The one I won was against a secured lender. sub prime but not SPML. They are as bad if not worse though as they charge you £250 as soon as you are late with a payment for passing you to their in house collectors.
They ignored all my letters and faxes but in the end I think they gave in because i was not going away even though I was right and they were wrong.
They were in the press recently for the re-possession that cannot be for 5 years;)

I think at the time I complained ( it was about them taking payments and not applying them to the account so I wanted them back) the FOS had not been given the remit of loans. Will have to try and find the letter to confirm.
I won anyway, took me 6 months of pure bloody minded persistance though!

I wonder if our friends have been referred for enforcement action. I have had trouble paying last month and this month and have had to do it in dribs and drabs. Normally that would start the phonecalls and letters but so far nothing. Very strange.

Have just checked the fees and it is £60 per month arrears management fee and the £115 litigation management fee is ONCE they have instructed solicitors to begin legal proceedings.

The case I took to the FOS was against UCB Homeloans (part of Nationwide) and was a first charge mortgage.
I did also try a complaint against Blemain but the FOS said that was not under their jurisdiction.
So some you win some you loose but after the BBC report about the Blemain case yesterday I would say Blemain are begining to crap their pants a bit he he
Sparkie very kindly gave me lots of advice about my Blemain agreement but when I approached some solicitors about it they said it was sound and could not do aything so I have just been binding my time over this not sure where to go with it.
littledotty you should read this especially pages 5-8 and then ask capstones to explain why they don't practice what they preach!

Well I got a letter from them yesterday but it was to tell me I was in arrears by £85.
I have written so many times now asking them to explain how and when and what for but all they do is send another letter sating I still have arrears.
Will sit and do a big complaint at the weekend ....again!
It definitely seems they are desperate not get a court ruling against them !
perhaps they are trying to avoid being brought to the attention of the FSA......poor souls!
