A few people going this route at the moment, I'm on the same road as you and will be sticking with contractual rate of interest....There's a letter on here from someone who had the same thing a few weeks back...She sent reply to cap1 and they rang her next day and paid it all back in full (thats the contractual) Paul

Please count me in on this CAP1 complaint thing..I have my own thread re CAP1 (any help to my questions would be greatly appreciated)...When CAP1 tried to get hold of me after I changed our phone number, one of their agents rang my next door neighbour in attempt to speak to us..they tried to get my number from my neighbour too!!! My neighbour doesnt even have a card with them,,now I wonder how they got his number! We were receiving up to 10 calls a week at one stage...Im going to hit cap1 with the highest interest rate possible...Already got court order (through Brian Carter Solicitors) on this account,,all because of the £500 odd charges on a card that had a £200 limit!

I'm still waitng for Cap1 to get back to me re the statements, however..Their bloody solicitors (Brian Carter) are threatening me that their going to send round the baliff's unless I repay the debt now!! I phoned them and got the usual cr*p from them..I tried telling them the account's in dispute but they wont listen...Help...what do I do now??? I have written this letter to Brian Carter...Is this letter ok ?? 02/02/07 Your Ref: XXXXXXXX To Whom It May Concern: Despite several attempts to make your members of staff aware of the current situation regarding my account, they still continue to be rude, arrogant, ignorant and unhelpful (according to many reports this is not unusual for the staff at Brian Carter Solicitors- I was just making a point), so I am left with no choice but to write to you. I live in hope that this letter will be logged and understood. THIS ACCOUNT IS IN DESPUTE WITH CAPITAL ONE BANK (Europe) plc.   9. Get your last 6 years statements first and foremost, then go from there. I get the impression you're going to claim back more than the -£700 ? As for the loan, is it an agreed loan? If so, then they can't suddenly demand it be paid back earlier than the signed agreement. Once you receive your monies back, it may well be paid into your account, but at least your o/draft gets paid off, and perhaps some left over to indulge yourself with...Keep us posted...I've just started a claim with HSBC also

  12. Well, now I'm wondering if all small claims will be this easy...I was going to start a thread when I sent my LBA (which I assumed would be this Tuesday). I sent my 1st 'request for payment' letter 11 days ago..Today (saturday) I got a letter back from Nat West offering me a full refund- which incidentely is for just under £300...I know it's not a massive amount but it's nice that they're paying me out after my FIRST 'request for payment' letter. I had added a pargraph of my own to the template letter, saying that I'm fully aware what Nat West procedures are re bank charge refunds and that I'm fully aware of just how much money they've already paid back..Don't know if it helped me getting my charges back so quickly (not even a LBA required) or it was just the fact that the amount was relatively small..Still, a success is a success, no matter how large or small the amount of money is...I bet that my HSBC and Capital One claims aren't nearly as easy- more's the pity
  13. Well here goes... 06/01/07 Have just written up, and got ready for posting, my SAR for this bunch... Just wondering if anyone can answer a question or two re this..Account is with Cap 1's solicitors, and a judgement has already been granted on this account..however, account is still 'open'..The limit on this card was measly, yet balance is showing as over £300 more than what the CC limit amount was (all has to be charges). When I get paid out on this, are they likely to send me cheque or pay it against the balance? However, the biggest question here is; If the charges are unlawful and the only reason the account got sent to Cap 1's solicitors was because of the charges, how do things stand then? I know that I can get the judgement overturned, but what about the charges I've incurred (approx £100) for it going to court in the 1st place? Hoping someone can answer these queries.. Cheers ..
  14. I walked into nat west and got a no-strings attached account. No problems at all, took about 10 minutes to set up in branch...Good luck with your claim...I'm just waiting for my statements before I start mine against the HSBC..

  16. But here's a point to consider...What about all the payments (for these charges) that they've already paid out for?? What, are they going to suddenly start saying it was 'charges' for these people but it's 'services' for all these new claimants??? That can't be right can it? Surely one just has to quote any case any bank have paid out on and ask why did they pay that person back and not me. After all, I'm claiming for money charged during the same period as all those others you've paid money back to..That'll be my defence
  17. What a fantastic site!! Anyway, after spending a few hours here reading different threads I've decided to go ahead with a claim against HSBC. There are a couple of question I have to ask just before I send the DPA letter. We (me and the good lady wife) had the account from 2000-2003/4..However, we go so behind with things that we had to stop using the account. We've had countless threats of court action since, but still they haven't done anything. The account is still 'open' though, as (unbeknown to us at the time ) a company sent us some money they'd owed us for ages, and it went directly into the account with no problems. We know this because a) I phoned up and was told that the account has never been closed and b) the money owed on the account (on these threatened court actions) has decreased by the ammount that this compnay paid in.....so that's the background... Anyhoo, I just need to check that I can still claim these charges (around £1500 at a guess) even though the account has been 'inactive' for so long and that there's threatened court action going on...Any ideas? Can I just say sorry for asking,, that's if this sort of question has already been answered elsewhere...I've been reading all sorts of threads for hours and haven't come across a similar one yet...Thanks for your anticipated help...PH
  18. Fascinating read this post..has inspired me to start my own claim with Nat West (It's only £300 but what the hell eh?) I just rang them actually, and they're going to send me all my statements from last 3 years (only had account that long), and it'll only cost me £5, have to say that the lady I spoke to knew about the BBC prog gone out tonight and she was REALLY nice to me and very helpful!! -- hmmmm, sign of things to come I hope!
