  1. Hi, I am in the process of trying to get rid of defaults on my record. The first one was from Barclaycard, the second from Kingshill when they bought the debt. Both are still showing for the same debt. From your earlier post above you contacted experian to remove both the defaults which they did. What did you say to experian for them to remove them? Thanks
  2. Hi I am up against CITI in court shortly, I noticed from the CMC sheet that disclosure is asked for. You say that you had to do an N244 to ask for disclosure. My question is, was the disclosure request on the CMC sheet not detailed enough? Cheers
  3. There is a very good chance that the interest rate you have been charged is not the same as everyone elses. Interest rates can be a personal thing. The way to work it out is.....to divide the interest charged by the total balance for the same month, then times that figure by 100. ....and there you have it your interest rate.
  4. I noticed from Citicards statements that they only show one amount of interest they are charging i.e. they do not differentiate between standard, purchase or overlimit interest. With Cap one it was easy as they showed the higher interest rate as purchase interest. How are people splitting the standard interest rate from the interest rate charged on the charges?
  5. I will be there, AL has said they will credit my account with the charges, court fee and £100 for something else. He said that they will be represented tomorrow by a solicitor (can not remember which company) so we can argue out the interest. I am claiming contractual. Funny thing is it took him since friday to credit my account with the monument win (which was contractual), but says he will credit my account on the same day (today) with my second claim without interest. Should be interesting tomorrow.

  9. The first address I posted to was my own bank who forwarded it on. Then as it progressed to LBA I started to receive replies from the address below. Barclays have said on their settlement that they have paid it because due to the amount it wasn't worth it, but it sounds like they are picking and choosing which ones to fight against depending on the value. I don't know how that will go down in court, paying for one and not the other.

  11. Millymollymoo, that is excellent. May have to use that or something similar on wednesdays CMC. Barclays have given me contractual interest on my credit card, but the same person I dealt with is refusing the same on my bank account.

  14. Bill, I am charging Capone contractual but I didn't add in the purchase interest and the claim stage. We have a CMC on wednesday and I have sent an updated schedule which includes the purchase interest to Cap One, have I done the right thing at this stage.

  17. The thing you must do is chase after them, they will come to you. They will try and draw you into an argument when you don't accept their offer. Tell them where you stand and that the conversation is over and put the phone down. This is all from experience so hopefully others do not have to go through it all. My CMC is on wednesday so I will not be calling them again.

When it comes down to settling over the phone expect them to say that..... your charges total is incorrect compared to theirs, may then follow that up with, you will have to resubmit claim may put as many as 6 different offers to you, if you do not accept (and this is what has happened to me) will be told that if it goes to court you will be liable for court costs of over £100,000
  19. Hi everyone, sorry about my rant earlier, just had to get it out. Definitely a mixture of excitement and annoyance. Anyway, spoke to A L again today, should have my settlement transferred electronically on monday, but warned him if it is not there before court date I will be seeing him. I know he is only doing his job but come on he is talking three peoples worth of trash at the moment. Apparently I will incur legal costs of over £100,000 if I go to court on my second claim for contractual even though they have paid out the first for the same. I have given that boy too much airtime and that is that. It was mentioned earlier that we were chasing the banks and that has been correct up to a point. I will not be calling again, if they do not I will see them wednesday. Oh, by the way as soon as I receive funds this excellent site will be receiving a lovely donation. This particular thread has been fantastic. Everyone helping everyone else and keeping people informed when the courts have not and it should be replicated throughout the site.

  21. Well done Jenny, this has been coming for a long time and for yourself it will be nice to have closure on this particular case. I have had a funny day today! Spoke to your mate A L about my monument claim. This is how it went.......... First of all he stated that he had sent me a letter with an offer, which I said I had not received as I had left for work early. A L says the charges figure I have sent in was incorrect according to the finance department. I told him I had been over the figures many times and they were correct and would not be changed. He then offers me approx. £740 which I refused, then £803 which was my original claim in november. I told him no way because interest had accrued by this time and it was £845.54 and as I had a much larger claim going through if I took less now then Barclays would try it on the larger claim. He was adamant that my figures were wrong so I decided to push him on the figures. I asked him how my total charges differed from Barclays. He would't answer my question. It got so bad that I said to him "you are not answering my question and it's annoying me big time" After 30 mins he says that finally says "we are both busy people, and we have things to do I will settle for £845.54 to save us both time". This may sound long winded, but it is important. Through the conversation we discussed contractual interest at approx. 27.9%. This is the sum interest rate he eventually paid out at £845.54. Later I talk to a lady about my larger claim. (The other woman who was dealing with it has left probably too much stress). The first thing she says is "your figures do not match with ours" deja vu or what. She says that the interest is more than the charges so there is no way they will pay (same again). I said that I have had a claim for contractual interest approved just hours earlier by A L. She then puts A L on the phone who blatantly says that he has not agreed to contractual even though he has sent me an email with the full amount. The really annoying part was neither of them had my schedule to hand but they argued that my figures were wrong. Tomorrow I will be sending an updated schedule of charges to them, should be interesting. A L stated that it would be quicker to send out a cheque to me rather than do a CHAPS because of the level of red tape even though I am a Barclays customer. I will be sending a letter also stating that if the cheque is not received before wednesday I will be still going to the court to show that an agreement has been made but not completed. I should really be celebrating, but it is not over as yet.
  22. Thanks for the CMC form Jenny Looks like they are fighting to the bitter end, but come on five offers in ten minutes, it just shows up how desperate they are to save a few pennies. Embarrassing really.
