  7. If you get your details from CRA (Equifax etc) and the debt is not on there (via a default) then it's statute barred anyways... If they've gone passed the 12 days + one month deadline, then you'll need to write to them again using a letter re statute barred debts...You'll find the letter you need here >>> National Debtline England & Wales | Debt Advice Also you can let them know that you are reporting them to the relevant authorities because they are trying to claim on a debt that they have no right to...Keep up posted...

  9. Holly- I've got a big argument going on with Bryan Carter at the moment. They have not got a Consumer Credit Licence. I am talking to Local Trading Standards on monday re this lot and OFT have asked me to file a complaint. Me thinks they're trying to hide behind the fact that they're regulated by the Law Society, but they (Brian Carter) contraviene many of the OFT guidelines re debt collection- They've a 0870 number for a start...Send Bryan Carter (NOT JD Williams) a CCA re this account (templates in the library) with a £1 postal order and recorded delivery. Add on a paragraph in your CCA request that you're contacting OFT regarding their actions, and the fact they do not have a Consumr Credit Licence. The more complaints the OFT get about these sorts of companies, the better. Do not under any circumstances ring BC or take any of their calls. The CCA (if sent to Bryan Carter) will get them off your backs, and the CCA request will still have to be honoured...
  10. From date receipt of your CCA request, they have 12 working days to comply- or else they are in default. If after 1 month (of the 12th day) they still haven't complied then they have commited criminal offence. If you haven't sent a proper CCA request (with a £1 postal order) then it might be a good idea to do so...

HAHa...Yeah..I think I will...but will give them a little more rope yet...This 'debt' is one of those KingsHill No. 1 things...Got a letter (years ago) saying they own it, and as far as I'm aware- still do, as I haven't heard anything to the contrary. I haven't a default from them on it- altho I do have one from barclaycard..The thing is; taking charges into consideration, they owe me a little more than I owe them...Hmm wonder what WW will make of that..
  12. Cabot are at it again- via Robinson Way...I sent a CCA 5 days ago and I already have a reply, the letter starts as follows: ' We acknowledge with thanks your payemt of £1.00. The balance outstanding after crediting your payment is stated as above. As the account is long overdue for payment, (and get this next bit) we cannot at this stage accept repayment by such small amounts' Now if you don't laugh, you'll cry!! So, just 40 more days to wait before they hang themselves...
  13. Are you sure account is closed? If there's monies still owing on it, it's doubtful that it is.. Is it still with Cap1 or have they sold it to a Debt Collection Agency? Add up all your charges and then send a prelim letter asking for BOTH refund of charges and default removal. Default removal is only likely if you can proove it (the default) only came about because of unlawful charges...Read up as many threads as you can (specially on Cap1 forum) as lots of people have lots of knowledge and they can help you.

  16. In light of the recent massive fine for this lot (re the laptop) I'd report this matter to all concerned...Claim for compensation maybe??
  17. First - Letter to legal at Crap One over the the CRA entry second - S.A.R - (Subject Access Request) to Crap One asking for ALL documentation and all data held by them on your account. SAR template letter in Library and send everything to everyone recorded delivery. Hope this helps to get you started. Not meaning to Highjack here....Battle-- was going to PM re my fight with CAP1 and the CCJ they put on...Where best to put my question to you?

The original time limit of 12 working days has long since passed, and the 40 day deadline after which Cabot Financial (Europe) Limited will have committed a criminal act in failing to comply with my request, is rapidly approaching. Hmm. He really WILL know who Seahorse is by now. I wonder if these specs will fool him? LoL, and why are you being so kind to this mob? Don't think you should have reminded them that they're about to commit an offence

  21. How far are you in with this claim??? Is what they've said about not removing it, something only discussed on phone?? If so then it's a simplerule...don't discuss anything on the phone with them, put it all in writing...When you send off letter for prelim payment (via the templates) make sure you tell them that you want, as part of the claim, the default removing...
  22. Thats the one...Send a SAR to Cap1 with the £10 fee (Postal Order). Make sure you let them know what your PREVIOUS address was, just so they cant get confused lol...Once you receive your statements back, you can begin your claim. Might be a good idea in the meantime to send a CCA to the Debt Collection Agency. That letter is also in the templates section...There's a £1 fee that will have to go with that letter. Send them both recorded delivery...Keep us posted of your progress or any other questions you have
