  1. James, I am at work so not time to go through this now but just letting you know that I have bookmarked this thread and as soon as I can, hopefully tonight I will check these figures for you. Lee, the interest charge on the insurance is correct. Are you claiming back the PPI? do you feel it was missold ?
  2. Ok not sure if anyone here can help with advise but trawled the big world of the internet and its so hard to get the info. . . Im concidering buying a car transporter to transport cars Around the country for customers, however im not sure on the laws and what I need to setup with insurances etc. Do I need an operators license, from my understanding this is for vehicles for over 3.5 tonnes and used to travel more than 100KM from the base of work then tacho laws also come in etc. . . Please advise so if less than 100k I would be ok not to use tacho ? Also the spectacle lifts are MOT exempt, however I want to go for a flat bed or beavertail etc. . . Anyways anyone any advise or wanna add to my ideas, lol.

  6. John, no I didnt have to sign a new agreement as my claim was for them to compensate me financially to the state I would of been at if I had never been offered the PPI. In order to do this they need to physically give it back as you have previously physically paid. The fact you have been offered the PPI back is their admitance that it was missold so the only issue you have is how they can fairly reimburse you. Somone else was in your position and I did them a letter to send to welcome, try to find this letter, I cant just think who it was now as kinda busy but if I remember I will post it up on your thread.

  9. Lol apologies to you all for the wait, trust me when I say my wait has been more painfull hehe. . . Okies great news, I have won in full my PPI claim. they have paid 5000 in cash via cheque and also paid off my arrears of 500 (figures rounded off ) this includes the full PPI amount from all 3 loans and also interest and also stat interest of 8% . If anyone needs to see the acceptance letters from welcome mail me at my username at this site addy. The offer was made to me on the 1st March which I had to sign to accept then cheque arrived on 15th March and I have been awaiting it to clear before I posted on here as didnt want to celebrate anything premature and didnt want to say anything that may stop this from happening. ........................... Now in my opinion this is only a battle that has been won, most certainly not the war, there is still the issues of : 1) Acceptance fee being 2500. 2) 3 x MIF being applied on account. 3) figures being incorrect on 3 x agreements. 4) My account has been in dispute since November as they have not replied to a CCA request and have admited to losing my agreement so without an agreement they have nothing to enforce. 5) Phone calls when my phone number has been removed from their database. 6) Bad attitudes of their staff lol. There are loads more contained in this thread that I need to compile and now work on one letter to cover everything. the saga continues.

On the 1st March received full and final settlement of PPI from all 3 loans inclusive of interest and also 8% stat interest. total 5K cheque and paid off the 500 pound arrears on the account (figures are rounded off ) . Cheque is now received and cashed, also the 500 pound has been applied to my account and arrears are now zero with confirmed statement through post. Thanks to this site for all their help and support........ Mods please mark as won and move to sucesses. . (if anyone needs to see any of the letters from welcome in response to this please mail me at username at this site address)

Okies Lynn you have posted up the same agreement 3 times but you say you renewed your contract at the beginning of 2009 so is the agreement on this thread your renewed one from 2009 or your orriginal one from 2007 ? Either way lets check the figures on it. . It is a loan for 20,296.17 over 300 months which is 25 years with an APR of 12.87% . So your payments should be £216.28 your paying a total for interest £44,589.91 So you pay back the total of £64,886.08 (I bet thats more than you expected)providing ou miss no payments etc. Welcome say you should pay back 216.24 so if we multiply this by 300 you pay back 64,872.00 leaving a shortfall of £14.08. Hope this helps.
  12. It can be done trust me, I smoked for 15 years and stopped last September and not touched a cig since. I firmly believe if I can do it anyone can, I went through hell but it is worth it to get rid, now I see it as a pointless ritual. ............. Unbelievable .......... . . the cheek of them . . .ok you had an agreement setup, then you questioned and asked for the PPI to be removed so tey did this but was clearly not happy as they decided "if your not having PPI we will put up your APR and charge you more interest" . . . seriously crazy, check out the first agreement being 75.42 then the second being 76.98 . . . so your loan is 2000 over 24 months at APR of 76.98 . This is a monthly payment of £143.14 total interest paid is £1,435.48 Total you pay back is £3,435.48 . Now you also have an acceptance fee that they have not included onto your monthly payments so it should be 75 pounds plus 3,435.48 should be total payable 3510.48 divide by the 24 months should be payments of 146.27 a month. . . . so because they didnt spread this payment when your all finished you will still owe them 75 pounds.

Let me know if you need help on it, dont mention statue barred in the first PPI claim letter you send as its not an issue till they make it an issue, stick to a simple claim letter and use it as a defense.
  16. No need thats right. . Ah, now that changes things. . . If the debt is sold and the PPI claim is rightly claimed against the orriginal creditor then refund has to be done via cheque as creditor has given up all rights to the debt. . winner takes all. They no longer own the debt to pay themselves their arrears. . . to allow the claim and pay themselves for arrears they do not own would be nothing less than fraud. To pay the DCA would not benifit them and would then breech DPA as it does not concern them as to your balance. . .

I totally agree that they are seperate products and the restitution should be on the one unique product alone, so this states that they cannot take your monies and pay off a loan or anything else owed to them, but if an account is in arrears they can and will use the monies to clear it up. I agree it is wrong but as far as the FOS, FSA and also if it went to court this would be the outcome. Depending on a companies own legal advise they may not pick up on this and pay it out but if they do and offer full refund plus interest then they do have the right to pay off the arrears owed before paying you. Once offer is made and if it goes the way I suggested we can certainly try to argue it and put a letter together but if it goes further we will probably lose. . . If anyone else has any other suggestions or a way around this then please jump in.

  19. haha, okies in my opinion . . . Yes he does, first we will assume the loan is statue barred under the limitations act 1980 so it still exists in principal but they cannot enforce the debt etc etc . . The missold PPI is not statue barred from his point of view as in referance to the same limitations act 1980 section 32C the right of action is that the clock can only start ticking from when he became aware of the missold PPI. Once a debt is statue barred it will stay time barred, the claim of PPI will not affect that and the PPI is claimable, however the challenge we have is on response from them acknowledging the claim they can take the monies owed to you for missell to pay the arrears which will probably be the full amount as not paid for 6 years plus and they can do this . . but worth doing all the same.
