  1. Exactly right Major, Dawny you dont need to send the questionaire back as you have laid out your complaint out in your orriginal letter so your choice if you wish to reply. However in my opinion I think it is better to reply as it shows your co-operation and stops any delays, I would follow Majors guidence though and also check out my thread on how I laid out my reply. Let me know what you decide and ask for help if your struggling with this.

Hey Bebo, unfortunatly not. they do have a right to deduct the arrears on account before any refunds are made and this is in line with the FSA, FOS and also any judge if it went to court would allow. Personnally i agree with you they should not be able to do this as two seperate issues and its your choice how you use the monies that were unlawfully taken in the first place but we will lose any discussion on this.
  3. In my opinion I would go directly to the ppi customer concerns team . and I would drop 8 weeks to 28 days.

I would say you dont have to pay monthly installments to a DCA in the first place but thisi s another issue you really should start a thread on lol. to answer your question the misselling of PPI does not invalidate your cfrdit agreement and is a seperate issue to any other issues or disputes you may have.
  5. John, your claim is in the bag m8. . . the limitations act 1980 does not apply untill you become aware it was missold due to section 32C (but you allready knew that haha) . get ya claim in. .
  6. My dad has in the last year made 2 PPI claims against his policy with cap1 credit card due to first being made redundant from his work and then a second due to being on the sick. Both were refused as he was not covered for this. He now asked me to make claim for him as he now feels it was missold having made 2 claims and none have been accepted. He took the card out in 2002. I dont have much experience with credit cards so wanted advise on how to proceed. I have sent initial letter and they have responded saying that in 2002 there was no intervention from them regarding the selling and my dad completed application form on his own and ticked the relevent box. I need to do him a reply in the next week and need some help from my fellow CAGERS. any advise ?

As previously advised Princess, read around and you do not have to fill in this questionaire due to the fact that you have entered all the claim in your initial letter and your working to your schedule and not theirs. However if you do not send it back it will delay your claim all beit the result will still be in your favour. This is the one I used and have also passed onto 3 other ppl and all have won inc myself to the sum of 5000, however you need to decide yourself and edit it as I do not know the particulars of your claim. ..

  13. Hey Deli, lets help Post out here a lil with the figures. Your loan is for 17.000 over 180 months with an APR of 19.21. You have no insurances, but an acceptance fee of £235 . The total you will pay back on this loan is £48,621.87 The interest your paying is £31,621.87 with a monthly payment of 270.12. But we now need to add the acceptance fee to the £48,621.87 so new total is 48,856.87 divide by 180 months giving a monthly payment of 271.43 . Welcome have failed to add your acceptance fee.
  14. When you say you asked for your agreement how did you do this ? was it on phone or did you send letter, if so was it an official CCA request with one pound fee.

  17. It is is response to your question the answer being no. However the subject access request is a request via data protection act 1998 asking for all the information a company holds on you. This meens that for the purposes of complying to this request all your information for both accounts will be together and intergrated. However any collections or defaults cannot be sent jointly for both accounts.

  21. That is why they head them without predjudice so they cant be used against them, although if you claim fraud or deception which is a serious allegation it can be used in court but that goes over my head lol.
  22. Hiya Beyond, hope all is well with you and ya family. . Question one is correct, cannot be used or produced in court without both parties consent. (even then judge will probably dismiss) Question 2 will take a little bit of homework lol.
