  3. Hi eie I have to say that when I complained to the FOS in March they were exceptionally good. The adjudicator was on my side all the way and was very disappointed when we discovered that there had actually been a missed payment from me in 2006 that had got overlooked. I have had poor responses from them over other complaints but I think a lot depends on who looks at your complaint and how keen they are on their job.

  6. Hi all I have sent my complaint in to the FOS today. I have pointed out that the problem of these alleged arrears has only occurred since my last complaint made to them in March 2009 because capstones: 1, claim to have made a mistake with the amount i should of paid back i,e I have paid too much 2, they found more incorrectly added charges 3, they add interest on the charges but forget to refund it when refunding charges 4,they have stated they pay the charges from my monthly payment first then the rest so automatically causing arrears 5, they now state that my 3monthly letter stating what my payments should be are only a PREDICTION and always seem to be under rather than over, so causing more arrears 6, despite having an agreement to pay by the 10th of the month in place for several years they now tell me that this incurs extra interest because of the de laid payment 7, despite the above agreement they now (since the 1st complaint) automatically add late payment and arrears management fees and then take them off again a couple of months later........all incurring extra interest which does not seem to be refunded. Basically they have got their selves in knots making all these mistakes and made a complete mess of my account! eie please use any of this in your letter. And if any of you guests think you can work out who I am to be quite honest I don't give a flying f**k I have had my fill of crapstones and i will go all out to fight them now
  7. Hi Well that's what I thought. They say that because the letter states that it does not take into consideration any arrangement you may have set up this covers it. I have had an arrangement for the last 3 years to pay by the 10th of the month and this excuse has never been used before AND they have never claimed that there were arrears because of this! I have my complaint form to go to the FOS nearly done and so will be off in the post on Monday. Capstones are complete idiots as far as I am concerned. I also queried some transactions on my account that had no explanation. They said they were due to charges that had been added and then considered an error. Trouble is they never notified me that ANY charges were being added and the amounts don't tally with any of their charges!
  8. Hi I have just had my second response from crapstones regarding my complaint re alleged arrears. Can I ask those of you who pay them, when you get your letter stating what your payments for the next 3 months will be do they take EXACTLY that amount stated in the letter if you pay by DD and if you pay by other means is that the amount that you pay? In my letter they say that this amount is a GUIDE and I should phone to get the exact amount so therefore I am under paying each month which is why I am in arrears!
  9. This might be a silly question but in that article i posted the FSA said they could not regulate the foreign owners of the mortgage books ONLY the administrators. So if crapstones become the owners of SPML and then claim to have the legal right to possession would that not mean our mortgages come under the regulation of the FSA or would it still be a case of the SPV's holding the legal title? Would this not put the SPV's at more risk because the FSA would then have the right to look into the mortgage books if crapstone are claiming ownership? Or am i getting so confused (not hard lol) that I am seeing it wrong?

  15. seems they are considering the insolvency of SPML as well required by the Issuer (with the consent of the Trustee) or the Trustee (the "Mortgage Administrator Actions") if the Trustee considers that the Charged Property or any part of it is in jeopardy (including due to the possible insolvency of a SPML or SPPL) where legal title to any Mortgage is vested in SPML or SPPL, as the case may be. and my securitisation is included so ryde can you pm me too please.

  18. Hi So sorry to here what has happened. Try Shelter they have a good record for helping in situations like this. Shelter England - The housing and homelessness charity Who was the original mortgage company and who took over? Did your mum attend the court hearing?
  19. Put a complaint into the FOS about the way you have been treated.
  20. Sounds like they have been taking lessons from A&L as they did the same to me and are still trashing my credit file 2 years on. I had the account has been terminated but when the CAB phoned them they said that it was still open but they had restricted my access! I went to the FOS and got compo off them but it didn't solve the problem.
  21. Do you also have a mortgage? If so ring them and find out if they had been informed by Blemain of the repossession. I believe (but may be wrong) that the first chrge has to agree when it is a second charge going for re-possession. You may find that they will not be happy with what Blemain have done. There are lots of threads on here about Blemain, you are not the only one being mis-trated by these sharks. Good luck

Well I would like to know who sends the letters telling you what to pay for the next 3 months because I have just discovered that the "arrears " they claim I have are due to someone not giving me the correct amounts and failing to use the calculator properly when explaining how the "arrears" are made up. Wonder if the change of account number means they are so overdrawn that they are changing banks to stop the payments made being swallowed up in charges lol
