  1. If you payed a default off and the DCA accepted a partial settlement, would it still 'drop off' your credit file 6 years from the original default date, or would it then count as 6 years from the date you partially settled?
  2. Bump. Can I still go to the ombudsman if Barclaycard have completely ignored my FOS questionnaire?

  4. So, If they cannot provide a signed credit agreement, and they have placed a default on your file, is there a way to get it taken off - for people who can't afford a barrister?
  5. Hi dx, The letter in post 19, was in response to the letter in post 18 (just basically saying I was mis-sold, and I'd like a refund). I have not had any other response from Monument, Carol ONeill, or Barclaycard. BC seem to have ignored my FOS questionnaire (sent 16th Sept) and letter asking them to respond.
  6. Today, I've had the following reply from Monument. What do I do now? Barclaycard do not have earlier statements, and they have ignored my FOS questionaire, and letter asking them to respond.

  8. Just write to Carole ONeill, asking for a refund? I'm rather loath to send another £10 only to be told they don't have the early statements or there was no PPI on it.. if there was PPI it's not going to be a huge amount either.
  9. I've received a response today regarding the 'missing statements' letter I sent, it says they are unable to provide the information as they only hold data for this account from Aug 2003. Do you think I may get earlier statements by writing to 'Monument' instead of BC? I'm still awaiting a response for my letter asking them to respond to my FOS claim.
  10. I've received a letter today from Barclaycard. It states that my case has been passed to them for further investigation, and they will write shortly with a final response. It also states "If we find you were mis-sold the PPI policy we would like to refund by your preferred method. Please can you complete and sign the enclosed payment preference form and return it within 10 w days. If your complaint is upheld, you will receive payment within 28 days. The form gives a choice of bank transfer, or cheque.

The disclosure of personal data is incomplete in that the following documents are missing :- You have failed to provide a complete list of transactions and charges for the period from when the account was opened until 07/2003. You have only provided me with statements for the Providian account XXXXXXXXXXXXXXX for the period covering 08/2003 to 01/2006. However this account was opened 11/2000. Please could you to provide me with copy statements or account data from when the accounts were opened as above. Accordingly, I have to tell you that you have not yet complied with your obligations under the Data Protection Act 1998. I expect my personal data to be sent to me within 14 days, as my original Subject access request was made on 29/06/2013 and this data should have been supplied long ago.   15. Hi ims21, I have not done anything about the missing statements, I don't know which template to use of if there is one for this. I received statements from Aug 2003, but I think it was opened 2000/01. I also received this which appears to be for the providian card, but the date on it was not properly shown.
  16. I have an ongoing PPI claim for an old Providian credit card. The card was taken out approx 2000/01, and went to a debt management company in Sept 2002. The card was settled in Dec 2007 through 'Cabot finance'. I am not 100% sure there was PPI on the card, but think there is a very high chance there was. Here is what I have done so far - 1st July 2013 - SAR posted (eventually received some statements but not all - ones possibly showing PPI were missing). 16th sept 2013 - Providian FOS questionnaire sent to Barclaycard 51 Saffron Rd (Del'd 18th Sep 13). My reasons were I was self employed at the time, and I was pressured into taking the PPI. I have not received any missing statements, nor heard anything at all since sending the questionnaire to BC, and it was received by them 3 months ago.

  18. Can anyone point me towards a letter I can sent for my Providian claim? I sent the FOS questionnaire on 16th Sept (they received on 18th), but have heard nothing at all about it.
  19. Could I get some help with this letter? On 'Point 1' I want to say about being pressurised', but am not sure how to word it. Also, can I add 'point 2' (I didn't know I could get a policy elsewhere? didn't put this on my original FOS Q, is it too late to add it now?
  20. Hi Slick, The reasons I gave on the FOS Questionnaire was I was not keen on taking PPI and told the assistant, but they were pushy, gave a hard sell, and implied I should take out the PPI to give me a better chance of getting the BC. Thanks DX for the link.
