just need to know if I have any leeway in getting the car home after purchase and getting it reclassified as disabled.

Good afternoon, I'm after some work related advise; I work in a kitchen with four other people - 4 of us have "contracts" that are 5/7 & 1 is a weekend worker- Over the last three months 3 of us have changed our rota to meet the needs of the business - mixed shifts / later shifts & also 1 weekend in three - the fourth person that has a 5/7 contract has now point blank refused to do the same & apparently has said "she'll leave & she can't do weekends or late shifts" now we are at a stage were the three of us are really ****ed off due to this person, while we've bent over backwards to "meet the needs of the business" she is getting away with dictating what she will & won't work, so we are after some advise on how to handle this situation with our management, We are considering also putting in a grievance regarding this colleague due to the state she leaves the place in half of our paperwork is legal requirements which she is not filling in & also talking to us on several occasions in a not very nice manner, she doesn't clean down & does as little as possible When she started there, over a year ago I make several verbal complaints about her standards & also documented the state of the kitchen with pictures in an email - we have all recently taken photos again about the state of the kitchen so we have some "evidence" again after some advise on how to deal with the situation as a whole

Sorry I need to ask for advice but not sure where to ask or where to post, we hired a person who assured us he could do the job which was laying a large patio, he left it unfinished and in a very poor state, not flat or level, he admitted liability and admitted the job is awful and said we would only need to pay for materials and no labour which is fine, we don't want him back as its obvious he cant do the work at a satisfactory standard, we now have to find someone else to dig up the entire garden and start again, what can we do, we contacted citizien advice but wasn't very helpful as we are not trying to get any money refunded as we haven't paid for any labour only cost of materials, thankyou for any help x
  14. Hi everyone I would be really grateful if someone could give me some advice in order to help my niece whom I will call Susan for the purpose of this plea of help. Susan started work at a children's day nursery and completed her 3 month probation 1 month ago. The nursery works by ages in the rooms, Susan is with age group 3-4. Things were great when she first started, but her team leader moved back into her 'director' role into the office and was replaced by someone else, it quickly became apparent to everyone that the new lady was not up to the job (even being sent home when OFSTED inspected) and therefore immense pressure was put on Susan to act as team leader, over the weeks she became more and more stressed about how things were going, particularly as the current team leader handed her 2 weeks notice in and it didn't look as if she was going to be replaced. Susan has realised since being there that too much emphasis is put on finances and not enough about the children, there is a lot of health and safety issues understandable where children are concerned and I feel Susan was beginning to loose her confidence in her ability to care for the children following the rules and regulations to the letter.   15. Am 60 and on ESA. I sold my house for £51,000.I have moved in with my daughter and partner and paid them £45,000 to house me for the rest of my days.Because of my change of circumstances I am filling in ESA3 and a form for council tax help. We are seeing a solicitor to draw up our arrangement legally. But I don`t know what form this should take.I am in danger of being accused of gifting her the money. Do I go for a Declaration of Trust, a lease or tenancy agreement or what ? I have spoken to 2 solicitors on the phone,one who just told me to go elsewhere, and a Welfare rights solicitor who told me to deal with it at a tribunal.Surely there is some way I can satisfy Benefits. I want something to prove our arrangement for my own peace of mind too.
  16. Hi need a bit of help/advice please from Vodafone and I believe they have a rep on here. April last year my son got his first new full time job and treated himself to a new phone contract without telling us, well he is a young adult so he didnt think to tell us. hes been using the phone as they do and occasionally it would go off and he said oh I havn't paid the bill I will ring them which he did and it got put back on. Now its been off for a while and he owned up to a huge bill and he cant pay it, he says not his fault as CPW said he had unlimited data (this is the huge bill) I checked his contract and yep it did say unlimited but for 90 days only he assumed it was the contract even though it does state 2gb a month. He's an idiot TBH expects everything to be done for him and with vodafone switching his phone back on each month without paying the bill hasnt helped at all. I rang vodafone yesterday and they gave me a run down from Sept 2014 and it comes to £736.90, mostly if not all data. I have checked and on one day he used 847mb even though he was at home and we have wifi so I think something is not right. I use my phone for business and only use approx 400mb a month. He even thinks on that day his phone wasnt even on, it had been blocked by voda. and other days that show high data usage. I asked why he hadnt been checking his bills he said didnt get any, asked about online account and he said cant log in just goes to a help page each time. I tried and found wrong password in five minutes I had logged in to see all these bills from oct 2014. Its absolutely unbelievable that vodafone have been unblocking his phone each month by him just ringing up and promising payment and not paying it. Whilst in his account I notice on the summary it states £30 a month inc VAT but checking his bill he has been charged £30 plus vat. Now his phone is still off, its about to go to collections and he cant pay it. Yes I know he should he used it, it wasnt free but my worry here is not too long ago he took an OD due to money problems so im worried he might go down that route again. I have spoke to CS but to no avail thought I would see if anyone on here could help. He to has rang CS but gets no where so ends up frustrated and very moody. P.S. I got through to Vodafone CS and asked the exact date the phone was switched off and was told the 18th November and just looking at his bills the phone was still being used after that date again mainly data and have incurred charges. How can a phone incur charges and use texts, calls and data when its been fully barred from use and hasnt been used. I have uploaded a couple of screen grabs. This now makes me think all the data may not have been used by him at all and I can see its common.

So, I tore out my alarm system & de-registered from our local Neighbourhood Watch. I've planted a Pakistani flag in each corner of my front garden and a large Flag of ISIS in its centre. Now, the Yorkshire police, the National Security Bureau, Scotland Yard, MI-5, MI-6, the CIA and every other intelligence service in Europe are all watching my house 24x7x365. My children are followed to school every day, and my wife too, when she goes shopping. I'm followed to and from work every day. I've never felt safer
  18. Evening all, A lady has explained to me that her estranged husband had broadband from AOL in his name, but hasn't bothered to pay the bill... AOL have now cut off the broadband, she lives in a rural area and has asked BT for broadband but they have refused, is it possible that there is some kind of adverse marker on the line?? many thanks in advance
  19. Hello, after reading so many posts on the forum I decided to join and seek my own help and get advice so please take it easy on me as a logof the terms used I am still getting used to. My problem. I havehad a Halifax Credit Card (MasterCard) that I started on 27/5/2008 now likemany others I got carried away and over spent on a lot of things and even usedthe card at times to withdraw money from ATMs as I was short on cash and only hadpart time job and the Card was only way that I could pay bills and other dailystuff. Now as the months went by and I reached my limit of £2950 I found myselfunable to pay the month repayment fee and the card started to build up oncharges forcing to it to go overdrawn due to late payment fees and interestcharges. I did call Halifax and tell them of my financial difficulties andthere was no way I could make their minimum payments which at the time werealmost £500 per month, tbh they didn’t seem to care and just said that my accwould go into default if I did make payments. Then on the 23/11/2010 I was ableto get some money together and paid them £100 but at this stage I knew it wastoo late and my acc was heading for default as it was overdrawn by almost £300. The months went by and letters arrived asking for payment but only being parttime I just couldn’t afford it. Then on the 1/6/2011 I got a letter saying a defaulthad been registered on my credit file by Halifax for the Credit Card. Now fast forward till today and I have got a full time joband have decided that I would like to pay this debt off, I first contactedHalifax and asked them for all the statements of the card from day of openingtill day that it was registered as a default , I have received them all butHalifax told me that the acc had been passed on to Debt Collector called BlaireOliver and Scott, so i deciced to call them but they told the acc is now withCapt Quest, I now call CApt Quest to setup a repayment scheme, 6 days aftercalling Capt Quest I then get a letter from Moorcroft saying that the acc iswith them now and I need to call them or a local reprehensive will call to myhouse. I picked up the phone and called Halifax directly to ask why the acchad passed from agency to agency. I would also like to note that since joiningthe forum I have made a claim against Halifax for the PPI I was paying on theCredit Card so I am awaiting the outcome of that claim. that’s my details, my problem is, the Debt now sits at£3482.17. I need to get it paid off ASAP but need advice, as there is 3 debtcollecting companies involved. Also is there any way I could complain againstHalifax as some of the charges that were happening were almost £100 a monthalong with late fees. If there is any other info required please let me know andid be happy to help Thanks Gary
  20. hi all, I am the main claimant for benefits, and have been for some years. We have an 8 yr old. my problem is : I have mental health problems over the years resulting in a breakdown. I was told I was unfit for work at a medical assessment over a year ago. however, I am interviewed every six months to see how I am getting on and if and when I will be able to work. This frankly is making my situation worse as it just piles pressure onto me. my husband is capable of work and would quite happily do so.(he is not my paid carer) I am in no fit state most days to cope on my own and we both know this would not be practical. My question therefore is: If my husband becomes self employed (not sure as what yet) will we get help with rent and council tax, would we get any other help? This is the only way we can think of to ease my situation. many thanks
  21. I would appreciate help iro submitting my defence which is due on 05/07/2014. AOS was submitted on 19/06/2014. I have attached relevant docs. The Credit Agreement was provided following a CCA request to Marlin. As it was too difficult to read they then provided the letter of 23/01/14 with a typed out version of the declaration. I believe that I had a default notice from Northern Rock in 2009 and have received the statutory notices each year. The loan was opened in 2001. The last full payment was made in October 2009 and token payments were made in Dec 2009 , Jan 2010 and Feb 2010. N Rock were aware of my financial difficulties at that time. I have not received an actual deed of assignment... just the attached letter and similar letter from N Rock.
  22. Hi everyone, Please could you help me on this matter. I have got an unsecured loan with a finance company, unfortunately due to a change in circumstances I wasnt able to pay the regular monthly payment. I verbally agreed with the finance company a reduced monthly payment which i paid for 18 months by standing order. Unfortunately I had to cancel the standing order at the beginning of the year but re-instated it last month. Early this year I received a letter from them explaining that my account has been transferred to another company within their group. For the past month i have been receiving calls everyday from the new company but I have not spoken to them. I have now received a letter from the new company: 1) Asking me to sign a letter of assignment. 2) They also said that they have instructed solicitors to commence litigation proceedings. I made a mistake today by answering the phone to them and when i told them that I had an arrangement in place with the original finance company and had been paying this for 18 months, their response was they have no record that the reduced payment was ever agreed and now want full repayment of the loan. Please could you help me on this...dont know what to do
  23. Hi all, A friends father is profoundly deaf, and he has just been diagnosed with prostate cancer. He cannot discuss anything over the phone, etc, so it would be easier for his daughter to be given access/permission to discuss any appointments, care etc for him on his behalf. he is happy to do this, as it is now looking like an care plan will need to be put together soon as it is untreatable, a nd without it, his daughter would struggle to discuss info with medical professionals. Is there anyone who knows anything about what this letter should say, we have been told that he just needs to write a letter giving permission, but it is how to word it? Kind regards Lisa x
  24. Hi, I'm posting this in the hope that someone can give me advice on how I can help my Dad. My Dad had a company that folded a few years ago that had secured business loans with Lloyds bank. He then had a triple heart bypass and during his recovery time the loan payments were paid by the insurance policy on the loan (it seems just the interest). Now he is working again (self-employed, he is 65) Lloyds want the debt cleared and are telling him they want to take his house. Earlier this year he came to an arrangement with them where he pays a certain amount per month. He made all the payments as arranged but they are now not accepting this arrangement any more and pushing him very hard. He has offered more per month but they say they want the debt cleared. They have now sent him out a form to fill in all his financial details but have already told him over the phone that they want to take his house. They have told him he only has 7 days to get all of this information back to them. My Dad is at his wits end and I'm worried about him. He's really stressed about loosing his house and can't think straight. I'm the only person he is talking to about this but I don't know what I can do to help. So I thought I'd post here in the hope that someone can give some advice on how I can help him and what his legal rights are. If anyone has any suggestions I would be very grateful. Thanks, David
