Depends, what is the reason for the claim . . You have overpaid for the past 10 years but why would you do this and when did you realize ? . Depending on the reason and the known knowledge from yourself would depend on when the limitations act comes into play. check out section 32c of the limitations act 1980. The clock would start ticking from when you became aware of the issue. . .

Dazz, welcome to the forum, they are trying to "pass the buck" . this will not work. Can you post up for us that agreement that you refer too, minus your personel info. You need to send them a SAR so we can see exactly what has gone on there with you and get your claim startd. check here

It does fall out of the jurisdiction of the FOS, however you do have a claim in your own right as the limitations act only comes into play when you discovered you had been missold. They are clearly not listening to your letters as they feel they have won, I would send a "LETTER BEFORE ACTION" (lba) . If you want to do this let us know and we can help you write one but you need yo read up on this forum for the process of what you are doing. take them to court for the PPI back plus interest plus stat interest. Can you post up your orriginal letter please and dates you sent letters.

haha yeah, well im currently checking through all my settings as everytime i get a mail (sent from me as test ) it changes title to spam and i get this lol. Spam detection software, running on the system "lacey", has identified this incoming email as possible spam. The original message has been attached to this so you can view it (if it isn't spam) or label similar future email. If you have any questions, see the administrator of that system for details.

I want to configure my outlook to work with CAGmail. but I do not know the basics like what is the incoming and outgoing mail server and is it pop 3 etc. . and anything else it may ask in the outlook wizard.

Exelent Bebo that answwrs that question, I understood it to be just a letter. It is a default notice and within they have to lay out what action would be taken if not paid in 14 days. . .this action is to apply for attatchment of earnings which they will have to do through court, it is not somthing they can do themselves as only the court can sanction.

In my opinion no they cannot, and if they did I would certainly not recognise them as any company that I needed to deal with. this is an edited acc in dispute I did for somone. But I really need to go through this properly and get a new dispute letter with all the correct info in as the current one seems to be outdated.

Well in that case Carl you should keep hold of that letter as a judge will not take kindly to them trying to do his/her job.

They do not need your national insurance for anything, if they do let them ask in writing and we can see the reason why. do not speak on the phone to them. Bigcannon, your friend or you on their behalf needs to start a new thread so we can follow progress and advise accordingly. If they make a claim for PPI they will get sent cheque as the account that had the PPI on is now closed .

This they cannot do, only a court can action. my guess this letter had withour predjudice headed, am I right ?
