  1. hi all, just some quick advice needed if poss, got a pcn before xmas code 01 parking in a CPZ during prescribed hours, I was parked on a single yellow no kerb markings, and no sign on the yellow lines stating prescribed times, was picking up my elderly father who was further down the road I had to have a quick search for him as he was carrying stuff, , (was parked for about 10 mins in all) the place I parked was a bus lane but it was out of the bus lane hours, 4pm till 7 pm I was parked in the red circled area, fig 1 The enforcement officer observed me from 19:30 to 19:30 hours (not even a minute) I carried out an informal appeal after looking on the council website and the rules and found this statement, saying I had to have a little search for my father, fig 2 It came back rejected saying that “a vehicle is not allowed to park on a yellow line when restrictions are in force other than for the purpose of loading or unloading as permitted by legislation, or for allowing passengers to board or alight, in which case the driver should not leave the vehicle, notes made by the civil enforcement officer show that there were no suggestion of either of these actions taking place at the time of the contravention, (bearing in mind the ticket says I was observed from 19:30 to 19:30 not even a minute), your vehicle was parked in contravention of a waiting restriction,, the restrictions were clearly shown in accordance with traffic management act 2004 legislation, They also included this picture of a sign that belongs to the yellow line further down the road to the left, beyond the crossing in the picture, fig 3 placement of the sign is neither here nor there as some half a mile down the road is the main CPZ sign with the prescribed hours, 8am – 8pm mon sat, which means the little yellow line automatically falls within the main cpz hours from what I have discovered, Now I went and looked at this sign which Is placed beyond a bus stop in the middle of the pavement, around half a mile from where my ticket was issued as you can just see it poking out, I’m usually pretty good at reading signs and obeying the rules (or so i thought ) fig 4 now this sign is obscured by the bus stop and if you get behind a bus its blocked totally, add it being dark is not a good mix rest of pics So the question is, do I go to the next appeal with this or do I just stump up the £65 in case I lose the next one and its £130, they call the first one that was rejected an informal appeal, now because I didn’t state all this about the main cpz sign and the other sign does that mean they will look badly at it ?? informal makes you think its summit cosy when in fact it’s a propa bone fide appeal, havering.pdf
  2. Hi My friend who lives over road went to local esso and got a pcn in the post for parking at the garage for 3Hrs 27 mins 37 secs to buy a newspaper!!! I have proof on my cctv (reg not readable) of him leaving at 06:37am and returning at 06:54am Is it best to just ignore it or send them a letter telling them where to go or see them in court as I would be willing to witness that fact that I know it was him that came home and parked opposite. I could save 2 weeks of footage of his 2 cars parked at home and photo evidence of me walking over and taking a picture on my cctv? Many thanks, Andy
  3. I was wondering if you knew how the registration number is displayed on the parking ticket that you get from the machine & display in your window ? (Full Reg, Partial, etc) My mum initially received a letter, for the same car park, stating she didn't pay enough when we sent the evidence in they now claim she didn't enter her registration number correctly but haven't given us evidence. Her ticket only displays the last 3 digits & I wondered if that was correct or if it should show the full registration. Thanks for any help you might be able to give.
  4. Hi all, Wondered if anyone could help. I recently purchased a new vehicle and had driven over Waterloo Bridge during the congestion charge times forgot that the vehicle was not registered on CC autopay after driving my previous vehicle for so long which had been registered on autopay for a long time. I received no warning letters nor a bill for the congestion charge simply a £65 PCN straight away. I understand I messed up by forgetting to set up the autopay on the new car but obviously not everyone is on top of their game 24/7. Is there any way around this or to appeal it in anyway? Any advice/clarification would be appreciated. Thank you Regards
  5. Hi, I have today received a Claim Form from BW legal. The Particulars of Claim read as follows: 1.The Claimant's Claim is for the sum of £100.00 being monies due from the Defendant to the Claimant in respect of a Parking Charge Notice (PCN) issued on 01/04/2016 (Issue Date) at 13:38:43 at Smyth Street - Wakefield Anpr Vcs Scheme Std (60-100). 2.The PCN relates to xxx under registration xxx. The terms of the PCN allowed the Defendant 28 days from the Issue Date to pay the PCN, but the defendant failed to do so. Despite demand being made the Defendant has failed to settle their outstanding liability. 3.The Claim also includes Statutory Interest pursuant to section 69 of the County Courts act 1984 at a rate of 8% per annum a daily rate of 0.02 from 01/04/2016 to 06/01/2018 being an amount of £12.92. 4The Claimant also claims £60.00 contractual costs pursuant to PCN Terms and Conditions. The total amount of the claim is for £100 PCN + £60.00 legal costs + £12.92 interest plus £25.00 court fee plus £50.00 Legal representative's cost giving a total of £247.92. For a bit of history, I first received a PCN shortly after the above issue date, looked into it, and opted to ignore it. I have received several more since and opted to ignore them all. I have now, today, received this Claim Form. I have yet to take any action. What should my first course of action be? Should I respond to the claim online (as stated on the form, at moneyclaim.gov.uk?). What should I then do upon doing this? Please advise as soon as possible. Thank you in advance, Card_Owner.
  6. Hi, Last week my husband took the children and an elderly relative for a bite to eat and to the cinema. After entering the car park it took him a while to find a suitable parking space big enough to get our elderly relative out the car and also get our son out of his car seat. They then went to get some food, went to the cinema, returned to the car and left the car park. Today we have received a pcn from parkingeye saying that we were allowed a maximum of 3 hours but the time from entering to exiting the carpark was 3 hours and 16 mins. In all honesty he didn’t actually realise that there was a 3 hour limit and due to him spending most of the time in the cinema we were quite surprised as some films can be 2 1/2hr plus long, not including purchasing tickets etc. is there anything we can do or should we just pay the parking charge?

Where exactly [carpark name and town] Surbiton Health Centre, KT6 6EZ For either option, does it say which appeals body they operate under. There are two official bodies, the BPA and the IAS. If you are unsure, please check HERE BPA I went to talk with the reception at Surbiton Health Centre, and they were not helpful. I remember the console to register the Immatriculation number was not working on one of the days I had to go there, but I am not sure it was on the 08/11/2017. The people at the reception did not want to confirm anything and went as far as to say that they have nothing to do with the parking company.
  8. My wife and I work for the same company. She broke her foot in November tripping over one of the many spent firework rockets left lying around the work car park by the landlord. After a while she decided to go back to work with a surgical boot and crutches and I agreed with our building manager that if our car park was full I would park in the disabled spaces as our overspill car park is quarter of a mile away. Four spaces are marked up for my company and the other five aren't marked up for anybody. On the morning in question, our four were taken up so I parked in one of the others. I got a ticket from CPP who didn't even query with our reception desk (I've got a company sticker on my windscreen). My company contacted the landlord (who knew my wife had a broken foot) to ask what was going on just got a curt reply saying we shouldn't have been parked in disabled bays that are not ours. We thought it had been dealt with however. Then a PCN arrived so help appreciated folks.   9. Hi all, Firstly, this is a great forum with very valuable content and discussion! I am a newbie but hope to add my input where i can in the near future! I received a PCN from Brent Council a few days ago. Images (attached) have been captured by a lanewatch CCTV camera - that is actually not listed on their CCTV map (found on their website). Perhaps it is not an 'approved' device? They have 'apparently' captured my vehicle in a box junction, but there are no clear pictures showing the number plate. All of them are very blurry. The last image in black is their only image which shows the number plate (i have scribbled over the letters) but it is completely black and still does not show the vehicle in the box junction. It looks like it may have been taken by another camera, but I cannot be 100% sure. I have requested the video evidence, but I keep getting error messages online. I wanted to know if I even have any grounds for appeal? Any advice is greatly appreciated! Thanks Tam camera.PDF
  10. Hello, I just received a PCN from private parking firm NTC (the worst of the worst). The communal garage door was broken meaning I had to use a visitors spot and display a ticket. I had a clearly displayed valid ticket except that the I forgot to put the reg. number on the ticket. The past 5 entries had the same correct reg. number and CLEARLY this was a valid ticket but I had just forgotten one inane detail. Here is the evidence they have: imgur dot com/Q4q1GFN The prelude to Christmas has rendered me broke and the ruthlessly exploitative nature of this conniving company is making me pretty reluctant to pay them the 'discounted' sum of £60.   11. Help Required I have received a Pcn fine from a private car park in Blackpool NE Parking Ltd. I have received a letter from above company on the 17.12.17, Saying that was parked incorrectly and not within the parameters of the bay, they have supplied a photo of my vehicle with one wheel on the white line of the car parking space (not actually outside of the bay) they also have a picture a parking ticket on the windscreen of the car. Which wasn't on there when i returned to my vehicle. The fine relates back to 22.10.2017. I have responded to the company by email To whom it may concern. I have today received a notification of a fine issued by your company stating that my vehicle was 'not parked correctly within the markings of the bay and it also stated that I had been issues a penalty notice at the time. my vehicle is on the white line (which is not outside the parameters of the bay.) this was only one wheel as shown by your photographs. you photographs also show a yellow package on the window screen however there was no notice on my car on my families return to the vehicle (if this was the case I would have contacted you prior to the letter I have received today.) I feel this is an unjust letter / fine that I have received. I will also endeavour to seek further advice if this matter progresses. Response from NE Parking Ltd Thank you for your email we received on 17/12/2017 Unfortunately you are out of the timescale to appeal you were given 28 days To appeal from the day after the pcn was issued to the vehicle which Was (22.10.2017) The amount which is now payable is £100.00 I have replied saying how do you respond to something which you where unaware you've received. Can anyone help me and tell me where I stand with this. Thanks
  12. I recently found a PCN attached to my windscreen from UKPC even though I was displaying a permit. The PCN stated that I was not displaying a valid permit, although the out of focus pictures taken by them, and displayed on their site, show the permit on my dashboard. I have appealed the PCN and asked that they stop harassing me, as this is the second time I have had a ticket whilst displaying a permit. What I find frustrating is that rather than cancel the first PCN, they simply waited 2 months for it to expire, and my guess is this one will probably go the same way. As this means I have to not only waste my time appealing these PCN's but also have to wait 2 months for a resolution, is there any way I can force them to issue a cancellation in a timely manner and to stop this happening repeatedly? As it stands,this series of events could go on infinitely and I have far better things to do with my time.
  13. Just received a pcn for failiure to comply with a street sign from a London council. The date of the alledged offence was 17/10/17. and the date of the pcn is 12/12/17 is this outside of the timelimits for such service obviously they've got the details from the hire company many thanks in advance
  14. I got a PCN sadly I never realised my Disabled badge ran out yesterday. All be it a fair, as my fault for not noticing. The form to me is filled out incorrectly, stating my dark blue car is grey. Would this have any bearing as to the PCN being legally not binding? I ask as every other form I know needs to be filled in correctly or gets thrown out of court ect ect.
  15. Hi guys, I've recently received a parking charge notice from the Swansea based Millennium Parking Services. They have asked for £60 with the charge increasing to £100 after 14 days. I am currently a student, so I don't have the money to pay for this and I feel conned. I was using the street to park for my regional rugby training sessions in Llandarcy academy of sport. They don't always have someone blocking the carpark entrance but when they do they don't let me in even if I tell them that my team trains here!! There were no road markings or clear signage for me to know that it was a permit holders only area, if there was, it was 6pm in november and I did not see them, meaning they were inadequately lit! What action should I take from here? Any advice is greatly appreciated!   16. Hi All, Some help please... I was dropping my son off at Liverpool JLA, early morning. Forgot to bring cash for the drop off point. No wallet. So dropped him off a roundabout on a service road. He had no luggage only a small holdall, so made sense. Literally stopped for 20 seconds. Through the post received a PCN (NTK). I have not responded. Date of infringement 18/11/17 Date on NTK 23/11/17 Date received. 30/11/17 No mention of Schedule 4 (2012) PoFA - Mentions the Date Protection Act 1996 (relating to DVLA) They have photographic evidence I have not responded in anyway. IAS is the body they use for appeals / Appeal can be sent via website myparkingcharge Company who have sent this speculative invoice is Vehicle control Services Limited, Sheffield. They are saying I stopped in a controlled area that has clear signage on the entrance to the private land...I would dispute that . I was not causing an obstruction. Its a big fat [problem]. Horrible.. Any tips or what to do next. I wont be paying this in anyway shape or form. Horrible state sponsored [problem]! thanks in advance..
  17. Hello, This site is great - thanks for all the information. I got a PCN from the Peel Centre car park in Stockport. I didn't even know it was pay and display because the signage is so bad and it was dark when I entered/left. I would have definitely bought a ticket had I realised as I was there for less than an hour (57 mins exactly). Usual conditions - pay £60 now or £100 later. Have no intention to pay but advice seems to be now to appeal? I think my grounds will be inadequate signage and unreasonable charge considering I owe them only for one hours parking. Can anyone give me some advice on how to word this in terms that sound more legally competent/aware. I have to appeal by 14th December. I am aware that there has been quite a few successful appeals against PCNs issued at the Peel Centre so if anyone has appealed and succeeded I'd love to hear how you did it. Also worth noting - I also got a PCN last June from Excel for parking at The Square in Chorlton (I wasn't actually parked, I was dropping something off so my partner never left the car - so therefore waiting?). I never received the initial correspondence about this, only the legal letters from BW Legal that started arriving in October this year. Stupidly I called up the legal department once they threatened taking me to court (realise now I should still have ignored perhaps). I informed them I had received no initial correspondence and as a result they have placed my account on hold for 30 days while they wait on Excel to re-send the original information (apparently Excel have no time limits to do this in! Ironic huh!). My plan is then to say that I want to be able to go through the standard appeal process as I never had the opportunity in the first place.   18. Hello PCN issued by Smart Parking for wrong VRM a zero instead of O was entered. The alleged contravention happened at HAVEN BANKS RETAIL PARK EXETER A ticket was purchased for the time parked but a zero was entered instead of letter O PCN received 06/11/17 Date of alleged contrevetion 21/10/2017 I appealed, not realising that I had entered a zero instead of O. Not sure if I disclosed the driver ( sorry didn't realise at the time what a mistake that may have been). Sent supporting evidence of purchased tickets- I had know idea what I had done wrong. Appeal refused although they acknowledge my tickets as eveidence of tickets purchased. Appeal refused as a zero was entered instead of the letter O I'm now appealing to POPLA I'm struggling to get my head around the legal jargon and which bits apply to my case. Any help would be much apprieciated.

Hello, I have received a PCN notice for stopping on a restricted bus stand; I will admit I was there, but for such a minimal amount of time, and clearly dropping a passenger off (shown in the photo on my PCN) - do I have grounds to appeal for alighting? The bus stand does have a sign saying 'buses do not pick up passengers from here' and I did not inhibit any bus during the few seconds I was there. Once I saw the sign I got out of there as soon as possible. Any help appreciated. Can someone also confirm if I do appeal, the reduced charge is held until it is resolved? Thanks, L
  20. Aplogies as an absolute newbie here, however I was asked to create a new thread. There is another recent thread (I can't post links, maybe someone else could as seems daft to recreate a whole heap of stuff). I am in the identical situation at the same location I have just received an identical letter from UKCPS, all details completely as the above mentioned thread (same paperwork). My wife was driving my car that day, obviously she didn't spot any signage etc. 28 minutes over a 4hr limit..... Disgusted that companies can request such 'fees', she is disabled (was parked in disabled bay, with badge on show) which has left me even more disgraced at these cowboys operate, with no extra time for disabled people.... Question is approach them & ask for 'understanding'? Dismiss? etc etc
  21. Hi, On 18 Nov 17 I received a Parking Charge Notice (PCN) through the post stating that my vehicle was parked longer than the maximum period allowed on 07 Nov 17. On the 19 Nov 17 I sent the following appeal to ECP: Dear ECP As the registered keeper of the vehicle, registration xxxx xxx, I have received your invoice number xxxxxxxxxxx. The driver at the time tells me that they did not notice any signs telling them about the time limit and that the fact that it’s a free car park they didn’t even think of looking for such sign. Whilst parked she was shopping at Tesco then headed to Costa to meet an old Friend for lunch, and that she is therefore not liable to pay you any money as she was using the shopping facilities. On conducting some research about Bishops Centre car park and shops; unbeknown to us it is possible to speak to the staff in the shops and restaurants and request that your car is exempt from charge, which is also free of charge. This means the 3 hour rule isn’t a rule in which must be complied with at no exception. As she was parked there on a Tuesday morning, school hours; the car park was less than 40% full, therefore she was not taking up a space that someone else could have had and no losses would have been made. If you reject this appeal, please issue me with a valid POPLA code. At POPLA I shall be asking for a breakdown of the genuine pre estimate of loss that the charge must represent, which might I add that since it was a free cark park, and also it was far from "at full capacity" then there was no loss. Yours Registered Keeper. Since then they rejected my appeal under the grounds of my vehicle being in breach of the terms and conditions of the car park. In the rejection letter i have also noticed that it says "This signage is quite clearly states that if your vehicle is in breach of the teams and conditions of the carpark then a PCN will be issued. To me they have admitted that it doesn't CLEARLY state this, but it QUITE clearly states this meaning they are not 100%. I don't know if this is worth mentioning. I personally feel that this is an unfair charge as my wife was genually shopping in the facilities where she was parked. And that it it possible to be exempt from paying if you speak to the shop managers, which isn't stated in there terms and conditions. I have a unique POPLA code, my question is, do i have grounds to continue with my appeal or should i just pay Thank you so much in advance. Zoe2640
  22. Hi, I received a notice to keeper from Smart Parking after the vehicle had parked in Haven Banks car park in Exeter. A ticket had been purchased, but the driver had accidentally missed one of the characters of the registration number when entering it. The ticket was displayed for the duration of the stay, but obviously the ANPR in use in this area would not have recognised this. A copy of the ticket was initially sent to Smart Parking, but they upheld the charge and we have since been through the standard series of letters and demands from DRP, Zenith and now Gladstones solicitors. Rightly or wrongly, there has been no further contact with Smart Parking or their agents since their refusal to accept that a ticket was in fact purchased at the time. A case of 'Computer says "no"'. The latest letter from Gladstones refers only to an amount outstanding of £160 with no date of alleged infringement or location. They are 'kindly' providing an opportunity to pay the full amount before it goes to court. Is this a 'Letter Before Claim'? Or is that the next I can expect? Thanks for any advice? Drogon
  23. Hi, I have received a PCN from Premier Park for parking in Exeter Road Car Park in Braunton, Devon. I parked in this carpark for 20 mins at 19:06 and it was dark. I did not realise that it was a paid car park as the notices were not that clear and lighting was low. 'Contrevention date': 2nd November, 2017. The issue date of the PCN: 8th November, 2017. The PCN requests £60 if paid by 14 days from issue date or £100 afterwards. I have googled around and this car park seems to have a history of this issue. I do not live any where near the car park, I cannot get images etc. From what I have read, Premier Park provides images in daylight or with a strong flash to 'prove' that they have enough lighting. I cannot provide this evidence, but even in the images that they have provided on the PCN form shows how dark it is. Could you provide me with any advice for a potential defence. Also, if I apeal to Premier Park (which I expect they will turn down) and then go to POPLA, will this mean that if I am refused, they will charge £100. Any advice is appreciated.

BPA i think, POPLA is also mentioned If you have received any other correspondence, please mention it here NONE £90 parking charge notice, parked for slightly over 5 hours according to their times, looks like the limit was 4h30 although this is not stated in the letter anywhere. Didnt even realise there were parking restrictions as its not like it is in the middle of town I can see you could easily park that length of time as we did, if you do several different things while there within the "park". not sure what else is useful to add if anything. I found another website a recommendation to ignore: so if thats the case then is there any guideline as to how much correspondence to expect from them before it stops or needs to actually be followed up?   25. Hi all Very curious about how long a PCN can actually be live/valid for and if there's a certain cut off period where the regarding council have no right to ask for any payment anymore. I have been disputing a PCN back and forth since last July 2016 and once again have had it brought back down to £65 at "the discretion" of said council employee. Do I really need to pay this? Can they keep pursuing me leading to court/bailiff action? If I have to pay the £65 within 2 weeks I will but if I do not really need to of course I would like a way out of it. Any info/clarification would be appreciated Thanks
