Yes I have, the case is in the courts waiting for their defence. I sent them a fax with the charges and interest on which they asked for, so I am just waiting for a letter to arrive which should be anytime soon. I wonder what it will say! -
My case goes like this:- I receive letter from Brian stating that they would pay out the difference between the £25 and £12 charges. He then goes on to say that because they give me a settlement when I closed the account minus £480 I would be able to claim that amount(my balance was £1780 on a credit limit of £500 all due to charges). So it was nice for them to do me a FAVOUR. His calculations were 1780 - 480 - difference in charges = £624 He also said he would chase me for the £480 and get the case transferred to a local court to citi. I know transferring the hearing is a lot of nonsense but what are thoughts on the early settlement figure minus £480 when I closed the account?

I have had an offer from capital one after I have sent my county court claim in. The funniest thing about it is that they are willing to give back all of the charges incurred plus interest. The thing is that they don't agree with the amount of interest I am claiming. They are saying that the interest is of the "purchase interest" type and very little was put onto the charges which puts their calculations of interest at about a tenth of what I am claiming. They don't seem to understand that you can claim from date of charge to the present date. The fact that it has taken a lot of time, goodwill gestures and a court claim to get to this position in the first place doesn't make me feel generous towards them, if they had said this months ago it may have made a difference but then again maybe not but at least I may have been open to a good offer. Has anyone else had the same response after the court claim?

Sorry for not replying, I have just started a part-time Masters so I am quite busy at the moment. The update is is that I have just sent my N1 to my local court (should have been done 2 weeks ago) so should be hearing something within the next week hopefully. The total claim is for nearly £4000 inclusive of contractual interest, so it's a sizeable sum which I paid out that I want back thank you very much. How's your claim coming along?

I was told by the court person that the 28 days includes the initial 14 days they get to reply, so they only have another 14 days not 28. By the way I am in the same position but with barclays.

When I read the first part of the letter I thought well they may have a point here, but then they go off on a rant about the OFT and the £12 charge and how that it was they willl be paying minus the written off amount. Which is garbage. Then they try to scare me about chasing me for written off amount and that they would have the case changed to a local court which is half way across the country, by this time I have lost interest because I know that they cannot do that to an individual claimant, it will stay in my local court. So in effect they MAY have had a point but it was lost in the rest of the nonsense. My N1 will be sent out this week. Somebody out there must have been through this already. -
Got a reply from a credit card company saying that because my account was paid off as an early settlement, they would pursue me for the rest because I had negated the agreement. They say I cannot claim because they have effectively given me it back already. Has anybody had this response?

Just wondering if anyone's case has been thrown out on a technicality, or the courts have attempted to have it thrown out. Maybe you have moved slightly off the tried and tested path and they've tried to catch you out! Don't be shy! Let us know if it has been tried and what measures you took to rectify the situation.

What happened? -
I would like to know how many people have taken Barclaycard to court over the microfiche issue and won or in the process of taking them to court. This microfiche issue is such a problem for most people like myself who haven't even got charges after 2004 even to make an estimate with. It would be nice to see how far people have got, which hopefully should give some confidence to the newbies and oldies alike.

Time is ticking away for CAP 1. They have until friday before I hand deliver my claim to the court. Kinda getting a good feeling just thinking about it. They have ripped me off for far too long. By the way, Barclays will be delivered tomorrow Crap 1 on friday Citicards will be delivered a week on friday Platform wil be delivered next week also SPPL have until next week very busy and initially very expensive times ahead
