  2. I find that this is a highly abusive story. The banks have a custom and practice right to combine accounts so that they may take from one account to remedy a problem in another account held by the same customer. This suggests to me that there is the same facility to take from one account in credit to put money into a second account in debit in order to avoid problems and charges. In fact their duty to mitigate their losses suggests very strongly to me that they should do this - but in fact they never do. To me it then follows that where one account is a feeder to another and it is clear that the feeder does not have the money to source into the receiving account that they should avoid ther loss by not activating the payment - as you suggest. Of course you are dealing with banks who will operate the rules always in their favour even when there is an ambiguity in circumstances. The bank has a fiduciary relationship with you and I am convinced that they have a duty to resolve any ambiguities in your favour. I hope that you are going to claim the money back. Use my post as a basis for your letter - although they will not pay any attention, of course.
  3. Get it in writing - also is the interest frozen? If it isn't then the debt will go up and one day you will find that they have sold it on.
  4. If they are unfriendly to you on the phone, you should get the name of the person you are speaking to and then tell them to keep a civil tongue in their head or transfer you to their supervisor.

  9. You'd be surprised. We have discovered that almost all of the banks have substantial number of CCJ's against them going back some years. They are not concerned about it. We will publish lists soon.
  10. Not being admissible means that the judge won't hear it or won't consider it when making his decision. It doen't mean that it is not included in the papers.
  11. They probably will refer to it in their defence but it is not relevant to the issues which you are raising.
  12. The time for the DPA response hasn't expired yet, has it? If it hasn't then I would wait and send them an abrupt reminder. If it has then I would refer to the fact that they haven't complied in your claim. I thihk that you will have to do this in an N1 rather than Moneyclaim.

    Please can we have a copy of this email - admin@bankactiongroup.co.uk If you beleive that this alleged £15 is more than the real cost of bouncing the DD etc then you should still claim. It will be interesting to see whether the banks will now claim that £15 is the real cost or whether they now say that their charges are in line with the OFT's recommendations. My bet is that they will say the latter - which just about says it all, really.

In addition to the above, at least:- Supermarkets and major stores closing for a 2 hour lunch Banks which close for 2 hour lunch Staff abandoning tills 20 minutes before this so that they can stock up shelves and enjoy a full lunch break Supermarkets which close for 2 whole days in order to stock-take once a year. Less than 20% of shop tills at any one time and black looks if you ask for another one to open. Staff who simply wave in a general direction if you ask where a product is Staff who don't know the layout of their own stores Shops which sell the item but won't stock the batteries Shops which sell large items but only have small bags Sandwich bars which will make you a salad sandwich or a cheese sandwich but won't do you a cheese and salad sandwich because it's not on the menu Even large stores which won't accept credit card payments for less than £12.00 Supermarkets which are so concerned about their stock levels that they prefer regularly to run out of items rather than make sure that their customers have what they want. restaurants which are happy to provide their customers with ashtrays n the no-smoking ashtrays and think that you are being unreasonable when you ask for smoking not to happen in order to protect yourself and your children. Major banks and stores closed on Mondays Banks which refuse to change a large denomination banknote and tell you to try one of the nearby shops. And I could go on.

  20. Actually I disagree that this is a British disease and I very often think that British standards of service at the personal face-to-face level are really quite delightful. I can think of at least one place where poor and morose standards of service are more than a disease, - they are positively genetically endemic.
