  1. Hi, I have a claim with HSBC that was stayed panding the Test Case - can anyone give me a general update on what's happening with the case brought by the OFT? It all seems to have gone a bit quiet.
  2. ****e!!! OFT Case? this is the first I've hear of it. bugger. just my luck. The end in sight and now this. Ok - will send a further chaser. Should I send it via the courts?
  3. Hi, I have been given a hearing date of 21 Sept at Bristol County Court. I wrote a nudge letter to DG sols some weeks ago offering to accept £1600 against a claim of £1800. Heard nothing back. What is likely to happen next? Given that the hearing is only just over a month away, I'm not sure it's worth applying to bring the date forward. But are DG still likely to roll over as the date looms nearer? Or will they let it pass and I win by default? Surely if I ring them up they will be amenable to settle earlier? Any advice greatly received. Thanks

I send Dg a standard nudge letter - I was considering dropping my claim from £1800 to £1600 - see if they take the bait. If not, then I apply to Court as per your instructions. Sound good?
  5. Hi there, HSBC have entered a defence and I now have a Notice of Allocation to the Small Claims Track (Hearing) dated 20th June 07. I havent yet sent a nudge letter to DG - can I do this now? Also, if DG dont move, do I really have to wait until 21st Sept (the hearing date) for resolution? Are DG likely to turn up to the hearing? Any help much appreciated - feeling worried

  7. Hi, After submitting an MCOL, HSBC have entered a defence. I have received the Notice of Transfer of Proceedings which is dated 11th June 06. It has been transferred to my local court - Bristol. I'm currently just sitting here waiting thinking 'there must be something I should be doing'! I have never received any communication from DG sols. My claim is for £1800. Can anyone help by advising what they would do now? What is the timeframe? Should I expect DG to chicken out before the case is heard? Do I just wait for it to go to court and then HSBC dont turn up (as Ive heard!)? Sorry for all the confusion. It's playing on my mind - I dont want to have to pay their costs:(
  8. Hi - sorry to be an ignoramus - but Im still a little confused as to what I do now. Here's a summary - any advice would be greatly received:- - MCOL showing as "Defence" - Ive never had any communication from DG Sols whatsoever - I thought the defence was entered Out of time - Do I now approach DG with a reduced offer to settle? - How do I find out which Court? (Im in Bristol) Thanks

  10. Thanks so much for your support and advice folks. One things that does concern me - I changed address AFTER having left HSBC to go to Halifax. I did inform them but they said I needed to go into a local branch. Im therefore worried DG, Court or someone else may have corresponded with my old address. HOWEVER, the MCOL was entered with my new address so Im quite sure DG/HSBC/Court should have been writing to my new address - but ive heard NOTHING whatsoever from anyone. Im also confused as I was checking MCOL regularly but am not sure when the Defence was filed? Im sure they are out of time as it was still showing as stauts "Acknowledged" only a few days ago (Date of Service was 06/05/06).
  11. Hi, My MCOL dates from 06/05/06. 28 Days expired and I'd heard nothing - not even a reply from DG sols. I went online today expecting the best and it says simply "Defence" with a date of 01/05/07. It also says my claim will be transferred to a local Court. How can this be when I havent even received the Defence in the post????
  12. Hi, I've now had my claim acknowledged by HSBC (via MCOL). The guide states I should send a schedule of charges to DG sols now. Is this right? Surely I should wait for them to make contact with me?
  13. Help!!! sorry, now not only have I inexplicably lost 2p on my original claim, I realised I cocked on a date so the interest is less. I have already submitted my MCOL at £1713.29 plus 222.29 but it should have been £1712.91 and £221.91 interest. What should I do??
  14. thanks very much folks, Ive re-calculated and now have (nearly!) the figure I entered as the total claim plus s69 on MCOL. However, a couple points. 1. I calculated the claim plus interest on 30/04/07 - but the date of issue is 02/05/07 - do I recalculate the 'days since offence' and therefore also the interest - in line with the new date? 2. Despite all the formula, figures and dates being identical, Excel is rounding fractionally differently from Works (where I first saved it) and therefore my schedule now reads £1713.01 instead of £1712.95 which was the originally claimed amount on MCOL - will this matter?? Thanks !
  15. Hi, Used the simple spreadsheet to calculate s69 8% interest. Saved it on my hard drive and then entered my MCOL. However, I now need to send a schedule of charges x2 to MCOL but when I go back into the spreadsheet it has calculated more interest cos the formula goes on days since offence to TODAY's date - not the date I issued the claim. Sorry to be thick - how do I change to formula so it goes from the day of offence to the day I issued the claim (01.05.07)??? Thanks
