  1. What am i to do with these? I apparently have a credit card with them from 2008. I remember applying at old address. but never received a card, a pin, not even a statement. so i assumed i was declined. Now i saw it on my credit file, rang them up but they cant do anything as i couldnt get thru security, cos i cant remember the details. was advised to send a letter, proof of name change( as i married in 2011) proof of address to update my account at least. They replied saying they cant do anything as my letter didnt have my account number on ...well duh, i never received nothing from them, how would i know....what do i do now? they told me to call but i cant get past security, so no point in waste of fone bill.. . i dont know what to do. help please!
  2. Starting a new thread for this PPI action against Barclaycard. Originally an Egg Card, then taken over by Barclaycard. Card is still active. I am helping a family member with this, so the card is in their name. They never needed or wanted PPI, they were self employed whren the card was opened, and they have phoned once in the past to cancel PPI and were told that they couldn't (hopefully this contact was recorded and will be confirmed if / when the SAR is complied with.) Action so far: 30.11.12 - Sent a SAR and £10 postal order to Barclaycard's Data Compliance Officer. Used one the templates off CAG for the SAR. 03.12.12 - SAR was received by Barclaycard (according to Royal Mail track and trace) 12.12.12 - Barclaycard returned the SAR and postal order, with a standard letter: "Thank you for your request for information under the Data Protection Act. Unfortunately we are unable to process your request due to the reason(s) detailed below: It is possible that the account has been closed for a period of more than 6 years and as a result customer details are no longer retained." Now, given that the card is still active, this is nonsense. As they received the request on 3.12.12, I reckon their 40 calendar days are up on 09/01/13. I am now unsure on the best way to proceed. Should I re-send the original SAR and PO, with a cover letter advising them that the card is active and they are running out of time to reply? Or should I wait until the 40 days are up and send a LBA? Any advice gratefully received!

A Bank has failed to reply to my SAR letter within the required 40 days, and up to this morning my £10 fee cheque has not been cashed though that may be for manipulative reasons if some comments are to be believed. I am about to send a 7 day notice letter. Posted at the same time as the SAR to the same address/office was a separate CCA letter with the required £1 fee. That cheque also has not been cashed, however I received a reply with the requested paperwork just a few days after writing. Both letters sent by Recorded Delivery, signed-for receipt has been verified via RM onliine tracker. Is there any benefit in referring to the CCA letter and reply to support my position in my 7-day notice letter pursuing SAR, or is the reality that whether they are being manipulative or whether there has been a genuine oversight they will only follow a formal path anyway, and this additional information may be more useful undisclosed and provided to court/ FOS in substantiation should this go bad and need escalating?   4. Hi all, I have recently sent out SAR to RBS please see my letter below, then the reply from RBS, what a joke, how can they delay my SAR like this?? I know they can ask for proof of identity, any suggestions what I should do / template reply letter.Do I comply and send back what they are asking for? I have some / most of the information they are asking for. EXCLUDING ACCOUNT NUMBER XXXXXXXXXXXX ( THIS IS MY BUSINESS ACCOUNT) Previous address other than above, if there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. XXXXXXXXXXXXXXX, DO NOT SEND ANY XXXXXXXXXXXXXXXXXXXX CORRESPONDANCE XXXXXXXXXXXX TO THIS ADDRESS Please include details of all transactions, and a copy of the original contract by which this account is/was governed at the time it was opened including all amendments made to the contract terms since opening the account. I would also like a schedule of all charges & interest applied to my account(s) including details of any instances that required manual intervention. If you are unable to provide this specific information, copy statements will suffice. All data, including data held on a microfiche must be provided within a reasonable timescale, a maximum of 40 days. In light of all the recent publicity regards the reclaiming of bank charges, some Banks appear to now only be providing a breakdown of charges in response to all and any Data requests. For the avoidance of doubt I do actually require all information held by yourselves. It seems a lot of banks are also wrongly interpreting the Data Protection Act (DPA) 1998 as a requirement to only disclose six years worth of personal data, and this is also wholly wrong. The DPA clearly states that all information held must be disclosed and it has no correlation to the Limitation act 1980 at all. If you no longer hold data beyond 6 years however, I would like a signed declaration from your data controller and a copy of all documents pertaining to its proper disposal. Whilst not exhaustive and for the avoidance of doubt I shall list what I require: * Full copies of all contracts that exist between myself and your organisation; including copies of any documents you hold in support of same. * Copies of all statements relating to the above accounts. * Copies of all correspondence, including all letters, faxes, emails and memos sent and received between ourselves, and any other third party in relation to any of the above accounts. * Copies of any telephone recordings and/or transcripts of these recordings as well as any logs or journals that relate to them. * Copies of all documents which include any of my personal information including copies of any contracts or invoices, emails or computer records containing my personal information, or any records which pertain to this information. * Full details and copies of any documents upon which you relied when you have provided my personal or financial information to any individual, organisation or third party. * Full copies or transcripts of any computer logs or database records kept in relation to myself or in relation to my financial or personal information. *Details of all systems you currently have in place to ensure my personal or financial information is kept securely, including details of those officers who currently have control of same, and at the time it was held or provided to a third party. * Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, reason for deletion, certificates or references confirming details of destruction. If we are successful in tracing your account, we would require either three months original bank statements or an original utility bill, dated within the last six months, showing your current address. We are unable to accept credit cards statements, mobile phone bills or copy documents. If your are unable to supply us with any further details which may assist us in tracing your account, please resubmit your request enclosing necessary proof of address documents. all original certified documents will be returned.   5. Long time viewer so thanks to all the contributors here, it's been a great help! I have sent off for the CCA for a Credit card and a Loan with Halifax. They have sent a letter saying "we'll get it to you when we can". I asked for it within 10+2 days. Is the template online the same for pre and post post 2007 debts? Thank you D This is the letter you need to send (edit to suit and send recorded) Account In Dispute Ref: Dear Sir/Madam Thank you for your letter of xx/xx/xx, the contents of which have been noted. You have failed to respond to my legal request to supply me a true copy of the original Consumer Credit Agreement for the above account. On **DATE** I made a formal request for a true signed agreement for the alleged account under consumer credit Act 1974 s77/8. A copy of which is enclosed for your perusal and ease of reference. You have failed to comply with my request, and as such the account entered default on **DATE**. The document that you are obliged to send me is a true copy of the executed agreement that contained all of the prescribed terms, all other required terms and statutory notices and was signed by both your company and myself as defined in section 61(1) of CCA 74 and subsequent Statutory Instruments. If the executed agreement contained any reference to any other document, you are also obliged to send me a copy of that document.In addition a full statement of this account should have been sent to me detailing all debits and credits to the account. Furthermore You are aware that the Consumer Credit Act allows 12 working days for a request for a true copy of a credit agreement to be carried out before your client enters into a default situation. This limit has expired. As you are no doubt aware section 77(6) states: If the creditor fails to comply with Subsection (1) (a) He is not entitled , while the default continues, to enforce the agreement. Therefore this account has become unenforceable at law.   6. Hey everyone, I'm new on the forum and looking advice to reclaiming late payment fee's from very. I had my first statement from very on the 30/06/12 since then I have continued to pay my minimum amount on a bike and a coffee maker that I bought from them. I have all this time up until 3 weeks ago been paying my bills out of my Job Seekers Allowance and recently started a new job. So in the last month or so have been unable to pay anything to them with other bills to take care off and no money coming in after signing off and starting the new job. I had a look through every statement online and realised they have been charging me £12 late payment fee's as of the 20th Oct last year. So two months payments have not been paid since signing off job seekers. So after all that I now have a minimum amount of £83.19 to pay by the 29th of this month which of course I am certainly not going to do as I have to live and pay other bills. I know what I'm going to do in terms of what I will be offering to pay back, and will be phoning them tomorrow to tell them what I can afford to pay and to freeze interest and the late payment fee's until i pay the money I owe. However I have realised from other threads those £12 late payment fee's they have put on my account (6 of them so far) can be reclaimed I did however ask very via email to move my payment date for me as each of those months i was receiving late payment fee's I wasn't receiving my benefit payments until 3 or 4 days after the payment date and this was swept under the carpet in the reply they sent me saying they couldn't help me with this. So do I need a SAR or can I total the amounts myself through the online statements and claim my money back that way? Any help would be much appreciated Thanks. Aaron.

Have had confirmation from fos that MBNA will make offer, In meanwhile my sar has arrived from them so want to spread sheet it up so i can see if the figs come close Its for a credit card, i have no statements just the print out showing ppi made and dates and the odd balance amount, can some one guide me what spread to use ,[ i am pretty rubbish at spreadsheets ] and can someone advise on charges ie can i look at claiming overlimit and late fees etc Thanks
  8. I recently submitted an SAR to RBS, sent on the 7th Feb and received on the 8th Feb this year. This was for any and all information in whatever form (as advised by dx on a number of posts). About a week ago, I got a letter from their Mortgage department advising I'd never had a Mortgage. So far all correct. Today however I received two letters. One advising that the Lombard Request I put in should be directed to Santander, so I'll add that one to the Burton/Tandy/Debenhams pile for my next battle. However, another paragraph in this letter contained the following: 'As you have asked us to provide you with all Payment Protection Insurance information, we have also passed on your request to our Credit Card departments and NatWest Bank to enable them to check whether you had PPI on those products. The outcome of those investigations will be sent to you separately.' Not once I had mentioned that I wanted PPI information. I've written back to them advising that the information would be welcome, but in order to comply with the SAR that they would need to send me any and all information in whatever format, reminding them of the date that the SAR would expire. What's more concerning is the letter I got from RBS cards. This advised that they are unable to identify me. Bearing in mind that I'm still a customer of the RBS group (Natwest, but not RBS cards) they would not normally have any difficulty identifying me. All of my Natwest account numbers were contained on the original SAR request which they included with their letter, the same SAR request that contained copies of my passport and driving license along with all of my previous addresses. They also advised that they were returning my cheque. I'd suggest they check this as I only received a photocopy. I've faxed them back this evening advising them that the clock is still ticking. I've also sent a letter containing my Water bill which will be winging it's way to them first thing tomorrow. Another of my concerns is that RBS have pretty much admitted that they're not going to comply as they've stated that they may not be able to trace my account as it may have been closed for a longer period than their records are retained. The RBS card was from (about) 1995 to 2001, Natwest loans in 1991, 1998 and 2004 and a Natwest account from 1988 until today - I understand that RBS have been known to retain information in an 'archive' format from 1992 to 2001 - can anyone comment if they've been successful in getting such information from them? They've asked me to resubmit the letter and cheque to them when sending the identity documents. Am I correct in thinking that if these are 'resubmitted' this resets the clock? Should I be even enclosing a copy of the original letter? I'd like to remind them that the SAR expires on the 20th March, so they're only wasting their time, not mine.
  9. Hi all, Been trying for ever to get a better deal from Santander on my mortgage (re). Am on the SVR @ 4.74% they are offering new customers 2.94%. They keep telling me that thats the only rate they can offer to me, because they look at peoples circumstances, credit rating etc. The FSA have told the banks that they should be viewing existing customers in a fair manner. I did in mid 2011 have some arrears put that was cleared up 14 months ago. I think they have something against me but need to advice on this because they are not telling me anything but taking my normal monthly payment. Always good for the money but better rates!!! Thanks
  10. Hi guys some advice would be great. last week I used the template to request any details of my loan accounts and got a reply of Natwest. Re. Request for information under section 77 of the consumer credit act 1974 with my loan details (account number etc) / loan amount / and when the loan closed Its says as these loans have ended we have no obligation to provide the information I request.(Credit agreement) I have had 3 loans over the last 10 years one from 2002-2004 the 2nd from 2004-2008 im unsure I was paying PPI on these accounts my final loan I still have the credit agreement for from 2008-current and know I am paying ppi on it and I have been mis-sold it because I had no idea I had it. What do I do now thats my question do I complete 3 separate questionnaires because Ive had 3 separate loan accounts and request my PPI be refunded to me? even though I dont have my previous 2 loan credit agreements - but I have the account numbers and Sort codes that my loans were under. Can I claim on my current loan even though im still paying it??... Thanks in advance for any help.
  11. Hello all, I would greatly appreciate some sound guidance regarding my next steps. I have received my SAR back from Halifax. It actually goes back to when I opened the account, 2004. Foolishly, I sent the SAR regarding a specific account. Thats all I got back. Know better now. It was a credit card, which I have defaulted, and Halifax have duly " disposed " of to Apex Credit Management. However, I only have 3 CCJ' s and Apex is not one of them. Does that mean Halifax still owns the debt?????? Closing balance £ 1898.62 ....... I have been in contact with Apex on several occasions ( via phone and I think letter ) and set up various repayment arrangements. Paying token / small amounts. To this date on Noddle the balance being £ 1671 . Back to the SAR..... Information received goes back to the beginning of the acc. = 2004. Surprisingly! It includes charges for late fees, over limit fees, un paid direct debit fees, and PPI. After reading a few threads on here, I get the drift that the banks will fob you off with the six year rule. So my questions are these ; 1. Can I initiate a claim for unfair charges from todays date and just back 6 years? 2. Is that 6 calendar years i.e. back to 11th August 2006 ? What is the cut-off date? 3. If successful, can I then persue a seperate claim for unfair charges from 11 August 2006 to the date the account was opened, in 2004, because these charges were considerably more. 4. There is also PPI on the account. Various amounts according to the balance. Am I correct in assuming that PPI claims are not subject to time limitations? I need to build a small " kitty " in order to fund other " requests for payments of unfair charges ". So I would prefer to claim what I have the most chance of getting back in the least time. ( hope that makes sense ). Please can you tell me my next step? Thanks in advance. Vaz

  13. Whilst I am in limbo waiting for some results on my PPI claims I thought I would attack my OH's Executive loan PPI. We have the policy and the date the loan was taken out (2001) but no account numbers. We do have the current account statements for that period. It would appear that the PPI was paid monthly separately to the loan payment, around £30 per month over a period of nearly four years. Do I really need to SAR the bank for the account number? Can somebody please point me to a template that I can use for this - have found a few but all the threads seem old. Are there any updated versions. Can somebody also tell me how to calculate the PPI refund - do I take how much we paid and then out 8% simple per annum on it ? I also had an old loan agreement with PPI but I know that this one was paid early - but I do not know if I had a refund of part of the PPI - again do you think I can just go for it or should I SAR them.   14. Hi I have a credit card with Natwest that I have tried to claim PPI refund for. I took the card out in 1997. They have provided me a copy of the application form under a s78(1) which shows that the account included "credit card repayment protection" I belive I cancelled the PPI in 2001. Natwest have said that they have no record of me making any PPI payments and so have denied my clain. I have no evidence to say I did either, other than knowing I cancelled PPI on all accounts in 2001 when I was made redundant as I was a contractor and no-one paid out. I SAR'd Natwest, who have sent me statements back til December 2005 (after 55 days). They have also sent me copies of some letters I have written to them, but by no means all. I asked to telephone transcripts, but they have said they wont send them unless I tell them the date and time I want the transcripts for. Finally, they have sent me no data at all about the running of my account. I imagine Natwest (like Barclaycard) must have some sort of customer management system, that tells them how I run my account, credit limits, over limit dates and times etc. but they claim that they do not and they have sent me all the data they are required to. Even the notes on my account are simply typed up, but with no date/time attached to them. I find it difficult to believe that Natwest holds so little data on me. Can anyone tell me if they have had more luck getting data out of Natwest or suggest what to do next? My plan is to notify the Information comissioner of Natwest's refusal to provide information, but I dont want to do that if this REALLY is all there is. I would like to complain to the FOS about the PPI, but I dont want them to be able to produce "evidence" that I cancelled the PPI the day after I got the credit card. Im fairly certain I didnt do that, as I was naieve back then and thought it was useful. Any help would be appreciated.

I requested a SAR from original creditor and have received a letter from them today acknowledging my receipt of £10.00 postal order but stating that the signature I provided does not match the one on their records.I only signed my name in capital letters. I have read through other posts which suggest using my signature but putting crosses through it. Is this correct please as I'm not sure if thy will accept this. Many Thanks
  17. Lots of issues going on at the moment but have a query regarding a mobile phone company not complying with my SAR. Basically VODAFONE put a default on my CRA unlawfully during 2011 and after a bit of help here using the dedicated pages for mobiles etc together with correspondence via the Vodafone Rep the Default marker was removed after a few shenanigans. Anyway i decided to get all my info from them and an associated company who supplied the faulty phone that led to the problem so i can assess my situation. The associated company have sent me my information, VODAFONE have not and are in serious default of the SAR. I am now so annoyed with their poor customer service that i want to take all my issues with them further including them unlawfully ruining my credit score. I guess that i should now write to them complaining about their lack of compliance with my SAR, should i also complain about the rogue marker as a combined complaint/letter before action for both issues (non compliance with SAR and rogue Default marker). I have researched Durkin and a few other cases and i feel i have a strong case. Should i deal with both matters seperately or together?

  19. Hi All Just wondered if anyone could please give me some advice? We have a Welcome finance loan and have had one for many years. It has always been paid on time and we have previously claimed back out PPI on the loan. Our concerns came when we looked at re-mortgaging our property last year and the mortgage advisor noted and brought to our attention some discrepancies which he found on our credit file etc - he advised us to check the legality of the loan etc. Since last year (Jan 2012) i have been writing to them trying to obtain copies of our documents, but got the run around. It was then in September that i managed to track down the actual branch where our loan was managed from as our account had been passed around many places??? the lady advised me to write another letter as the previous letters remarkably had not been recorded and send a 10.00 fee which i did. I did question at the time why this was not the usual 1.00 fee but was told this was welcomes fee. In October 2012 we then received a letter confirming receipt of the payment and that our request could be processed once we sent off our documents of identity which i did straight away. In November 2012 we received a letter to state that our request was being processed. January 2013 still no paperwork or letter received from welcome other than our yearly statement, so again i wrote to the head office to the contact who had sent the previous letter. Today i have received 2 letters one to me and one to my husband, the one to my husband states again that they are processing his request for the documents, my letter is now requesting for more copies of the identity documentation which i have already sent to them. I'm getting to a point now where i'm questioning if there should be a time period within which we should have received this documentation and where do we go next?? I dont want to suddenly stop paying for the loan and wreck our credit report incase everything is cosha but i really do not believe it is and if its not i want to claim back what ever money we can from them! Could someone please also advise is ASU - accident, sickness and unemployment another insurance which was added onto loans like PPI which can be claimed back?
  20. Hello, Looking for some advice on a claim against an old Alders store card that Creation finance took over. My card was between about 1996 - 2005, however after sending a SAR to Creation finance they have responded with the following: "We can not provide you with a Data subject access because the account is closed and no longer active. We are no longer holding details of your client on our records. You will appreciate that documents request under section 7 of the data protection act 1998 cannot be supplied, however I can provide all available statements from March 2004 to November 2005" - Is this information correct that they are telling me as they have cashed the £10 cheque that I sent them for all records? - On the statements that they provided it only states Interest charged at 2.00% per month - does this mean that no PPI was charged to this card?   21. Hello All, I have received the attached "SAR" reply from Barclaycard and would like some help please? I better give a brief history of the problems. I went through personal and financial difficulties in 2001, I had "unmanageable" debts and basically stopped paying everyone. I had, or rather still have debts with Barclaycard and other organisations who walloped me for charges, left, right and centre. I am still paying these off on a monthly basis to Link and trying to cope on a limited budget. I then found this forum recently and have been intently reading as many threads as possible. I have SAR'd every single financial institution that I had debts with. Back to Barclaycard, I have received the attached response to the SAR request that I sent to them. 1) I can view the letter and THREE statements as, the balance shown is "purely" Default charges as their letter implies, go back six years and try and claim them all, bearing in mind, these were actually in 2001 and not 2007 as their statements imply. I am not sure if I view this as Barclaycard trying to help me by suggesting I claim these but forget about going back to 2001 as their statements are dated February, March and April 2007, just within the last 6 years!! 2) Write back and say I am not happy with their response, as I actually had two Barclaycards with them at various different periods, the other one being approximately 2003 to 2007, that I was also hit with charges on. Any thoughts or comments please?
  22. Hi, I've just send my ppi claim letters of to capital one and mbna. I'm going to now write to them for my sar just to speed things up. Just 2 questions will my sar contain a copy of my original application? Also do I address my request to the same address as my ppi claim? Kind regards Stuart
  23. Hello All, I have recently started "clearing up" all my financial arrangements and am slowly receiving my CCA and SAR requests that I had sent after reading the threads on here. I have received a CCA today from The Capital Bank after duly sending them my £1 fee. The response is clearly marked "No PPI", so I presume that they were able to "find" my agreement, I wonder if they would have if it did have PPI on there!!! The agreement is dated April 1999 and shows an "Administration Fee" of £55. I have long since paid the loan off but is this something that was legimately and legally charged?
  24. I've had six accounts with HSBC since first banking with them nearly 20 years ago now. What I would like to know is do I have to send off 6 SAR's thus costing me £60, or can I just send off one with all the account numbers in it? I've read the SAR and it does say to hand over ALL information on me. Well all info would be all accounts...Yes...No? Thanks
  25. So I sent Barclays a SAR Request and included the credit card details in the letter. I am still using the card and have a balance on this. Barclays responded saying they can not send the SAR because it is possible the account has been closed for more than 6 years and therefore they have no records... Well that sounds like a crock of..... I beleive they assume I am chasing PPI (why else raise the 6yr mark?) The card is definitely still in use. I guess a response back saying the card is in use (with a balance printout enclosed) is the way forward... I know the card is older than 6 years is there anything else I can do to force them to get all the older documents as well?
