  1. Evening all, Decided that I would do my new update on my iPhone 5c last week and 2 days later the phone completely broke! Phone is 12 month old and was 9 days out of warrenty when it broke. Took it to Apple, not very helpful at all! Told me its a hardware fault and charged me £199 for a replacement. I really needed my phone so paid it! Was sat across from a lady who was in the same boat, did the update and was being charged £199 also. Can they really get away with this? My phone was working absolutely perfect until their bloody update! Not sure who to contact - is it worth it? Any advice would be appreciated. Thanks, Rachael

  3. Hi I purchased an iPhone 5 from three's clearance website. The phone started to drop calls randomly a few months in and would never achieve a good signal. I took it to apple who confirmed there was a hardware fault with the handset and called 3, they also confirm this. The handset is just past apples 1 year warranty but 6 months into 3's 12 month guarentee on the handset. When i called them i asked for the phone to be repaired or replaced, they inform me that the phone is no longer made by apple and that i would need to take it to apple to be fixed/replaced there at a cost of £220. I cannot afford this and asked them if they could exchange the phone for a newer model ( iPhone 5S ) or release me from the contract. After a lot of call backs from 3 they offer me the 5C as an exchange. I refused the offer saying that i would like to have my original one repaired as I dont want a plastic exterior and that asked to be released from the contract. Unsurprisingly they refused this. Im not trying to get a 5S because its the latest one, I simply want my phone fixed or a new one that is like for like as the iPhone 5 is no longer made. My question is: What can I do about this in regards to getting my iPhone repaired or 3 releasing me from the contract? Thanks

  5. I have got involved in a dispute between a prospective tenant (PT) and agent, and would appreciate impartial advice. Bear with me, later episodes get rather fruity. This is part 1! PT put down 2 months' rent and fees on a property on the basis that it would be available in 5 days time and on the basis that 6 months rent would be paid in advance. This offer was made to secure property as PT was worried about housing benefit requirements. Having put down the money, agent provided a sheet of A4 as the receipt which listed the fees and said they were non-refundable. Prior to that, no paperwork had been issued. On day 4, agent phoned PT demanding that advance payment of the rent be made forthwith otherwise agent was ready to cancel the deal. PT said he was waiting for a contract. On day 5 PT visited the flat and found workmen were still in it and it was not ready. Over the next week or so there was a ding-dong between PT saying he would not pay out further money without a contract, and agent saying that contract would not be produced till 5 days after money received. The property was visited on occasions and still the work was not completed. Agent did produce a sample contract which contained a number of "school-boy" errors, such as "with" being written instead of "without" so making one of the terms mean the opposite of what it was supposed to mean. Agent did not appreciate the errors being pointed out "I'm sorry I'm too busy to spend all this time on one tenancy". After PT had already put down money, I researched the agent. The agent is un-regulated. The agent is run by one woman. In the past 5 years she has run 4 separate businesses all with similar names. Three have been dissolved, and the current one is marked on Companies House as potentially to be dissolved due to lack of accounts filed. On the other hand, PT and I managed to speak to the agent's workmen who confirmed that agent was genuinely working for a landlord and had been for some time. So this suggested some level of legitimacy. First question: was PT right to demand a contract prior to paying even more rent?
  6. My laptop has broken and won't turn on. Now my son spilt some liquid on it yesterday, I was wonder how easy would it be for me to get it fixed by apple. I have applecare on it but have read that apple refuse to fix any laptops that have been damaged by liquid. Will the sales of goods act help me or am I already fighting a losing battle?
  7. Bought an iPhone 5s in November from Apple - it developed a fault problem. Took it back to store - they confirmed it was a fault - but only offered to replace it with a refurbished phone. Said no - cause i did not want to end up after two months with second hand phone (with new T&Cs). Also does not feel fair or legal !! What should i do ? Any ideas Thanks Ed

  9. i have sent various complaints to T-Mobile and Apple about the rubbish handset IPhone 4s really is, first thing is my signal is terrible and my touchscreen doesn't work when i lay my phone down flat, it freezes during calls and when using apps, plus the battery dies so quickly its stupid. .. everytime i complain t-mobile blames apple, apple says theres no hardware problems, i got back to t-mobile and theres nothing they can do either i will most likely be switching to different company and different brand of phone but im tired of not getting help from either company
  10. I swear to god it's the last time I ever buy anything from Apple! I bought it from PC World, who today just informed me that I am just out the 1 year warranty and need to contact apple, who no doubt will say the same thing. I was hoping for some advice on this though because if i buy a device that is faulty and the fault doesn't become apparent until after the 1 year warranty runs out then that surely is still an argument for a replacement/repair? The guy I just spoke to in the shop reckons it could be a faulty hard drive, and I previously just put it down to a software glitch which can be fixed. I set up my speakers and iPod ready to bang out some tunes and to my horror- No Music on it. Nothing. Nada. Zilch. 100 and odd GB of data, but no tunes... This has happened before when I charge it up, add music and I know how to fix it, it just takes hours! And it's highly inconvenient, not to mention extremely annoying. What is the point in having this device if I can rely on it to supply me music when and where I might happen to be, which last night was in the middle of nowhere miles away from my laptop. this is the third time this has happened, and it also occasionally has errors in songs, for exmaple it will be half way through playing a track and then suddenly it's playing something else, then back to the track I was listening to, as though a segments of tracks have been mixed about. Do I have any consumer rights here that I can enforce if necessary. I will not be fobbed off by Apple again, they already sold me a dodgy macbook, refused to repair and I kicked out their genius store once and humiliated by the staff for raising my voice (after travelling all the way there from 70 miles away one day) I never sent the letter of complaint that time, but I should have. I will certainly mention that this time if i have to.
  11. Hi There, My sister has an iPhone 4S which was Replaced by Apple within the warranty period (Albeit only just). She was told that it would have 90 days warranty on the replacement handset and was sent on her way very happy indeed. exactly 110 days later the replaced iPhone 4S completely died. Won't turn on, no output from the screen so back to the Apple Store to see what could be done. As the iPhone was 20 days out of warranty, they wanted £129 out of a 16 year old girl to replace the handset. Pretty poor show if you ask me, but their rules were rules! I am aware of the Sale of Goods Act as I am Self Employed and I am curious on the best way to proceed? The original iPhone was replaced whilst it was still in warranty. The replacement died 20 days after that period had ended. Would this be grounds for "Unreasonable period of operational life for the product" It died less than 4 months in service. I am not paying £129 as the handset is insurance covered, but with an Excess I'd rather not go down that road either. Could anyone suggest the best way to proceed please? Do you personally think that they are in breach of the Sale of Goods Act? For the benefit of doubt. Handset was NOT: Jailbroken, Taken Apart, Dropped, Water Damaged and was always in a case which covered the screen also! Thanks Caggers
  12. I am a Windows user but prefer the look and feel of a Mac keyboard and mouse - both of which I've used easily and happily for some time now. I bought a Mac keyboard from Amazon, it developed a fault so they sent me a replacement, that is dodgy too. I also bought a Mac mouse which fails to scroll down. I contacted them and they said I should take it up with Apple, in disgust I cancelled my Amazon account and am wondering what rights I have with the manufacturer (if any), both products are about 4 months old.
  13. Apple is set to pay out around £66m ($100m) to settle a US lawsuit which claims children were improperly charged while playing iPad and iPhone games. It is alleged that poor safeguards meant kids were easily able to buy extra features for the free games without their parents' knowledge or permission. Court papers claim: "Apple failed to adequately disclose that third-party Game Apps, largely available for free and rated as containing content suitable for children, contained the ability to make In-App Purchases." The case dates back to 2010 and 2011, with Apple updating its software to put in more secure controls on in-game purchases from March 2011. It has now agreed to give a £3.30 ($5) credit to an estimated 23 million people who were affected. However, if parents can show they were charged more than £20 ($30) then cash refunds will be offered. The games that were downloaded were designed for children as young as four, claims the lawsuit - which was started by five parents. One of the parents, Garen Meguerian, says his young daughter spent several hundred dollars on "game currency" while playing "highly addictive" apps like Zombie Cafe and Treasure Story. Apple previously required a password to be entered for any download or purchase which was valid for 15 minutes without needing to be re-entered. The system changed in 2011 to make the password mandatory for every transaction, and to warn users that free games might contain the option to buy extra features. Some technology writers have said that parents should be more aware of the consequences of giving children access to their gadgets and passwords. Lawyers bringing the case also want Apple to pay their legal fees of £860,000 ($1.3m). The proposed settlement needs court approval and will go before judges on March 1.   14. Anybody else having trouble with Apple computers or their Apple Care extended guarantees. I am on the verge of suing them over a built in fault with the early 2008 MacBookPro laptop. Video issues, overheating and failure to start up are symptoms of this fault - due to a faulty graphics chips built in to the logic board. The repair costs over £400. Under the Sale of Goods act Apple are responsible for the repair as it was there from the beginning. Anyone one else with problems with this mac please respond with your experiences. Also any dealings with Apple repairs or the mis-selling of Apple Care that you are concerned about. Thanks. PS Sorry if posted in wrong area - I am new to forums.
  15. I Have a problem with short term memory loss. I have used up all my easy to me to remember passwords but of course cannot remember which I have used got in touch with apple support and just got scripted reply's telling me how to get new password. Tried to use apple forum to ask for help guess what have to sign-in using apple ID for which I cannot remember password. dpick
  16. I've had an I pod touch for around ten months now and recently the rubber which holds the screen to the back came away and now the front and back are not connected properly. I checked my warranty online with apple and was able to send the Ipod touch away for repair. This part was very efficient but I received the ipod touch back today and it has not been repaired. Apple have said "A diagnostic evaluation has determined that your ipod requires service because of and external cause such as accidental damage."- This is not true. I've looked after my ipod really well and have never dropped it or anything like this. Looking at the damage to me it is clearly a flaw with the way it is made. In essence I would like to know if there is any point in disputing their diagnostic evaluation and if so how to do it? I only have until the 24th of December when my warranty runs out. My other concern is that the inside of the ipod is not protected as the seal has come away so obviously I don't want to use it in case the inside gets damaged. I use my ipod everyday for a diary, emails etc so this has really annoyed me. They have said I can pay to have it fixed which I would do if it was my fault and out of warranty. What is the point in having Warranty if companies can decide that it's damage is caused by the user at whim!? Any help would be appreciated.
  17. Hi, I have bought a Macbook Pro 15 at the UK Apple Online Store in mid April for around £1500. From the moment I first used it, when turned on, it made a slight clicking sound. I was told it is normal with high capacity HDD drives that came with the laptop. On June 28 my Macbook froze with all my data and became unusable, so I called the Apple Care Warranty service, I was guided through several tests and the issue was diagnosed as a faulty HDD and was told that it will be replaced at the Apple retail store the following morning. On June 29 I went to the Apple retail store (specifically to its Genius Bar, a quick service desk where technicians help customers solve problems with and on the spot fix/repair Apple products). Here I was told that I need to buy an external HDD, back up my data first and then follow instructions given. On June 30 I went to buy an external HDD, backed up my data and followed the instructions, which were erasing the HDD and installing the system from a DVD that came with the laptop. The installation failed in the middle; repeatedly for 5 times. I the same DVD from the same laptop of a friend, it failed as well. I even tried to install the system on the external HDD, it failed as well in the same way. I called the Apple Care Warranty service, was guided through the same steps without result, so was told to go the retail store again. On July 2 I went to the retail store, my laptop was taken away, and came with a new system installed. It worked. On July 14 it stopped working again, another error, with data inaccessible, luckily I made a backup this time. I called the Apple Care Warranty service where I was told to install a new version of the system from my install DVD, which did not work as it did not before (see June 30), so was told to go to the retail store again. On July 15 I went to the retail store, where the laptop was taken to away and brought back working again. On July 17 it had a different appeared (I believe it is related to it). Applications did not run (such as MS Office, Safari, Utilities). On July 18 I went the retail store and was told that the laptop would get replaced if it was not customised by me through the online store, but that it will be replaced by the Apple Online Store. On July 19 I called the Apple Online Store to replace the laptop but was told that they will not do it, because according to UK law they have the right to repair it first, so I agreed to a repair. On July 20 I was told that I will need to stay at one place from 9 am to 6 pm for the laptop to be picked up. On July 29 I received it back with a replaced HDD. The same problem persisted. I called the Apple Care Warranty service asking for it to be replaced, but was told to go through the installation process again (even though I did it under its supervision several times before) and was told that they will need to do another repair. I asked for a replacement/refund but was told that they will not agree to do it. They said they will repair it again as they have the right to a "reasonable number" of repairs. What I would like to know, I would be grateful if somebody could help me what my rights are: 1. Do I have a right to a refund? 2. Do I have a right to a replacement? 3. What is meant by reasonable number of repairs that Apple tells me it has to fix the issue? 4. What is meant by significant inconvenience that it caused to me in this case? Please take into account that I spent hours on the phone, travelling and trying to solve the issue myself. I also needed to buy additional hardware to rescue my data. Thanks, jaro
  18. 2 years ago I bought an Apple ITouch from Tesco for my daughter. After 6 months the display screen went blank. As we live in Malta it was a few of months before it was returned to tesco still under warranty. They returned it (presumably to Apple) and duly sent us a new replacement but now after a further 9 months or so this new device refuses to charge up. We took it to our local Apple agent who tested it and told us that it would be too expensive to repair and we might as well buy another one. Whilst I understand that the warranty has now expired my main question is - is it reasonable to expect me to buy an iTouch every year? Which is what is suggested by the lack of reliability of these two machines. With no moving parts shouldn't they be expected to remain in reasonable working order for longer periods of time? Can I pursue this further (e.g. directly with Apple) or is there some other consumer right that I can use to help my case. I'd be grateful for any advice as this is an expensive device which has had relatively little use. Thanks
  19. Morning all, I recently purchased an Apple Macbook Pro from a seller on eBay for a buy it now price of £1,020. It seemed a good price at the time, and obviously others thought this too as the seller sold 6 of these laptops in a matter of 5-6 hours (yesterday, 25th Oct). I paid via £120.00 out of my Paypal account and the rest was paid via bank transfer through paypal. Last night, after having my routine check on eBay, I noticed that the item wasn't in my "won/purchased" category on the side. After further checking, I noticed that the seller had completely unregistered their account and also removed all traces from the item, somehow. I'm not sure how he did this, but I bought the laptop at approx 2.10pm yesterday afternoon and I got the second last one, with the last one being sold at about 3.00pm. It seems the buyer has done a runner. I can't get any of his details from eBay as his account is unregistered and I can't even view the item I won as he has deleted it from eBay, somehow... I've opened a dispute with paypal right away but i'm not sure how much i'll be covered for. This guy seems a real [problem] artist, and has probably already withdrawn all the money from his paypal account (a hefty amount, considering he sold 6 of these laptops, adding up to around £6,100) in a day! I'm wondering what other course of action I could take? I'm planning on ringing paypal today and seeing what else they can do. They state in the dispute they want to seller to reply by 4th November, but I obviously can't see this happening, and feel at risk waiting for that date to come with no further action taking place. Thanks for all your help in advance, hopefully someone can give me a solution. Brent
