What did you put on your particulars of claim when you filed your claim? Also did you include a schedule of charges??? -
halifax wont remove default.HELP

You need to be careful here, as you can see from Jonh's case although both defaults and charges went hand in hand the judge refused to entertain the issue of charges as it had been settled previously, It looks like to stand any chance of winning a removal of a default and charges you need to bring both issues to the table at once....therefore do not accept a settlement in the case of charges if you want to deal with the issue of defaults with them too. -

Right, Firstly you need to fill in an exemption form for not paying court fees, http://www.hmcourts-service.gov.uk/HMCSCourtFinder/GetForm.do?court_forms_id=168 you can fill it in online and have it ready to bring to court along with your claim form and schedule of charges. Secondly defendants name and address is just barlcays bank and their head office registered address which is church hill place. Brief details of claim would be something along the lines of claimant is claiming a return of bank charges and penalties imposed on claimants account by the defendant. Yes fill in schedule which will add 8% to each charge if you are using Vamps spreadsheets which can be found in Bank templates library,. So for now you need to bring to the court to file your claim Exemption form plus proof of tax credits (link will give you more info) N1 form - 3 copies Schedule of charges - 3 copies Make sure it is all signed. Thats all you need at this stage. Hope that helps.

Why is the bank one not revelant?? I sent the lba from the library but adjusted it to suit my needs, I have learned over time that the above they sent you is complete rubbish and intended to fob you off...

You will be waiting for a SAR request from these guys, they are very slow at providing the info...keep on at them, I rang and read the non compliance bit out to them over the phone and hey presto got my info.... Just an update, judgement for claimant issued on 31st Oct, lets hope they either pay up or forget as I really do not want a set aside now...christmas is coming and the goose is getting fat and all that
